Mayor Feight called for comments from the floor and/or written objections . Hearing none , Mayor Feight closed the Public Hearing and Convened the Regular City Council meeting at 7 : 10 PM „ .. Council present Balog, Berryhill , Bullock, Josifek & Zamastil . Minutes of previous meeting corrected in regard to Mr . Halls statement that a 6" force main just meets the needs of the city at this time and then approved on motion of B . Balog 2nd J. Zamastil . Carried. Clerks financial and budget report approved and placed on file . Rollcall vote all ayes Mr Levi , representative. from Iowa Ill Gas , discussed with council f their service to the city and a recent rate refund . Mr & Mrs Dale Carter ask city council to write to Iowa Department. of transportation requesting a school bus loading zone sign be erected on 149 near the curve on the south city limits . Balog made motion. to this effect and 2nd by Berryhill . Carried all voting aye . Sheriffs Dept to be notified to check this area for cars not stopping for the school bus when they are unloading children. Building permit presented by Liberty buildings for a building being built for J. Patterson/Don Share at 506 Williams Blvd. Motion to approve made by Josifek, 2nd Bullock. Builders advised .of the natural waterway through the area and the side yard measurement of 10 feet that is necessary. Joe Morrissey, owner of J.R. ' s Prairie Oasis attended meeting to ask council ideas and thoughts as to a Health Spa, Swimming pool etc for old Frontier Spice Building. Star Hotel & Livery Liquor permit approved on motion of Zamastil 2nd Balog . Carried . All Yeas . Ordinance 117 being AN ORDINANCE AMENDING FLOOD PLAIN ORDINANCE' 11.3, was presented and read for the firsttime. Councilmen Balog moved the approval of the Ordinance on its first reading and that the rule requiring three readings on three different dyas be suspended and the Ordinance be placed on its second and third readings by its title . 2nd Berryhill. The Ordinance was then read the 2nd and 3rd time by tis title Councilmen Balog moved the adoption. of ordinance as read 2nd Berryhill . All voting Aye . Mayor Feight declared-Ord 313 dd and in effect as prescribed by State of Iowa. Ordinance 118 being AN ORDINANCE AMENDING Title 1 Chapter 4, Article 1 , of City Code and, Odinance 119 being ANORZ�]CINANCE AMENDING Title 1 , Capter 4, Article 2, Section 1-04 . 0201 were both present and read for the first time.. Councilmen Balog moved the approved of these two ordinances on their first reading and that the rule requiring three readings on three different days be suspended and the Ordinances be placed on their 2nd and 3rd readings by their title 2nd Bullock. Carried The ordinance was then read the 2nd and 3rd. time by their titles . Councilmen Balog moved the adoption of the Ordinances as 'read,„ 2nd Bullock. All voting Aye . Mayor Feight declared Ordiances 118 and 119 adopted and in effect as prescribed by State of Ia. Motion by Berryhill 2nd Balog, May 18th to be CityClean Up day. C I e to contact Barker Sanitation and request two of his packing trucks and two men per truck plus volunteers and volunteer trucks for May 18th. All voting aye . RE IT ORDAINED BY THE CITY COUNCIL OF FAIR.FAX, IOWA Section 1 , P'uurpose . The purpose of this ordinance is to amend Title I , Chapter 4 , Article I , of the City Code of Fairfax. Iowa . Section 2 . Article 1 , City Clerk, of Title I , Chapter" 4, City Code of Fairfax, is amended by adding the following thereto : 14 . 0114 ADDITIONAL DUTIES _ In addition to the duties as City Clerk, the City Clerk shall have all the powers and shall be responsible for and perform all the duties of the Treasurer set forth in Title I , Chapter 4 , Article 2 , of the City Code of Fairfax. Section 3 . All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section. 4 . Severability . If any section, provision or part of this ordinance shall be adjudged invalid or unconsti- tutional. , such adjudication shall not affect the validity of the ordinance as a whole or any section , provision or part i thereof not adjudged invalid or unconstitutional . Section 5 . This ordinance shall be in full force and effect from and after its passage , approval and publication as provided by law. BE IT ORDAINED BY THE CITY COUNCIL OF FAIRFAX, IOWA Section 1.. . Purpose . The purpose of this ordinance is to amend Title I , Chapter 4 , Article 2 , Sections 1-4 . 0201 and 1-4 . 0202 of the City Code of Fairfax, Iowa , Section 2 . Section 1--4 . 0201 of Title I , Chapter 4 , Article 2 , City Code of Fairfax, is repealed and the follow- ing adopted in lieu thereof : 1-4 . 0201 APPOINTMENT . The City Clerk shall perform, the duties of the Treasurer . Section 3 . 'Section 1-4 . 0202 of Title I , Chapter 4 , Article 2 , City Code of Fairfax, is repealed and the follow- ing adopted in lieu thereof : 1-4 . 0202 COMPENSATION .
