Regular meeting of the Fairfax City Council was held 5/1/86 at 7 PM
Public Hearing on the amending of the Fiscal Year 85/86 Budget was
opened with Mayor Charles Peters presiding. Council members , Balog,
Bach , Cerveny & Shakespeare present. Bullock absent . j
No objections received and no objectors in person. Mayor Peters
closed the public hearing at 7 : 10 PM
Regular meeting opened at 7 : 10 PM. Minutes of previous meeting approved
on motion of Cerveny 2nd Balog . Budget report received and placed on file . j
Receipts to be accounted for : General $9, 128 . 53, RUT Fund $1 , 890. 58,
Debit Serv, $508 . 70, Revenue Sharing $1 , 435 ., 33, Library Trust 523 . 66
Water Dept . 1, 479 . 98, Garbage fee 540 , 00, Sewer Dept : 3 , 541 . 26 .
Representatives of the Fire Department explained the new law in regard
to "Trading of territories between fire departments . On motion of
Shakespeare, 2nd Bach City Clerk to contact Atkins in regard to

certain areas that have been divided by the highway 30 bypass .
Carried . All voting aye.
Beer-Dine permit & Sunday permit. for HandiMart and a 6 Month
Seasonal Beer and Sunday Permit approved on motion of Cerveny 2nd
Balog . Carried. All voting aye .
Building permits for Larry Truitt and Bryon Balog presented and
approved on motion of Cerveny 2nd Bach . Carried All voting aye .
Mayor Peters reported that he had approved a. building permit for
Ron Tonneson for a garage .
Oin motion of Shakespeare, 2nd Cerveny that the estimated cost of $40 . 00
be paid to Mr & Mrs Robert Falter for damaged that allegedly was done
to the siding of their house by city mower . Carried.
Several inquires received in regard to the draining on ditches along
Park and Linn Street . City Clerk to contact City Engineer for standards
and prices of storm sewer for the area .
The issuing of building permits was discussed and the following motion
was made by Shakespeare 2nd Bach, City Clerk to issue permits for
sheds , porches , patios , & decks . If Clerk feels that if there could
be a problem, two council members are to be contacted for final
deceison. Garages and houses to be issued by City Clerk after the
0 . K. of two Council members . This is a change of policy that
was issued at City Council meeting of 7/ 7/83 which stated that
houses and garages were to be approved by the full council .
Carried. All voting aye.
Resolution 5186 being a resolution "Amending the 85/86 Fiscal Year
budget" presented and approved on motion of Shakespeare, 2nd Cerveny
Carried. Roll Call vote. Aye : Balog, Bach, Cerveny & Shakespeare,
Nay: none . Absent : Bullock
Ordinance 130 being an Ordinance "PARKING VIOLATIONS ALTERNATE FIDE"
was presented at read for the first time . Councilmember Balog moved
the approval of the Ordinance on its first reading and the rule requiring
three readings on three different days be suspend and the Ordinance be
placed on its second and third reading by its title ; 2nd Cerveny.
Ordinance 130 read for 2nd and 3rd time . Councilmember Balog, moved
the adoption of Ordinance 130 as read, 2nd Bach. Adopted on
Moll Call Vote . All votin aye .
Ordinance 131 being an Ordinance "AMENDING WATER RATES AND SERVECE°
was presented and read the first time . Councilmember Bach moved the
approval of the Ordinance on its first reading and that the rule requiring
three readings on three different days be suspended and the
Ordinance be placed on its second and third reading by its title : 2nd
by Councilmember 5hakepseare . Ordinance 131 was then read for the
2nd and 3rd time . Councilmember Bach moved the adoption of the
Oirdinance 1300 as read , 2nd Shakespeare . Adopted on RollCall
Vote. All votingAye ..

Discussion held on changing the rates for garbage pickup :as reflected
on the utility statement. Each residential pickup cost is approximately
$7 . 83 per month. ( $2 . 00 on utility statement, 5 . 83 on tax base) €E€
On motion of Shakespeare, 2nd Balog. Rates to be shown on utility E
statement per month as follows Single Family dwelling $6 . 00, Multi-
family per dwelling $6 ,. 00 , Commercial $8 . 00 . Carried . All voting Aye .
Ordinance 132, being an Ordinance .".AMENDING COLLECTION FEE FOR
GARBAGE FEE" was presented and read the first time . Councilmember
Shakespeare moved the approval of the Ordinance on its first reading
and that the rule requiring three readings on three different days be
suspended and the Ordinance be placed on its second and third readings
by its title : 2nd Cerveny. The Ordinance was then read the 2nd and 3rd
times by its title . Councilman Shakespeare moved the adoption of the
Ordinances as read; 2nd Cerveny. Adopted All voting aye .
Mayor Peters then signed Ordinance 130, 131 & 132 , and declared Ordinance
1.30 adopted and in effect as per publication requirements and Ordinance
131 & 132 effective date as July 1, 1986 as per publication requirements .
Bids open for repair of Prairie street that had buckled. Merta Concrete
$3 , 360(concrete) Prairie Roadbuilders (black top) 51 , 600 . 00 , Chet
McCabe $350 . 00 (Mud Jack) . On motion of Cerveny bid to be given to
McCabe, 2nd Balog, Carried . All voting Aye
Discussion held on purchase of certain Chicago Northwestern Trans .
Co property along the Forth right-of-way for .sloping & grading of
berm on lagoon. On motion of Shakespeare 2nd Cerveny City to accept
the sellers price of $1, 650 . 00 for land and to further sign a lease
for a smaller strip of land on the right of way at $35 . 00 per year.
City to remit a $500 . 00 deposit with the signed offer to purchase
land . City Engineer to secure for the City a Survey and description
of property to be shown on the quick claim deed. Carried . All voting
Aye
On motion of Cerveny 2nd Bach, City Clerk to contact Davis , Jones &
Lamb Insurance Agency In regard to procurrin;g special insurance
coverage for the 4th of July Fireworks display. Carried. All voting Aye
Clean Up day discussion. Volunteers to meet at City Hall at approximately
8 : 30 AM on Saturday May, 17 , 1986 . On motion of Cerveny, 2nd Balog
any volunteer who works at least two hours will have dinner paid for
at the Star Hotel by the City. Carried . All voting aye .

