Regular meeting of the Fairfax City Council was held 3/3/83. Mayor James Stallman presiding. Council present Cerveny, Feight , Josifek, Shakespeare, Absent Carver. Mayor Stallman 6pened publkc bearing on F/Y 83/84 Budget. No objectors 'Present and. no written objections received, Resolution #3383 Adopting, the Annual Budget for the Fiscal Year ,End ing. June 30, 1984 Passed and approved on motion of V.. City Clerk to Me budget with the Linn County Auditors offiffg.Mayor Stallman closed public hearing.- Minutes of previous meeting, clerks report,& budget reports approved and placed on file. Receipts received,: General 20,097,33, RUT 2,764.40, DS- 51.40, Water Dept, 1 ,776.96, Sewer' Dept 4,383.85., Don Hall(Hall & Hall Engr) discussed with Council proposed changes at the inter- section of Losey and Prairie and Highway 149. Several different plans were dis- cussed. Mr Hall to consult with DOT on these changes. Also discussed was the changing of spf6d limit on highway 149. -Resolution 3383A, lowering the speed limit at adt�h city limits to 45 MPH to Stallmqn Road intersection and 35 MPH from Stallman road intersection to South city limits, presented by J. Feight 2nd V. Cerveny Carried. Iowa DOT to be consulted on this proposal. Building permits for Lots 7 & 8 Selzer Lakeside addition approved. on motion of V. C. 2nd H. Shakespeare. Permission also grant K. Selzer to install a driveway culvert at 534 Park. Star 'Hotel k Livery Liquor license approved on motion of R. .Shakespeare 2nd V. Cerveny. Lounge application for liqmor license and cigarette permit approved on motion of V. Gerveny 2nd J. Feight Petition with 24 signAtures (1,2 from ins 'de of c.ity limits , 12 outside of limits) ad and Highway 149. On motion of H. Shakespeare 2nd N.Josifek,REC to be cont,act in regard to the installation of the requested street light. Carried All voting Aye Petition with 16 signatures (10 from inside of city limits , 6 outside of limi,ts) requesting the City Coune il to post "No Parking" signs on both sides of Stallman Discussion held on this petitionland other streets that need parking reguLation changes. On motion of V. Cerveny 2nd H. Shakespeare the following "no parking" r6gulations to be instituted upon ordinance changes ,and,j'the purchase of signs Stallman Road--no parking either side. Losey Street--n,o parking either side of the NIS section of losey and, on the curve , OK to park on E/w section of Losey Park :street from Front Street to Linn Street--Parking on the West side of the street only except between Church & Main where parking will be pe,rmitted on both sides. Carried Request received from the Gene! Croys for gravel in the alley between Vanderbilt and Park. On motion of H. Shakespeare 2nd N. Josifek suEficent gravel to be put in alley from Croys garage west to Vanderbilt Street to allow acess to their garage. First reading of Ordinance 102 amenid�ng Title 6,Chapter I Section 6-1.0304 appr,oved on motion of. H. Sha�:-,espeare. V. Cerveny moved that the rules requiring three readings at three seperate meetings be suspended and that ordiTlance be approved on 2nd h 3rd readings by title! only. 2nd N. Josifek Carried Ordinance 102 read the 2nd & third time by title only and approved on Motion of .N, Josifek�c2nd V. Cerveny Carried. Mayon Stallman declared ordinanc%e passed. Resolution 3383B establishing a temporary road embargo of 5 ton on Cemetery Road East presented by B. Shakespeare 2nd V. Cervany Carried Discussion on Load Limitsupon certain streets - 5 Ton limit to be posted on Reynolds Street fron Railroad to Church as per ordinance 2.1-2.0703 and the 5 ton limit be removed from same ordinance on Railroad street between park and Reynolds street upon motion of V. Cerveny 2nd H. Shakespeare carried Mayor to sign renewel of lease with the Chicago N W Railroad on Legoon bern on motion of H. Shakesneare 2nd V. Cerveny. | (Regular city council meeting 3/3/83 con't) Two quotes were received for the replacement of the windows in City hall k Fire station. Allied Glass for S849.00 and HG II Class for: $680,.00. Motion of V. Cerveny 2nd J. Feight that UGH Class Co quote be accepted and that the-y be not if ied of same,. Carried Discussion