Park committee report on approved types of trees for planting and that Dwight
Hughws from Hughes 7,1ursery will be at the July meeting for further planning.
Street committee report: Prairie Road Builders will be in next week to start
some of the ditch work and that Linn Countles machine is still broke down
for cleaning of deep ditches. County Road supervisor to again be contacted
on this. New "no parking" signs have arrived and will be put up during the
next two weeks. Committee check" and staked corners where signs will be neededll
R. Sluiter k R. Andrle attended council meeting in regard to their construction projects
before building permits issued. After discussiog motion to approve their N_ rmit,s
and for R. ?enisek and L. Olson made by R, Carver 2nd N. Josifek. Carried
Possible changes in the issuance of buildi6g permits to be pint on' july adgenda.
Cigarette permits approved on motion of R. Co.rvc-,,r 2nd V. Cerveny, pending receipts
of completed forms and payment from PandiNart, Bobs Meats, Star Hotel, B. J. 's Lounge
and D & S Lounge. Carried
A Committee from the Senior Citizans of the area (fir & Mrs James Benda, Mr & Mrs
Wayne Fdmundson and Mr L. Dusil) ask that the coiincil consider obtaining a buiiding
for use as a community center for their and other organization use. There are
some grants available for this purpose. They also announced that a Community
covered dish supper will be held June 14 at 6:30 PM and everyone is welcome.
Further discussion on this subject at the July meeting.
Mr. R. D. Meyocks, read letter signed by 12 citizens in regard ibeir concerns
about the water and sewer dept. Discussion held on this matter. City has 60
days. to answer their claims.
Resolution 62838 Placement of Star West Cable TV dish on city property by
water tower presented and approved on motion of H. Shakespeare 2nd J. Feirht.
City Clerk to contact 3 near neighbors on this matter (Dostal ,Croy &,'Larson)
Cindy Divisek presented a petetion signed by 62 people' (35 residence,35 non
residence) propesting the proposed fence for the west, side of ball park.
H. Shakespeare made motion that fence be installed. Motion died for lack
of second. (This motion was not necessary as no formal action had been taken
on this matter at previous meeting)
D &SLounge and Star Hotel presented their plan' s for beer gardens during Hey
Dey on June 17 & 18. Approved on motion of R. Carver, 2nd H;Sbakespeare
pending Star Hotel contacting neighbor about location of fence and D & S
signing a Hold Barmless agreement with the City is regard to that portion
of beer garden on sidewalk. Carried Ayes: Shakespeare, Carver, Feigbt &-
Cerveny, Nay.- Jo-sifek. Carried.
Third-reading Ordinance 9104 being an ordirence setting out speed zones
approved on motion of R.Carfer 2nd J. Feight. Carried
Third reading Ordinance #105, being an Ordinance setting out certain No Parking
Tones, approved on motion of R. Carver grad H. Shakes,peare Carried
Mayor Stallman declared both Ordinance #104, Rz ✓05 approved and in full force
and effect after publication as provided by law...
Discussion held on certain post due water and sewer bills. Councilman Shakespeare
volunteered to try and collect them before the process of putting them on the
tax payers property as a special assessment.
Clerk reported to City Council certain properties with in the City Limits 'that bad
a tall growth of grass, weeds other vegatation in violation- of Ordinance
3-1.0102. Motion by V. Cerveny 2nd H. Shakespeare Property owners to be contacted
and advised of this violation. Carried XII voting Aye
Bob Fredericks, Green Engineering, updated Council on obtaining easements from
property owners. Meeting tenatively set for June 13 at 7 P.M.
Resolution 6283 Setting Salaries for appointed officer's and employees approved

OF TUR CITY OF FAIRFAX FOR THE FISCAL YEAR 1983-1984
BE IT RESOLVED by the Council of the City of Fairfax, Iowa
Section 1. The following positions named shall be paid the salaries