ORDINANCE
AN ORDINANCE AMENDING TITLE II , CHAPTER 2 , ARTICLE 11 ,
SECTION 2 . 1-2 . 1102 , OF THE CITY CODE OF FAIRFAX, IOWA.
BE IT ORDAINED BY THE CITY COUNCIL OF FAIRFAX, IOWA
Section 1 . Purpose. The purpose of this ordinance is
to amend Title II , Chapter 2 , Article 11 , Section 2 . 1-2 . 1102
of the City Code of Fairfax , Iowa.
Section 2 . Section 2 . 1-2. 1102 of Title II , Chapter 2 ,
Article 11 of the City Code of Fairfax, Iowa, is hereby
deleted and the following substituted in lieu thereof :
2 . 1-2 . 1102 PARKING VIOLATIONS : ALTERNATE .
Admitted violations of any parking restrictions
imposed by this chapter may he charged upon a
simple notice of a fine of two (2) dollars payable
at the office of the Fairfax City Clerk. If the
fine is not paid within 48 hours , the fine shall be
increased to five (5) dollars for each offense .
If such fine is not paid within 10 days , the
person violating any provision of this chapter,
shall be subject to arrest or citation as provided
in Section 2 . 1-2 . 1101 above.
Section 3 . All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 4. This ordinance shall be in full force and
effect from and after its passage , approval and publication
as provided by law.
Adopted this day of 1986 , and approved
on the same date .

AN ORDINANCE AMENDING TITLE VI , CHAPTER 1 , ARTICLE 3 ,
SECTION 6-1 . 0302 , OF THE CITY CODE OF FAIRFAX, IOWA.
BE IT ORDAINED BY THE CITY COUNCIL OF FAIRFAX, IOWA
Section 1 . The purpose of this ordinance is to amend
Title VI , Chapter 1 :, Article 3 , Section 6-1 . 0302 of the
City Bode of Fairfax, Iowa.
Section 2 . Section 6-1. 0302 of Title VI , Chapter 1 ,
Article 3 of the City Code of Fairfax, Iowa , is deleted and
the following substituted in lieu thereof :
6-1 . 0302 RATES AND SERVICE . Water service shall
be furnished at the following quarterly monthly
rates within the city :
1 to 3 ,000 gallons - $4 . 00 (minimum bill) .
3 , 001 to 10 ,000 gallons - $1 .50 per thousand .
10 , 001 to 13 ,000 gallons - $1 . 55 per thousand.
13 ,001 to 15 , 000 gallons - $1 . 60 per thousand.
15 , 001 to 18 ,000 gallons - $1 . 65 per thousand.
18 , 001 to 20 , 000 gallons - $1 . 70 per thousand.
20 , 001 to 23 , 000 gallons - $1 . 75 per thousand.
23 , 001 to 25 ,000 gallons - $1 . 80 per thousand.
25 ,001 gallons and up - $1 . 80 plus $ . 10 for
each thousand over 25 , 001 .
Section. 3 . All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 4. This ordinance shall be in full force and
effect from and after its passage , approval and publication
as provided by law..

Article 3 of the City Code of Fairfax , Iowa , is deleted and
the following substituted in lieu thereof :
3-4 . 0211 COLLECTION FEES . The collection and
disposal of solid waste as provided by this article.
is declared to be a benefit to the property served
or eligible to be served and there shall be levied
and collected fees therefor in accordance with the
following :
1 . Schedule of Fees . The fee for solid waste
collection and disposal service used , or available
shall be
a. For each single family residence
b . For each dwelling unit of a multiple family
dwelling - $
C . For commercial , industrial and institutional
premises - $
2 . Payment of bills . All fees shall be due and
payable under the same terms and conditions provided.
for payment for water service except that the pro-
visions of subsection 3 hereof shall be used to
enforce collection of delinquent fees .
3 . Lien For Non-Payment . Fees remaining unpaid
and delinquent for a period of ninety (90) days
shall constitute a lien upon the premises served
and shall be certified by the clerk to the count,.£
auditor for collection in the same manner as
property taxes .
Section 3 . All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 4. This ordinance shall be in full force and
effect from and after its passage , approval and publication
as provided by law_
