Regular meeting of the Fairfax City Council was held on August 6 , 1987 ,
at 7PM, with Mayor Charles Peters presiding. Council present : Balog,
Cerveny & Shakespeare,. Absent Bach & Bullock.
Minutes of previous meeting approved on motion of Cerveny 2nd Shakespeare ,
Budget & Financial report, including F/Y 86-87 final report approved

and placed on file .

Mr. F. Kahle , South Slope Telephone Co manager, discussed with the
Council several options available in regard to the sewer alarm systems .
Future discussions will be held on this subject .
Mr. Keith Young, Iowa County Ready-Mix, discussed with council the
locating of his Ready-mix company in Fairfax, in regard to the land
available and zoning of same . Further discussion will be held with
Council on this matter .
On motion of Balog, 2nd Shakespeare, Fire dept, giving permission.
to purchase radio for new fire truck from Motoralafor $1 , 799 . 75. Carried
On motion of Balog, 2nd Cerveny Fire Dept ... by-laws accepted - as passed
by the Fire Dept . Carried,
On motion of Cerveny, 2nd Balog, Don Carver and Harold Zenisek be
accepted as probationary membersof the Fire Dept . Carried.
On motion of Shakespeare, 2nd Cerveny, approximately$62, 828 . 00 of
the Sewer reserve fund to be used for Lagoon project expenses before
resortin g to
interim financing with the bank, Carried .
On motion of Shakespeare, 2nd Balog, $300 .. 00 to be paid to James
McCormick for the loss of use of his North pasture due to the
construction of the Lagoon cells . Carried.
On motion of Cerveny 2nd Shakespeare, a new overhead door and
automatic opener to be purchased from Easter Iowa Door Company,
Lisbon, Iowa for $1 , 525, 00. This door to replace current door on
maintence building.
Resolution 8687 "RUT Street finance Report" presented and approved

RESOLUTION 82087
BE IT RESOLVED, that the City Council of
Fairfax, Iowa deems it necessary to designated
certain streets as "'"haul .streets" and establish
certain parking regulations upon these streets
for the protections of the residents whose
properties are located on said streets .
IT IS FURTHER RESOLVFDe that the one hundred
block of Prairie, the one hundred block of
Nickolet and all of Front street be so
designated as "haul streets" for the routing
of trucks involved in hauling clay to the
Lagoon construction site .
IT IS FURTHER RFSOLVED , that temporary "No
Parking" signs be installed along these streets
until project is completed.
IT IS - FURTHER RESOLVED ; that all residence.
on these streets be notified by U. S . Mail

8YLAWS OF THE FAIRFAX FIRE DEPARTMENT
Preamble
Be it resolved, that we solemnly pledge ourselves to sustain the officers
the discharge of their duties, and hold ourselves bound in honor to conform
to and abide by, in every respect, the following Bylaws.
Article I
Bylaws
Ict ion A
These bylaws shall be adopted when approved at a regular meeting by sixty
(60) percent of the active members present and when approved by the City
Courcil of Fairfax.
Section 2.
These bylaws dated shall precede all previous bylaws.

Section 3
These Bylaws can be amended or repealed by a two-thirds vote of the active
members present at a regular meeting of the department.
ARTICLE 11
Name and Purpose
Section 1
This organization shall be known as the Fairfax Fire Department.
Sect ion 2
It" s purpose shall- be to preserve life and property within it' s fire
strict, and to promote through fire safety education the prevention of such
fires and other emergencies, and to provide support when called on for mutual
aid.
ARTICLE All
Membership
Section I
The membership of this organization shall be composed of probationary,
active and honorary members.
Section :21
Any person who has attained the age of 18 years, and is a resident of
Oairfax shall be eligible for election W probationary membership in this
organization.

