Regular meeting of the Fairfax City Council was field 10/3/85 at 7 P.M.
Mayor Feight presiding . Council present Balog, Berryhill , Josifek &
Zamastil , Absent Bullock
Minutes of previous meeting and adgenda as posted approved on motion of
Tasifek 2nd Zamastil . Budget & Financial reports presented and placed
on file .
Receipts to be accounted for : General Account $5, 040 . 65 , RUT Fund $2 , 500. 50
Debit Service 120 . 10 , Revenue Sharing 112 . 09 , Water Dept $6 , 732 , 67, Sewer
Dept ; $796 . 80 . Total Receipnts & Investements including transfers 62, 302 , 91 ,
LeRoy Soukup, from the Linn County Road Dept, discussed Cemetery Road West
&,Southview Road with Council .. Cemetery Road will be observed over the
winter and decision will be made on repairs in the spring. Southview Road
is; not currently wide enough for a hard surface . Residence on Southview
need to petition Supervisors for road improvements . It may need to be
financed by special assessment .
Boh Levi , from Iowa Ill Gas Co discussed with council the new pilot program
bezg sponsored by them in regard to low interest loans on replace of old
urnaces with high efficiency furnances .
n. motion of Balog, 2nd Berryhill , Iowa Ill Gas given permission to extend
as main from current end of line on Highway 151 to Wilson property on
outhview Drive West . Carried
ohn Feld, from Iowa Electric Light discussed with council the up corning
ranchise election - to be held in January 1986 .

parking ordinance . On motion of Balog, 2nd Berryhill , ordinance to be
emended to read "NO PARKING ANY TIME" on the North side of Front street.

deport the name of the owner, if known, to the Sheriffs dept and if enough
complaints are file, charges will be filed against the owner by the Sheriffs

ordinance 125-11PENALTY FOR NON--READING OF WATER, METER" was presented and

Mayor declared Ordinance 125 passed and in effect as per publication
requirements . Clerk to send notice to all residence in regard to the
$25', 00 penalty for non-reading of water bills . The penalty to be in
effect as of the November 1 , 1985 readings .
Ruote prices from Water Products Co and Utility Equipment were read
in regard to the purchase of safety equipment for the Sewer Dept .
Bad was awarded to Water Products Co on motion of Zamastil , 2nd Berryhill
Carried All voting aye .
n1scusSion held in regard to Insurance Coverage that is with Iowa
National Insurance Company. Clerk instructed to advise our local agent
that ' he should look elsewhere for coverage if nothing is resolved in the
newt t wo weeks .
Correspondence from Iowa Conservation Commission requesting Councils
assurance that they will continue to comply with all the regulations in
regard to the City Park that was partially paid for by a grant from

complied with and the Mayor given authority to sign same . Carried all voting
Quote prices from three water tower maintence contracts were read. Clerk
to get further references from Cities where these companies have worked .
Final decision to be made at the November Council meeting .
Minutes of the September 28th Board of Review meeting read, read in
regard to the granting of an exception to Wayne. Marlow and advising
City Clerk to issue a building permit to him for a deck.
Letter received from Joe krahmer resigning from the Board of Review.
Council accepted resignation with regret and thanked Joe for his
service to this committee. Councilman Terry Berryhill appointed to
fill vacancy on Board of Review by Mayor Feight with Council approval .
Ordinance 126-"VACATING STREET" was presented and read for the first
time. On motion of Josifek, 2nd Zamastil that Ordinance 126 be approved
on lst reading and that the rule requiring two morereadings of the
ordinance be suspended and that ordinance be placed on last reading .
Carried Motion by Josifek, 2nd Zamastil that Ordinance be read by
title only for final time and approved. Carried. All voting aye .
Mayor declared Ordinance 126 passed and in effect as per publication
requirements .
On motion of Balog, 2nd Josifek to approve bills as presented . Carried
Al voting aye .
No further business meeting adjourned on motion of Balog, 2nd Josifek

Purpose of meeting : Insurance Coverage for City.
Pete Laydon from Davis , Lamb & Jones agency discussed with council
coverage he could provide through Employeers Mutual Insurance Co .
On motion of Bullock 2nd Balog, Mr Laydon to proceed with obtaining
coverage thru Employers Mutual Insurance Co and also obtain a
Umbrella policy for the city. Roll Call vote all ayes .
No further business meeting adjourned at 7 : 4OPM.

AN ORDINANCE AMENDING SECTION 6-1 . 0304 OF TITLE VI , CHAPTER 1
OF THE CITY CODE OF FAIRFAX, IOWA.
BE 1T ORDAINED BY THE CITY COUNCIL OF FAIRFAX, IOWA.
Section 1 . Purpose . The purpose of this ordinance is
to amend Section 6-1 , 0304 of Title VI , Chapter I of the City
Coje of Fairfax, Towa.
Section 2 . Section 61 . 0304 of Title VI , Chapter 1 ,
City Code of Fairfax , is amended by adding the following
thereto ;
5 . The clerk shall send meter reading cards to each
customer, to be compleved and returned by each customer
by the 8th day of each month. If a customer has not
completed and returned the meter card within at least
six (6) months from the date the last previous meter
card was received by the clerk, the city shall read

will be added to the customer ' s bill .
jection 3 . All ordinances or parts of ordinances in
oonfiict herewith are hereby repealed.
Section 4, Severability. If any section, provision or
part of this ordinance shall be adjudged invalid or unconsti-
nutinnal , such adjudication shall not affect the validity of
the ordinance as a whole or any section, provision or part
tbereof not adjudged invalid or unconstitutional .
Section 5 . This ordinance shall be in full force and
effect from and after its passage, approval and publication
as provided by law.