held with Flmo Konmen and Tess Fitzgerald from Frontier Coop Spice store about the lead that occured in the water line in one of the buildings owned by them. A total of 553,220 gallons of water leaked unnotic*d because building was empty. City Attorney to be notified and a ruling given to Council on weather they can give them a pj:lce break on this bill, on motion of H. Shakespeare 2nd V., Cerveny. Billing to be sent and further discussion on this at April meeting. Gity Clerk to contact Farmers Home and ask f or an extension of time needed to refile pre—application for loan on sewer improvement prbject. Crass mowing project for the summer are to be listed and contract to be written asking for bids for these jobs. Person hired will furnish own mower. & fuel and will bid job at a flat rate not a hourly wage, Bills approved for payment on motion of U. Shakespeare 2nd V. Cerveny. Virginia Soukup, City Clerk James S llman, Mayor E E I RESOLUTION NO. - WHEREAS, the City of Fairfax, Iowa, may establish a temporary road embargo pursuant to Article 7, Section 2. 1-2.0701, of the City Code and Sections 321.471 and 321.472 of the Code of Iowa, and WHEREAS, it appears by reason of deterioration, rain, snow or other climatic conditions that certain streets will be seriously damaged or destroyed by vehicles weighing in excess of five (5) tons. NOW, THEREFORE, BE IT RESOLVED by the City Council of Fairfax, i Iowa, as follows: That there is hereby established a five (5) ton temporary embargo load limit on Cemetery Road Fast in the City of Fairfax, Iowa, and that the Street Committee is directed to post signs as prescribed. The Street Committee is also authorized to remove or reinstate this temporary embargo at any time the City Council is not in session, when the condi- tions so dictate. J �j yr : i t z n ORDINANCE AN ORDINANCE AMENDING TITLE VI, CHAPTER 1, SECTION 6-1.0304, OF THE CITY CODE OF FAIRFAX, IOWA. BE IT ORDAINED BY THE CITY COUNCIL OF FAIRFAX, IOWA Section I. Purpose. The purpose of this ordinance is to amend Title VI, Chapter 1, Section 6-1.0304, of the City Code of Fairfax, Iowa. Section 2. Section 6-1.0304, of Title VI., Chapter 1, City Code of Fairfax, is repealed and the following adopted in lieu thereof: 6-1.0304 BILLING FOR WATER SERVICE. Billing and payment for water service shall be in accordance with the following: 1. Meters Read. Water meters shall be read monthly. 2. Bills Issued. The clerk shall prepare and issue bills for water service on or before the tenth (10th) day of the month following each monthly period. 3. Bills Payable. Bills for water service shall be due and payable at the office of the clerk by the twentieth (20th) of the month following the end of each monthly period. 4. Late Payment Penalty. Bills not paid by the twentieth (20th) of each billing period shall, be con- sidered delinquent. A late penalty of One Dollar ($1) shall be added to each delinquent bill. (Code of Iowa, Section 384.84[1]) Section 3. All ordinances or parts of ordinances in conflict herewith are her6by repealed. Section 4. Severability. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Section 5. This ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law. Adopted this day of .' , 1983, and approved on the same date. Adopted, Yeas, Councilmen Bergen, Delaney, Murdock and Schaefer 0 Attest: - C i t y Clerk AMENDMENT TO ARTICLES OF AGREEMENT BETWEEN THE CITY OF CEDAR RAPIDS, LINN COUNTY, IOWA AND THE CITY OF FAIRFAX, LINN COUNTY, IOWA FOR THE CONSTRUCTION, OPERATION AND MAINTENANCE OF WATER POLLUTION CONTROL FACILITIES WHEREAS, on the 30th day of December, 1981, the Cities of Cedar Rapids , and Fairfax entered into the Articles of Agreement, and WHEREAS, it was agreed that Fairfax begin capital payments as provided in Item 4 on January 1, 1983, at which time it was intended that Fairfax would begin usage of the Cedar Rapids Water pollution Control Facilities , and WHEREAS, through unforeseen delays due to project revisions and the Department of Environmental Quality reviews , the completion date has been . delayed. THEREFORE, be it agreed that the first payment date in Item 4 be changed from January 1, 11983 to July 1, 1984.
