Mayor Charles Peters called the Public Hearing on the Proposed vacation and sale of public property to order at 7 : OOPM, No written comments were received and no personal objections were voiced . Mayor Peters declared the Public Hearing closed at 7 : 10 PM Mayor Peters called the regular meeting of the Fairfax City Council to order at 7 : 12PM. Council present : Balog, Bach & Cerveny, Absent Bullock & Shakespeare . Minutes of previous meeting approved on motion of Balog, 2nd Bach carried. Budget & Financial report received and placed on file , Sheriff Blome and Lt . Weatherbee attended meeting for a discussion. with council on the service that the Linn County Sheriffs department is giving the City of Fairfax . Sheriff Blome advised Council that he didn ' t think the contract price to the City would change until possible January of 1957 . Council took under advisement but did not act on a request from the Republican and Democratic parties to hold their caucus in the Council chambers . Frank Scott , from Prairie Roadbuilders , discussed with council the cost of oil for the summer street program. On motion of Balog, 2nd Cerveny, Mayor Peters to sign agreement with PrairieRoadbuilders for a price of 53� a square yard with further adjustment up or down to be determined later this year , Carried . All voting aye . Discussion with Mr Davis from StarWest Cable in regard to a bill for the cutting of a cable „ Original map to obtained from City Engineer and further discussion will be held . American Legion representatives gave Council a tenative plot plan for Hey Dey in regard to the ride locations and beer tent . Hey Dey meetings are held the 3rd Wednesday of each month at the Legion Hall . Anyone wishing to volunteer is urged to attend these meetings . Ordinance '129 AN ORDINANCE AMENDING ORDINANCE 126 TO VACATE STREET was presented and read the first time . Balog moved the approval ofthe Ordinance on its first reading and that the rule requiring three readings be suspended and the Ordinance be placed on its 2nd & 3rd reading by its title . 2nd by Cerveny. Voting Aye : Balog, Cerveny & Bach. Absent Shakespeare & Bullock. Nay None. Ordinance 1.29 was then read the 2nd and 3rd times by its title . Balog_moved the adoption of the Ordinance 129' as read, 2nd Cerveny, Voting Aye : Balog, Bach & Cerveny. Absent Shakespeare & Bullock, Nay: None Mayor Peters declared Ordinance 1.29 approved and in effect as per publication requirements . Councilman . Shakespeare arr-ived at 9 : 10 PM. No action taken on the Filter claim. City Clerk to invite Mr & Mrs Falter to March Council . meeting to discuss the claim. Building permit presented for remodeling at 71.5 Church St . On motion of Cerveny 2nd Balog building permit approved,,, All voting aye . May 17th will be designated at City Wide Clean Up Day. Further information an this will be sent out in the Water bills . On motion of Balog, 2nd Shakespeare, The public,. hearing on the 1986/87 Budget will be at 7PM on March 6 , 1986 at the Fairfax City Mall . Carried . All voting Aye : Bach, Balog, Cerveny & Shakespeare , Absent Bullock. On motion of Cerveny all bills presented with the exception of the claim from the Clerk of Court to be paid, 2nd Balog. E Section 1 . Purpose . The purpose of this ordinance is to amend Ordinance 1.26 of the City Code of Fairfax, Iowa. Section 2 . Ordinance 126 , City Code- of Fairfax, Iowa, is repealed and the following adopted in lie# thereof : Street vacation. That all of the following described real estate be and the same i, forever vacated pursuant to Section 409 . 25 (2) of The Code of Iowa: That part of south Front Street , Fairfax, Iowa lying within the following described parcel : A part of Lot 1, Irregular Survey of the Sz of the SE4 of Section 9-T82N-R8W of the 5th F" . . , Linn County , Iov?a described as follows : Beginning at the Northeast corner of Lot 5 Selzer ' s Lakeside First Addition to Fairfax, Iowa. Thence N.