All applications for membership shall be in "writing and on forms provided
the department.
Section 4
After a period of six (6) months a probationary member may become eligible
for election to active membership, by approval of the departmen-�
at a regular meeting. The department can also recommend at this time, al
n4ditional probationary period or termination of this membership. Keys will be
sued' after probation period is completed.
Section 5
Any. person who has rendered distinguished service to this organization
shall be eligible for election to honorary membership in this onganizati,--in
by a two-thirds vote of the eligible voters present.
Section 6
The number of active and probationary members shall be not more than

Any memoer may be expelled from this organization for cause, including t
not limited to, improper conduct related to the members duties with the F . e
department, by a two-thirds vote of the active members at a regular meeting.
They must be notified in writing, signed by the chief, that charges will be
preferr9d against them at said meeting. This section shall not apply to special
reasons, for automatic discharge from the department that are a part
of the bylaws. Any member moving outside of the city limits of Fairfax, Iowa
shall be subject to approval by the Fire department.
Section 8
NO FIREMAN SHALL RESPOND TO A FIRE CALL; ATTEND A MEETING OR DRILL WHILE
UNDER THE INFLUENCE OF ALCOHOL OR DRUGS. THIS RULE ALSO APPLIES TO DUTY DAYS.
VIOLATION OF THIS RULE WILL BE AUTOMATIC DISMISSAL.
Section 9
All active members should make an honest effort to attend all Fire
department functions.
ARTICLE IV
Section I Officers
The officers of this organization shall consist of Chief, 2 Assistant
CKiefs' and a Secretary.
ARTICLE V
erection I Election of Officers
The election of officers of this organization shall be every 2 years, on
the year of the council elections. The election shall be held on the last
regular meeting in December of that year. The new officers shall assume their
office on the first day in January following the election.

Officers shall he elected by written secret ballot. If there is only one
wand date for an office, he may be elected by acclamation.

Any vacancy occurring in any office during the fiscal year shall be ele( :d
ond voted on by active members at the next regular meeting.
Section 4
The fire chief shall then be appointed by the city council upon
-ecommendation by the fire department. The city council shall not appoint as
fire chief any person who has not been recommended by the fire department.
Jpon refosal of the city council to appoint the chief recommended by the fire
lepartment, the office shall be declared vacant and another election held n
the next regular meeting night. In this event the previous chief or "is
assistant shall hold office until an appointment has been made.
Section 5
All committee heads, and otter officers not provided for in these bylaws #
shall be appointed by the fire chief.
ARTICLE VI
Duties of Officers

The Secretary shall keep a true and accurate account of the proceedings
every meeting.

The chief shall be in full charge of all appanatus and equipment and the
building in which said apparatus is housed, and to see that all apparatus and
equipment is in good working order.
Section
The officer in charge at a fire or emergency,, shall fill out a report of
each fire in a book provided for this purpose, immediately or after returning
to the station. The report shall state date, time, ,address, owner, occupant,
extent of damage, cause of fire, hoar extinguished, number of firemen present,
ladders and ether equipment used, or in the case of an emergency all the
information concerning said emergency. From this report a discussion of the
Fire shall be held at the next regular meeting. It shall be the duty of the
thief to see that the information in this book is available and reported to the
state Eire Marshall.
ARTICLE VII
Duties of Members
Sect ion 1
Every active member shall be considered to be on duty as soon as an alarm
is turned in by whatever means or if he discovers a fire himself.
Every active member, at the alarm of a fire or emergency, shall promptly
-eport to the fire station, pick up his fire gear and assist in getting the
apparatus to the fire and in operation. Ripon arrival at the fire every active
Member shall serve at his .assigned task and assist in any work assigned by his
tomrtmand i ng officer. On orders to pick up at fires, all active members shall
assist in breaking, draining and loading the lines and replacing the
equipment on the apparatus. They shall report back to the fire station and all �
active members present shall help put the apparatus and equipment in condition j

Any member in attendance at a fire shall make his attendance Drown to
to the officer in charge before securing from the fire ground.
On return, to the fire station it shall be the duty of any members to report
the officer in charge before dispersing.
The fireman shall familiarize himself with the fire departments equipment,

All regular members are required to attend training sessions set by the
chief or by as training officer appointed by hire.
All members shall be required to attend all meetings unless they have a
^easonaable excuse.