AN ORDINANCE AMENDING TITLE II, CHAPTER 2., SECTION- 2. 1-2-0409,
OF THE CITY CODE OF FAIRFAX, IOWA.
BE IT ORDAINED BY THE CITY COUNCIL OF FAIRFAX, IOWA
Section 1. Purpose. The purpose of this ordinance is to amend
Title II, Chapter 2, Section 2. 1-2.0409, of the City Code of Fairfax,
Iowa.
Section 2. Section 2. 1-2.0409, of Title II, Chapter 2, City Code.
of Fairfax, is repealed and the following adokpted .in lieu thereof:
2. 1-2.0409 SPECIAL 25 MPH SPEED ZONES.. A speed in
excess of twenty-five (25) miles per-hour shall be
unlawful on° any of the following designated streets
or parts thereof.
1. Stallman Drive from Williams Boulevard
(Highway 1.49) to Cemetery Road West.
Section 3. All ordinances or parts of. ordinances in conflict
herewith are hereby 'repealed.
Section 4. Severabillty. If any section, provision or part of
this ordinance shall be adjudged invalid or unconstitutional, such
adjudication shall not affect the validity of the ordinance as a whole
or any section, provision or part thereof not adjudged invalid or
unconstitutional.
Section 5. This ordinance shall be in full force and effect from
and after its passage, approval and publication as provided by law.

A group of Fairfax citizens request time at the June
2nd Council Meeting. The group will present some
concerns which pertain to the water/sewer situation
which exists in the City of Fairfax.

As citizens of the City of Fairfax we have some strong reservations
about the water/sewer system which exists in this community.
These concerns are presented to the Council in the hope and belief an
amicable solution can be reached in the handling and correction of the
problems we have experienced. As citizens we could have chosen a more
aggressive action. Hopefully we will encourage your corrective
measures without resorting -to a more formal resolution.
The key issue for the concern is the re-occurrence of back-up water
entering our dwellings through the sewer lines . The frequency and
severity of the situation has increased dramatically in the last year.
Experiences of individuals who have lived in the community three . . .
five . . . up to twenty years . . . indicates the last twelve months have
been the worst in their recollection.
This issue is not a new one to the City Council of Fairfax. It is one
that has been discussed on more than one occasion. The purpose of
this document is to reaffirm that even though discussions have taken
place, we are not aware nor satisfied the actions needed to solve the
problem have taken place.
Therefore, we would like to have positive indication from the Council
the necessary steps which have been discussed previously have indeed
been undertaken . . . are in the process of being completed . . . 'or' have
been completed. These steps include:
11 . A warning system which is " fail-safe" . This warning system
alerts the designated personnel to activate the additional
pumping devices necessary to insure that surface water does not
back through the sewer system and flood individual homes . As we
understand it, the failure of the system on April. 2nd contributed
to the problems experienced by many of us represented here.
2.. Pumping station reassurance. The pumping station is of prime
importance in protecting the citizens of this community from
"sewer flooding". It is our understanding that this pumping
station currently has an unusual method of keeping one pumping
motor engaged. It is the desire of this group that
representatives be allowed to inspect the pumping station and the
equipment. We want assurances that the pumps and motors are in
proper functioning condition to protect our homes from flooding.
It is also our desire ( if our inspection proves the equipment to
be faulty) the City Council will take immediate action to bring
the motors and pumps into a first class operational condition.

3. Surface run-off correction. It is our understanding the City,
promised to clear some drainage ditches which are vital to
expedite the fast removal of surface water. It is our

observation that the dredging work has not been done adequately.
Therefore, we are requesting that the City take immediate action
in correcting this specific problem because:
a. There is water standing in many of the ditches in the
community. This presents a serious health hazard to young
children, and also provides a breeding ground for mosquitos
and other insects which can be hazardous to the health of
the entire co-mmun'ity..
b. This work will help alleviate and control the problem of the
volume of surface water entering the sewer system. This
will also help prevent individual homes being flooded.
4. Renumeration: For the damages our homes have incurred due to
negligence by the City we are demanding fair and equitable
restitution. We will accept the damage estimates provided by a
mutually agreeable insurance adjuster as fair compensation for
these damages.
The City has a covenant with the citizens to provide services which
the citizen pays fora In the past year our water/sewer bills have
increased from a level. of $5-$ 10 per month to a range of $60-$ 100 per
month. For the "privilege" of paying these grotesquely inflated
amounts we have the "advantage" of living quarters being flooded and
furniture , clothes , carpets and appliances ruined. We also have
exposed ourselves to possible injury or death through electrocution .
This is not a position we like, nor will we tolerate. The City is not
living up to its responsibilities of providing the necessary
protection or service we are paying for and expect .
We believe a timetable to handle Items 1 through 4 of 60 days is.
reasonable. If we do not feel this Council has acted in good ,faith by
August 1 , 1983 we are prepared to seek alternative solutions.
