presiding. Council present, Balog, Berryhill, Otto & Zamastil.
Minutes of previous meeting approved on motion of B. Balog, 2nd J. Zamastil.
Clerks report and budget report approved and placed on file.
Receipts to be accounted for: General Fund 3,044.77, RUT 1,376.93, DS 182.59,
T&A 762.38, Rev Sharing 1,309.31, Water Dept ,1,999.07, Sewer 5,386.22,
Building permit approved for R. Dusil on motion of J. 7amastil 2nd B. Otto. All voting aye.
John Feld, Iowa Electric Light representative , spoke with City Council in regard
to recent power outage, and type of protection that need to be made in this regard.
He is going to advise council of the difference in price of mercury verus sodium
street lights. This information will be available at the March Council meeting.
Don Kleis, Prairie Roadbuilders , gave presentation to City Council on his company
in regard to street work the city may need to do this summer giving the council
a price of .496 per square yard. Ken Jackson from Fox Lamborn quoted a price between
.49 to .60 per square yard, and would give a more diffent price later when council
decided what nee&&! Roy exalters from Municipal Street Improvements gave council
a quote of .42 per square yard plus 2.50 per ton for hauling if they haul the gravel,
A 2% discount would be given if paid within 15 daysafter completion and City would
sign a release letter ,on completion. Council to make final decision at March meeting.
Ken Selzer, Selzer Construction, ask council if he starts work on a 20 home sub-,
division in the Quarry Area if council will give permission to hook on the water
and sewer. Discussion held with council. This item to be put on March adgenda.
Clerk to get prices on changing force main from 4""- to 8", and to contact Kansas
City on progress of Flood Plain maps.
Discussion held on Prairie , 149 & Losey street intersections. On motion of
B.Otto, 2nd T. Berryhill , Shive-clattery representatives to be ask to meet with
the street committee (Otto & Balog) at 5:30 PM presiding the April 5j 1984 council
meeting, All voting ayes

contractors for the installation of vinyl siding on t1he upper portion of the fire
station and city hall. Estimates to be on material and labor (total bid cost , price
per unit not excepted) and guarantee. Presentation, bids and discussion - at March
meeting, final determination of contractor at April meeting. All voting ayes.

suspended and the Ordinance be placed on its 86cond and thYd. readings by its title.

RESOLUTION N0 . 228
WHEREAS , the City of Fairfax, Iowa, desires to establish
a procedure for the issuance of checks , drafts , warrants , and
vouchers on bank accounts of the City of Fairfax in order'
to comply with requirements of the State Auditor .
NOW, THEREFORE, BE IT RESOLVED by the City Council of
Fairfax, Iowa, as follows :
All checks, drafts , warrants , and vouchers written for
amounts of $1, 000 or more on bank accounts of the City of
Fairfax, Iowa, shall be signed by the City Clerk and the
Mayor of Fairfax, Iowa.
All checks, drafts , warrants , and vouchers for amounts
less than $1, 000 may be signed by the City Clerk alone .

Aid' ORDINANCE ADOPTING THE EXISTING CITY CODE OF THE CITY OF
FAIRFAX, IOWA , 1978 AS TITE CODE OF ORDINANCES OF THE CITY OF
FAIRFAX, IOWA, 1984 "
DE IT ORDAINED by the City Council of the City of ` airfax , Iowa ,
as follows :
SECTION 1 . PURPOSE . The purpose of this ordinance is to
comply with the provisions of Section 380 . 8 , Code of Iowa , 1983 ,
requiring cities to compile a code of ordinances at least once
every five years .
SECTION 2 . CODE ADOPTED . The CITY CODE OF THE CITY OF
FAIRFAX , IOWA, 1978 , as amended by Ordinances 1.06 through 109 ,
both inclusive , being found to be current and adequate for the
city Ls hereby readopted as the CODE OF ORDINANCES OF THE CITY
OF FAIRFAX , IOWA, 1984 , with the following amendments :
A. 'TITLE . Section 1- 1 . 0.101 is repealed and the following
enacted in lieu Hereof:
1- 1 . 0101 TITLE . This Code c;f Ordinances shail be
Rnowii and may be- c i ( ed as the "Fairfax Municipal Code"
for the Purpose of pro secatioii in the courts . "
B . DEFINITIONS . Section 1 - 1 . 0102 , sub-section 5 is
repealed and the follow iig enacted in lies_: thereof :
"8 . ' City Code " or `Municipal Code " : shiall rrrean the
CODE OF ORDMMJCES OF THE CI'T'Y OF FAIRFAX , IOWA,
1984 . ,
SECTION 3 . AMIENDMEN`T'S . All general ordinances of the city
passed hereafter shall be in the forth of an addition , amendment
or repealer to the CODE OF ORDINANCES OF THE CITY OF FAIRFAX,
IOWA , 1984 , and shall include prior references to title ,
chapter , article and section or sub-section to maintain the
orderly codification of ordinances .
SECTION 4 . REPEALER . All ordinances of a general nature or
parts thereof in force on the seventh day of February 1984 ,
and not ccntai-reed in the "CODE OF ORDINANCES--OF THE CITY OF
FAIRFAX, IOWA , 1984" , adopted herein are hereby repealed from
and after the seventh clay of February 1984 , except as
hereafter provided �._
SECTION 5 . ORDINANCES SAVED FROM REPEAL . The repeal
provided for in the preceding section of this ordinance shall
not affect any offense or act committed or done or any penalty
or forfeiture incurred or any contract or right established or
accruing before the seventbday of February , 1984 ; nor shill
such repeal affect any ordinance or resolution promising or
guaranteeing the payment of money by the City or authorizing the
issuance of any bonds of said City or any evidence of said
City ' s indebtedness or any contract or obligation assumed by
said City; nor shall said repeal affect the administrative
ordinances or resolutions of the Council not ' in conflict or
inconsistent with the provisions of "THE CODE OF ORDINANCES OF
THE CITY OF FAIRFAX, IOWA, 1984" ; nor shall it affect the
ordinances specifically saved from repeal by Sections 3 and 4 of
Ordinance No . 75 adopted in 1978 ; nor shall it affect the
following ordinances specifically saved from repeal :

ordinance establishing building lines , establishing or changing

affect any prosecution , suit or other proceeding pending or any
judgment rendered on or prior to the seventh day of February, 1994,
SECTION 6 . COPIES ON FILE . An official copy of the "CODE OF
ORDINANCES OF THE CITY OF FAIRFAX, IOWA., 1984" , adapted by this
ordinance , including a certificate of the City Clerk as to its
adoption and the effective date, is on file in the office of the
City Clerk.
SECTION 7 . COPIES AVAILABLE . Copies of the "CODE OF
ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 1984" shall be kept
available at the office of the City Clerk for public inspection .
