Regular meeting of the Fairfax CityCouncil was field 12/4186 at 7PM Mayor Peters presiding - Council present : Bach,„ Cerveny & Shakespeare Absent Balog & Bullock. Minutes of previous meeting, adgenda, budget & financial report approved on motion of Shakespeare, 2nd Ce rveny. Carried Receipts to be accounted for : General Fund, $41 , 168 . 29 , RUT Fund 2 , 162 . 02 Revenue Sharing 174 . 73 , Water Dept 3 , 367 . 07 , Sewer dept 3 , 447 . 30, Investments on hand 12 / 1 /86 $205 , 576 . 75 . On motion of .Cerveny, 2nd Bach Barker Sanitation awarded a five year contract , effective 7 /1/87 to 6/30/92 , to pick up garbage in Fairfax. Carried. Roll call vote , All ayes . On motion of Cerveny, 2nd Shakespeare, Liquor permit for the American Legion Approved . All voting aye . Progress report given by Mayor Peters & Councilmen Shakespeare, on the Lagoon project and the relief sewer line . Councilmen Shakespeare reported that Western Tank & Tower will be painting our watertower in the spring. The decision on Sheriffs contract to be delayed until after budget meetings held in January. City Attorney to have an ordinance ready for council action at the January meeting in regard to hazardous chemical spills and hazardous substances . Clerk to contact Linn County Health Dept in regard to underground storage tanks that have been abandoned and not sealed properly . Notice to be put in water bills in regard to dogs -running at large , Bills approved for payment on motion of Cerveny, 2nd Shakespeare . Carried . City Clerks office will be closed due to meetings & vacation, Decemberl2 . 17 , 19, 24 & 26 . January Council meeting will be held 1/8/87 . I AGREE�THENT This Agreement made and entered into on thise �------day of—L �, 1986 . by and between David }Barker , d/b /a Barker ' s Sanitation ( hereafter referred to as " Barkers" ) and the City of Fairfax, Iowa (hereafter referred to as i Fairfax) . Barker and Fairfax , in consideration of the mutual promises , benefits , covenants and obligations herein made , agree as follows ; 1 . Barker shall operate a trash and garbage pickup and hauling service in the City of Fairfax, Linn County, Iowa. 2 . Barker shall pick up trash and garbage within Fairfax on 4i'rialrty of each week at all residences , businesses and commercial establishments , when is use , and delivar said trash and garbage to the City of Cedar Rapid, lan, fill for disposal . If Friday falls on a legal holiday, then the pickup shall be on the following day . 3 . Fairfax shall require that its residents place trash and garbage at the curbs in front of their respective dwelling places and businesses , -nd Fairfax shall make every reasonable effort to keep the streets clear to facilitate the garbage and trash picl.<_up . 4 . All garbage shall be wrapped in newspaper or other si.milar material and plat,:ca in a container. Containers shall be the regular metal or plastic types :4hich nave handles and tapered sides along with proper fitting, lids . Plastic bags designed for this purpose are acceptable . No container-s shall weigh more that sixty ( 60 ) pounds . Large items of junk or trash will be through private agreements with the landowner; except that Christmas trees will be picked up a not extra charge . Trash , including fall garden cleanup and sp--ring cleaning will he picked up as long as the items are reduced to packages weighing less than sixty ( 60) pounds . Brush iay be placed for collection as long as the bundles a.te securely tied and not in excess of four feet long and not exceeding sixty ( 60 ) pounds in weight . 3 . Barker shall use packer trucks in the collection of trash and garbage . U, Barker shall hold harmless and indemni y Fairfax from all liability, claims , damages and court costs , including attorney fees , for injury or death to persons or damage to property in any manner caused by, arising from , incident tc; or connected with the work to be performed by Bar_keT_ pursuant to this Agreement . Barker shall carry liability insurance in the amount of Three Hundred Thousand Dollars ( $300 , 00{} ) personal injury a,, d Oiie alundrd Thousand NDo11ars ( $ 100 , 000 ) property damage , naming Fairfax as an additional insured,, and provide Fairfax with evidence therof . (Agreement page --2--) Fairfax shall. pay Barker the amount of---�• �------------- per month per pickup . Fairfax has entered into an agreement to allow Barker to dispose a:as = and garbage at the Vedar Rapids Lancnf ill and shad pay Lt,e f.t c, ar,tged by such disposal site for dumping the trash and garbage collected pursuant to this Agreement , and the terms and conditions of said agreement a---e incorporated by reference and made a part of this agreement as if fully set forth herein.. 9 . Barlcer shall keep accurate records of all trash and garbage waste being collected and hauled to the Cedar Rapids Landfill and shall subaait l a monthly report thereof to Fairfax . If required by the Cedar Rapids Landfill, Barker shall provide the Cedar Rapids Landfill with a list of Barker ' s customers . 10 . This Agreement shall be for a. five (5) year term beginning July 1 , 1987 and ending July 1 , 1992 . However this Agreement may be reanegots.ated after three ( 3) years upon mutual agreement by the parties .
