at 7 : 00 PM. Mayor Peters presiding . Council present : Bach, Cerveny &
Shakespeare . Absent Balog & Bullock.
Discussion held with members of the Fire Department in regard to the
appointment of a chief, by-laws , and other general areas .

Fire Dept representatives ask that Clerk contact Chicago Northwestern
about the rail crossing on Vanderbilt Street .
On motion of Cerveny 2nd Bach, City Clerk to get quotes from, if possible
local lawn care companies in regard to spraying of dandelion and other
(� weeds on City property. Carried . All voting aye.
The June regular council meeting date is changed to Wednesday, June .,
1987 at 7 : 30 PM.
There being no further business meeting adjourned at 9 : 15 PM

Special Council meeting of Fairfax City Council was held June 3 , 1987
at 7 : 30 PM. Mayor Peters presiding. Council present, Balog, Bach,
& Shakespeare . Absent Bullock & Cerveny.
Purpose of meeting : Set date for bid letting on sewer project .
City Engineer Donald Hall„ presented the final plans for the sewer lagoon
improvements to the Council .
Resoltuion 5387-"Resolution to provide for a notice hearing on proposed
plans, specifictions , proposed form of contract and estimate of cost for
construction of improvements and extensions to the Municipal Sanitary
Sewer System, and the taping of bids therefore"" was introducted by Balog,
2nd Shakespeare . Roll call vote . Aye Balog, Bach, & Shakespeare ,
Nays None . Absent : Bullock & Cerveny. Mayor declared motion carried
and said resolution adopted.
July 9 , 1987 at 7 : 30 PM was fixed as time and place of hearing. Project
to be started by August 1 , 1987 and complete and ready for operation
within 150 consecutive calenda days thereafter.
No further business meeting adjourned on motion of Balog, 2nd Shakespeare .

Motion to approve minutes of previous meeting, budget report & financial
report made. by Shakespeare, 2nd Bach Carried
Cigarette permits approved for Bobs Meats , Handimart & Star Hotel on
motion of BAch, 2nd Shakespeare Carried
On motion of Balog, 2nd Bach , R. Schwertfeger, Jr, Craig Dostal and
Don Demeulenaere appointed to the Fairfax Fire Department and Ron
Stallman appointed Chief . Carried.
Representatives of the Baseball Team request Council to run a water
j line and install a drinking fountain in the dug--out area and permission
- to build a storage shed for equipment . Cost figures to be obtained
{ for the July 2 , 1987 Council meeting.

Mr Cawthorne in this regard .
Action on quotes to spray weeds on city property tabled until the
August Council meeting. Quotes on bridge repairs also placed on
the August adgenda.
On motion of Bach, 2ndBalog, fire Department given permission to hold
a fireworks display at the Ball Park on July 4, 1987 . Carried .
Bills approve and City Clerk given permission to pay any bills received
after the Council meeting that are within the budget requirments to
close out Fiscal Year 86/87 on June 30 . Carried. Allvoting aye .
No further business meeting, adjourned at 9 : 45PM on motion of
Balog, 2nd Shakespeare . Carried.

A RESOLUTION SETTING THE SALARIES FOR APPOINTED OFFICERS AND EMPLOYEES OF THE CITY OF
F'AIRFAN FOR THE FISCAL YEAR OF 1087/1988
BE IT RESOLVED: By the City Council of Fairfax, Iowa
',CTION 1. The following positions named shall be paid the salaries or wages indicated
and the City Clerk is authorized to issue checks, less legally required or
authorized deductions from the amounts set out below, and make such contri-
butions to IPERs and FICA or other purposes as required by law or order of
the City Council, all subject to audit and/or, review by the City Council.

SECTION 2. Over time hours shall be paid for at12 times the hourly rate for the job
per Formed. (Overtime meaning time over 40 hours per week) Employees may request
compensatory hours within a pay period in place of over time pay. Compensatory
hours shall be 12 hours for each hour of overtime.
SECTION 3. The City shall provide the CityClerk and W&S Superintendent with Protector 200
Blue Cross/Blue Shield Insurance. 'The City shall be responsible for the first.
$500.00 (200.00 deductible plus $300.00) for each person covered under this
policy.
SECTION 4. A $234.00 per year uniform allowance will be provided for the W&S Superintendent.
SECTION 5. The City Clerk and Water & Sewer Superintendent shall be paid for the following
Holidays: New Years, Memorial Day, July 4th, Labor Day, Thanksgiving, Christmas
and Good Friday.
SECTION 5. The City Clerk and Water & Sewer Superintendent shall be allowed 3 personal
days per year. The personal. days may be accumulated.
,J:SECTION 6. The City Clerk shall be allowed 108 hours paid vacation. The Id & S Superintendent
f shall be allowed 120 hours paid vacation. Vacations must be taken and can not
be accumulated.

