Mayor James Stallman called meeting to order at 7 P.M.. Council present: Josifek, Carver, Feight, Cerveny- Shakespeare absent Minttes of previous meeting approved on motion of R. Carver grad V. Cerveny. Carried Clerks report, budget-,`report, & financial reports approved and placed on file. Dwight Uugbes presented a street tree planting plan to the council for their consideration. A Masterp-lan will need to be formulated, More discussion will be held on this project at future council meetings. John. Feld, Area Commercial Manager, of Iowa Electric Lip .,ht spoke with the council in regard to their service in the area and answer questions from those citizens attending the meeting. 1st reading of Ordinance 106 "Amending. Article 3-Nominations by Petition" Councilmen V. Cerveny moved the approval of the ordinance on its first reading 2nd by Jim Feight.. Yeas TosiEek, Carver, Feight,Cerveny,(Sbakespeare absent) Councilperson N. Josifek Moved that the rule requiring three readings on three Carried different d s be suspended and the Ordinance be placed on its 2nd and 3rd reading all yeas .by its title , 2nd by J. Fel-g7h—t9'The Ordinance wns then read the grad and 3rd times b, its title. Councilmen Feigbt moved the adoption of the Ordinance as read, 2nd V. Cerveny. YeasJosifek, Carver, Feight ,COrveny, . Mayor Stallman declared Ordinance 106 approved and in full force and effect after publication as provided by law. Bey Dey discussion held with Legion representatives., Parking of cars seems to be the main problem. Legion also was informed that the City roust be included in the hold harmless agreement that is on the form that the partic abts in the run must sign. Legion ask council to approve the dates for Hey Deys in 1934. They will be June 15 and 16. Motion to approve made b� R. Carver, 2nd V.Cerveny. Yeas Carver, Cerveny, Nays Feight & Josifek. Shakespeare absent. Council advised Legion t i.at there would possibily be a new council after January 1 , 1984 and they should come back at that time for further discussion with them* Building- permitsfor Balogs, Carver , Star West & Oujiri and a Curb Cut permit for K.Selzer approved on motion of V. Cerveny 2nd FTight. Yeas Cerveny, Feight & Josifek. Carver abstained. The issuance of building permits was discussed. on motion of Feight grad Cerveny City Clerk given permission to issud permits for decks, porches, & storage sheds, without council approval, but if she feels building needs further approval she will contact 2 out of the five council for final T. ptoval. All building permits for housesand garages must still be approved by full council at regular monthly meetings. Carried All voting Yeas. Letter read from Brown & Dyer in regard to complaint from citizens that they did not do a good job on sewer main repair. Letter placed on file. Senior Citizens representative Barbara Benda ask council to name a committee of at least 7 citizens to investigate the building of a community center. Mr & Mrs Wayne Fdmundson volunteered to be on committee. Any one interested in being on this committee should contact the City Clerk. Discussion held on the purchasing of Errors P\, Omm-issi&ns insurance coverage for the Fire Department. On motion of J. Feight 2nd V. Cerveny council to purchase $1 ,000,000.00 coverage from Slavia Agencies for $490.00 per year. Yeas Cerveny, ,Tosifek, Feight. Carver abstain. Carried Disf•ussion of certain trees on privet t property that over hanA sidewalks, and obstruct view at certain intersections. Clerk to send letters to property owners and also to follow up with Certified letters to property owners who have not complied with letters sent to them in regard to cutting of tall grass and vegetation on their properties. Motion to approve bills made by V. Cerveny 2nd R. Carver. All voting, Yeas Discussion held with Sheriff Sawyer on law enforcement in our city and communication between the council and deputies. No formal action taken on any items discussed. NTo further business motion to adjourn at 9:30PM made by R. Carver 2nd V.Cerveny. Carried. BE IT ORDAINED BY THE CITY COUNCIL OF FAIRFAX, IOWA Section 1. Purpose. The purpose of this ordinance is to amend Title 1, Chapter 1, Article 3, of the City Code of Fairfax, Iowa. Section 2. All of Article 3, Run-Off Election, of Title I, Chapter 1, City Code of Fairfax, is repealed and the following adopted in lieu thereof: "Article 3 Nominations By Petition 1-1.0301 Nominations By Petition. Pursuant to the provisions of Section 376.3 of the 1933 Code of Iowa, the City of Fairfax hereby adopts, elects and chooses the provisions of Chapter 45 of the 1933 Code of Iowa relating to nominations of candidates for elective city offices." Section 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4. Severability. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole. or any section, provision or part thereof not adjudged invalid or unconstitutional. Section 5. This oydinance shall be in full force and effect from and after its passage, approval and publication as provided by law.
