Regular meeting of the Fairfax City Council was held at 7 PM on 6,15/86.
Mayor Peters presiding.. Council present : Balog, Bach, & Cerveny. Absent
Pullock and Shakespeare. 20 guest present . Adgenda approved as posted.
Minutes of previous meeting approved on motion of Cerveny 2nd Balog.
Carried . Budget & Financial reports received and placed on file .
"Buzz." Sawyer spoke to the council in regard to his candidacy for the
the office of Linn County Supervisor .
Motion by Balog, 2nd Cerveny that discussion in regard to the "Pit Bull
Dog"" problem be limited to 15 minutes . Carried . All voting aye .
Cathy Chapman presented a petition signed by 84 people (varification
of eligibility not established) asking the City Council to amend
the '*Viscious Animal" section of the cities dog ordinance .
Disc-sssion was then held with those in attendence in this regard .
Council to consider this request and the amending . of the Ordinance at
the July 3 , 1986 Council meeting .
Resolution 6686 "REP'EAL OF THE LOCAL OPTION SALES AND SERVICE TAX" was
presented and read by Mayor Peters . On motion of Bach 2nd Balog,
Resolution 6686 to be accepted and approved . Carried . All voting Aye .
City Clerk to forward Resolution 6686 to the Linn County Board of
Supervisors for their consideration.
On motion of Cerveny 2nd Balog, Cigarette permits approved for the
Star Hotel , Handimart , & Bobs Meats . Carried All voting aye .
j Oin motion of Cerveny 2nd Bach, Permission granted the Star Hotel to
have a "leer Garden" during Hey Deys and the American Legion was
granted a Deer Permit for Hey Deys . All voting aye .
On motion of Balog , 2nd Bach , Shirley Lowe appoint to the Fairfax
Library Board to fill an unexpired term ending in January 1990 . Carried
All voting aye .
Special Council meeting with representatives, of the Library Board for
a work session on the City Survey to be held on June 17 , 1986 at 7 PM.
Discussion in regard to the installation of storm sewers on Park and
rTnra street " Engineers estimate is approximately $65 , 000. 00 . These s
cost may possibility be included in the Sewer Lagoon Bond Issue ..
Notion by Balog, 2nd Cerveny, that certain past due utility bill-s be
certified to the Linn County Auditors office for placement as a tax
lein on property taxes . Carried. All voting aye .
Discussion held on commercial garbage rates . On moiton of Balog, 2nd
a Commercial Zone to be charged the
Cerveny, only business located in
Co^p e rcial rate . (This will excluded most home businesses ) Carried .
City Clerk instructed to put notice in water bills about people dumping
trash and grass clipings in ditches . They are to bag their clippings
and place out for garbage collection.
Notion to approve bills made by Balog, 2nd Cerveny.
Ox; motion of Cerveny, 2nd Bach, City Clerk to pay all bills received
,efore the end of the current fiscal year (June 30) that have been
'Aicluded in this fiscal year budget . Carried. All voting aye .

Special Mee' ing of the Fairfax City Council was held 6 /17 /86 at 7PM.
Council present, Balog, Bach & Cerveny. Purpose of meeting : Further
discussion with Fairfax Library Board Representatives in regard to
City Survey. City Clerk to contact Dr . Hammond, Iowa State Extension
Service and have a 2nd draft of survey done and returned in time for
Library Board meeting on July 7 .
No further business meeting adjourned at 8 : 15 pm.

Whereas, the City Council of Fairfax, Iowa
has been advised of certain past due utility
bills,
NOW, THEREFORE, RE IT RESOLVED, by the
Fairfax City Council that charges for past
due sewer and garbage charges be placed
against this property ( 118 Park Street }
as a tax Lein.

Property Owner, Jeannine McIntire will
be notified of this action. Past Due
Amount of 94.16 will be certified to the.
Linn County Auditors office for collection.

Dear Mr Erickson,
Enclosed are copies of the resolution
passed by the Fairfax City Council at their
regular scheduled council meeting on .Tune 5 , 1986
Also enclosed is a copy of the letter to
the Zinn County Board of Supervisors asking
that they repeal this tax.
As of this date we have not received
any of the local sales tax that was collected
here in Fairfax. We were wondering just
what has happened. to it? ? ? ? Would appreciate
a reply by return mail in this regard..

This letter is to inform -you that the
Fairfax City Council, meeting in regular-
session, on .June 5, 1986 , passed the
enclosed resolution . The vote was three
Yes , no Nays and two absent .
The City Council respecCfully request
that the Linn County Board of Supervisors
repeal the local option sales and service
tax effective at the end of the calendar
quarter (June 30, 1986 ) .

RESOLUTION NO.
WHEREAS , the City of Fairfax, Iowa, desires to repeal

the local option sales and service tax imposed upon the City
of Fairfax pursuant to Chapter 422B of the Code of Iowa.
NOW, THEREFORE , BE IT RESOLVED by the City Council of
Fairfax , Iowa, as follows :
That the City of Fairfax, Iowa , upon motion duly
considered, hereby requests the Linn County Board of Supervisors
to repeal the .local option sales and service tax imposed
upon the City 'of Fairfax , Iowa, as authorized by Section 4
of Senate File 2302 . The City of Fairfax, Iowa , further
requests that the Linn County Board of Supervisors repeal
the local option sales and service tax effective at the end
of the calendar quarter during which this motion for the
repeal is received by the Board.