for the called purpose of considering all matters pe-rtain_ng to the

The Council took up and considered the proposed construction of
improvements and extensions—to the Municipal Sanitary Sewer System.
Council Member introduced the following resolution
hereinafter set out bntitle "Resolution to provide for a notice of
hearing on proposed plans, specifications, proposed form of contract
and estimate of cost for the construction of improvements and
extensions to the Municipal Sanitary Sewer System, and the taking of
bids therefor" , and moved its adoption, seconded by Council Member

To provide for a notice of hearing on proposed plans and specifications
and proposed form of contract, and estimate of cost for the
construction of improvements and extensions to the Municipal Sanitary
Sewer System, and the taking of bids therefor
WHEREAS, the City of Fairfax, Iowa, has heretofore established a
Municipal Sanitary Sewer System, and it is necessary and desirable that
said Municipal- Sanitary Sewer System be improved and extended and such
improvements and extensions are for the best interests of the City and
may be hereafter referred to as the "Wastewater Treatment Lagoon
Improvement Project" hand are sometimes hereinafter referred to as the
"°Project" ) , such Project to be as described in and to be contracted for
and completed in accordance with the proposed plans and specifications
and form of contract prepared by Hall and Hall Engineers , Inc. , the _
engineers for the Project, such proposed plans, specifications and form
of contract, and estimate of cost being on file with the City Clerk;
and
WHEREAS, it is necessary to fix a time and place of public hearing
on the proposed plans , specifications and form of contract and
estimated cost for the Project and to advertise for sealed bids for the i
Project;
NOW, THEREFORE, Be It Resolved by the City Council of the City of
Fairfax, Iowa, as follows:
Section 1. The detailed plans and specifications , notice of
hearing and notice to bidders, form of contract and estimate of cost,
referred to in the preamble hereof be and the same are hereby approved.
Section 2. The Project is necessary and desirable for the City,
and it is in the best interests of the City to proceed toward the
construction of the Project.
Section 3 . The amount of the bid security to accompany each bid
is hereby fixed at 10% of the amount of the proposal .
Section 4 . The day of 4Fa
1987 , at 7; 35
o1clock p.m. , at the City Hall _, r7 Iowa, is hereby fixed
as the time and place of hearing on the proposed plans, specifications ,
form of contract and estimate of cost for the Project , and also as the
time and place of taking bids in connection therewith.
Section 5 . The City Clerk is hereby authorized and directed to
give notice of the aforementioned hearing and taking of bids by
publication of such notice in a newspaper of general circulation in the
City, which publication shall be made not less than four nor more than
twenty days prior to the time of the said hearing , all in conformity
with Chapters 362 and 384 of the Code of Iowa . The said notice 'shall
be in the form substantially as attached to this resolution.

NOTICE OF PUBLIC HEARING AND LETTING
NOTICE OF PUBLIC HEARING ON PROPOSED PLANS AND SPECIFICATIONS,
PROPOSED FORM OF CONTRACT AND ESTIMATE OF COST FOR WASTEWATER
TREATMENT LAGOON IMPROVEMENTS FOR THE MUNICIPALITY OF FAIRFAX,
IOWA, AND THE TAKING OF BIDS FOR SUCH CONSTRUCTION,
Notice is hereby ;given that the Council of the Municipality of
Fairfax, in Linn County, Iowa, will meet at the City Hall in said
municipality, on the day of , 1987, at 7 :30
o'clock p.m., at which time and place a hearing will be held on the pro-
posed plans and specifications, form of contract and estimate of cost
for wastewater treatment lagoon improvements in and for said municipality.
At the said time and place, the Council will receive and consider bids for
the construction of the aforesaid wastewater treatment lagoon improvements.
The extent of the work involved consists of maintenance work and Rip-,Rap of
the existing Lagoon Cell No. 1 along with the construction of two new
cells, No's 2 and 3, together with related subsidiary structures, piping
and incidental work.
The kinds and approximate quantities of materials and types of con-
struction for which bids will be received shall be as follows :

