All voting aye.. On motion of Bullock, 2nd Cerveny, All bills present for payment be approved . Carried . All voting aye . Motion to adjourned at 9 30PM made by Cerveny, 2nd Balog. Carried . Council -present, Bach, Shakespeare & Balog, Absent. Mayor Peters , Councilmembers Cerveny & Bullock. Minutes of previous meeting approved on motion of Shakesspeare 2nd Bach . Carried . Budget report presented and placed on file . Receipts to be accounted for: General $2 , 211 . 76, RUT 2 , 336 . 14, Rev. Sharing 2 , 056 . 00, 'eater Dept 2, 066 .36 , Sewer Dept 3, 576 . 36 Garbage fees 1, 775 . 00 to Gen account . On potion of Bach 2nd Shakespeare Nancy Josifek appoint to fill an 2 year unexpired term on the Library Board. Carried Mr & Mks David Barker, ]darker Sanitation, were present to discuss their garbage contract that will be coming up for renewel . On motion of Shakespeare, 2nd Bach, City Clerk to draw up new contract with same terms as old and present it to the council at the November regular council meeting for final passage . Carried. Discuss held on traffic problem on Stallman Road . Matter to be referred to the Sheriffs Department . Resolution #10286 "No parking Area on shoulder of Highway 151" , present for passage by Balog, 2nd Bach. Carried. All voting aye . Recommondation from P & Z committee in regard to Kurtz 2nd addition read to council . Resolution 10286A "Preliminary & Final Plat Kurtz 2nd addition" was presented by Shakespeare 2nd Bach. Carried, All voting aye . Reports from Ordinance & Rule changes committee continued until the regular November meeting. Owners of property at 240 Losey street , building permit extend another three months . Progress report is to be given prior to the end of the three months on motion of Balog, 2nd Bach. Carried . Discussion held on 7 "old" parking tickets . On motion of Balog, 2nd Shakespeare , City Clerk to notify City Attorney to process these 7 tickets through district court . Carried . All voting aye . Discussion held on correspondence from Iowa DOT in regard to a Bridge inspection. CityClerk instructed to contact: Linn County in regard to this matter and get names of companies in the area that do bridge repairs . On motion of Balog, 2nd Bach CIty to sign agreement with the Iowa Land and Conservation Dept that nothing will be added to the City Park with out their prior approval. . Carried . All voting aye . Discussion on pater tower repairs to be continued until the November regular council meeting . On motion of Balog, 2nd Shakespeare, .Craig Dostal & Richard Schwertfeger,) Jr . to be placed on the Fire Department for a 6 month probationary period . Carried On motion of Shakespeare 2nd Bach, bills presented for payment be appro�ed . Carried . All voting aye.. Motion to approve the bills as presented made by Shakespeare, 2nd Bach Carried . Mayor Peters arrived at � - 52 PM. Discussion held in regard to the meetings the City Clerk will be called upon to attend in Des Moines in regard to her appointment to the Board of Directors of the League of Iowa Municipalities , When meetings fall on a day other than Thursday she is to work the Thursday of that week. There will be no cost to the city of any expenses . There being no further business meeting adjourned at 9 : 20PM on motion of Bach, 2nd Balog . Carried . All voting aye.. Dusil 397 . 66 RESOLUTION The City Council of Fairfax, Iowa, having met in regular session and having received a copy of the Preliminary Plat and the Final Plat of James Kurtz's Second Addition to Fairfax, Iowa, along with a Recommendation from the Planning and Zoning Commission of the City of Fairfax, Iowa, and WHEREAS, the City Council of Fairfax, Iowa, having considered said Preliminary Plat and the Final Plat and the Recommendation of said Planning and Zoning Commission does hereby approve said Preliminary Plat and Final Plat of James Kurtz's Second Addition to Fairfax, Iowa, the vote of said City Council being unanimous for said approval. Dated this day of .per 1986. i CITY COUNCIL OF FAIRFAX, IOWA B ,, Mayor, i Attest: City C1 k : RESOLUTION NO. 10286 A i WHEREAS, the City of Fairfax, Iowa, desires to erect No Parking signs pursuant to City Ordinances 2. 1-2 . 1006 ( 3 ) and 2 . 1-2. 1006 ( 13) in the area between the viaduct and the bridge on Highway 151. NOW, THEREFORE, BE IT RESOLVED by the City Council of Fairfax, Iowa, as follows: On behalf of the City of Fairfax, the Iowa Department of Transportation is hereby empowered to erect permanent No Parking signs between the viaduct and the bridge on :Highway 151 pursuant to City Ordinances 2. 1-2® 1006 ( 3 ) and 2 . 1-2'. 1006 ( 13 ) . PROJECT T'IT'LE 19-00901 Fairfax City Park Acquisition the City of Fairfax r does hereby assure that it: (1) will not convert any portion of a project area to other than uP blic outdoor recreation use through sale, lease, easement, construction of non-outdoor recreation facilities or by any other means without prior approval and re- I placement of the converted property. (See Section 6(f) (3) of the Land and Water Conservation Fund Act.) A "project area""' will generally include all of any outdoor recreation area which has received 'L&WCF assistance; (2) will not install any overhead electric or telephone lines on project areas; (3) will maintain the project area in a safe, attractive and inviting manner;; - (4) will make reasonable repairs on facilities assisted by the L&WCF throughout their estimated lifetimes to prevent undue or premature deterioration; I (5) will keep facilities open for public use at reasonable hours of the day and times of the year; ('6) will permanently display a Land and Water Conservation Fund symbol on all project areas; (7) will comply with Title VI of the Civil Rights Act of 1964, Section 504 of the Rehabilitation Act of '1973 and the Age Discrimination Act of 1975.