Proposals received will be acted upon by the Council at the time
and place above specified or at such later time and place as may then
be fixed.
All work and materials are to be in strict compliance with plans
and specifications prepared by Hall and Hall E'ngineers$ -Inc. of Cedar
Rapids, Iowa, and, together with the proposed form of contract, have
heretofore been approved by the Council and are now on file for public
examination in the office of the Clerk, and are by this reference made a
part hereof as though fully set out and incorporated herein.
All proposals and bids in connection therewith shall be submitted to
the Clerk on or before the time herein set for hearing and letting.
All proposals shall be made on official proposal forms furnished by the
Municipality or the Engineers, and must be enclosed in a separate sealed
envelope and plainly identified and addressed to Clerk, Fairfax, Iowa.
Each proposal shall be accompanied by a bid bond., certified check,
cashier ' s check or credit union share draft in a separate sealed
envelope in an amount equal to ten per cent (100) of the total
amount of the proposal. It bid bond is submitted, it must be on
the form provided with the Contract Documents . If provided, the
certified check, cashier ' s check or credit union share draft shall
be drawn on a bank or credit union in Iowa or a bank or credit
union chartered under the laws of the United States of America
and made payable to the Treasurer of the Municipality as security
that if awarded a contract by resolution of the Council, the Bidder

will enter into a contract at the prices bid and furnish the required
performance and payment bonds and certificate of insurance. 'The
certified check, cashier ' s check or credit union share draft may
be cashed, or the bid bond forfeited, and the proceeds retained
as liquidated damages if the Bidder fails to execute a contract or file
acceptable performance and payment bonds or provide an acceptable certificate
of insurance within ten (10) days after the acceptance of his proposal by
resolution of the Council.
At the said hearing, the Council will consider the plans and specifi-
cations, proposed form of contract and the estimate of cost for the
project, the same now being on file in the office of the Clerk, reference
to which is made for a more detailed and complete description of the
proposed work, and at the said time and place, the Council will also
receive and consider any objections to said plans, specifications and form
of contract or cost of such project made by any interested party.
Payment of the cost of said project will be made in cash derived
from the proceeds of the sale of General Obligation Bonds and/,or Sewer

Revenue Bonds, and/or from such other cash funds on hand as may be
lawfully used for said purpose and/or from the proceeds of the sale of
warrants authorized by Section 384. 57 of the Code of Iowa , which
warrants may be made payable from any of the above mentioned sources ,
or any combination thereof, and will draw interest at such rate or
rates as determined by the City Council at the time of their issuance.

Payment to the Contractor will be made., in .monthly estimates and one
I
final payment. Monthly estimates will be equivalent to ninety-five per cent
( 954 of the contract value of the work completed during the preceding
calendar zi nth. Estimates will be prepared on the first day of each
month by the Contractor, subject to the approval of the Engineer, who will
certify each approved estimate to the Council for payment on or before
the 15th day of the month in question. Such monthly payments shall in
no way be construed as an act of acceptance for any part of the work
partially or totally completed.
Final payment to, the Contractor will be made no earlier than thirty-
one (31 ) days from and after the final acceptance of said work by the
Council, subject to the conditions and in accordance with the provisions
of Chapter 573 of the Code of Iowa. No such partial or final payment
will be due until the Contractor has certified that the materials, labor
and services involved in each instance have been paid for in accordance
with the requirements stated in the specifications.
The work under the contract shall commence on or before
and shall be fully completed and ready for oper-
ation within /,:r o consecutive calendar days thereafter.
By virtue of ,statutory authority, preference will be given to products
and provisions grown and coal produced within the State of Iowa and to
Iowa domestic labor to the extent lawfully required under Iowa statutes.

"Bidder's Proposals, " plans and specifications may be obtained from
the Engineer. A deposit of $40.00 will be required for the plans and
specifications, $20.00 of which will be refunded to those returning them
in good condition within twenty (20) days after the date of the bid opening.
The successful Bidder will be required to furnish performance and
payment bonds on approved forms in amounts equal to one hundred per cent
(7000 of the contract price, said bonds to be issued by a responsible
surety approved by the Council., and shall guarantee the faithful per-
formance of the contract and the terms and conditions therein contained,
and shall guarantee the prompt payment of all materials and labor and
protect and save harmless the Municipality from claims and damages of
any kind caused by the operation of the Contractor, and shall also guarantee
the maintenance in good repair of all work and materials for a period of
two years from and after the completion and acceptance of the work by
resolution of the Council.
The Council hereby reserves the right to reject any or all bids,
to .waive informalities and irregularities and to enter into such contract
as it may deem to be for the best interests of the Municipality.
