MINUTES OF MEETING TO APPROVE PLANS AND SPECIFICATIONS AND FORM OF CONTRACT AND TO RECEIVE BIDS I 4861 W Fairfax, Iowa w October 29 1987 The City Council, of the City of Fairfax, Iowa , met in sx�ecial session at the C�tY Hall , in Fairfax, Iowa, at 7 : 00 o' clock P .m. , on the 29th day of OctEber 1987 , pursuant To previous resolution and published notice. The meeting was called to order , the Mayor presided and the roll being called, the following named members of the Council were present and absent: Present: `. �a Absent: - , The Mayor announced this was the ytime and place set for hearing and inspection of bids for the proposed Sewer and Water Improvements i Project. i Upon investigation, it was found that had appeared and filed objections to the proposed plans, specifications or contract for or cost of such Sewer and Water Improvements Project, as follows: ( Insert the word "no" in the blank space above or list here the names of objectors and the types of objections, if any are filed. ) I -1-- N s BELIN HARRIS HELMICK, ATTORNEYS, DE'S MOINES, IOWA I The City Council of Fairfax, Iowa met in special session at City Hall on October 29 , 1987 at 7 '.: 00 PM pursuant to resolution and published notice . Mayor Peters presiding. Council present : Bach,. Cerveny & Shakespeare Absent Bullock and Balog. Mayor announced this was the time and place set for hearing and inspection of bids for the proposed improvement projects . No persons appeared to file objections to the proposed plans , spec and or contract. On motion of Shakespeare, 2nd Bach, Resolution 102987 "Approval of plans, specifications and founof contract for sewer and water improve- ment projects" Carried. Resolution 11587 and 115871 "Award Contract" and "Approve Contract and Bond" presented on motion of Balog , 2nd Cerveny, Roll call vote : Ayes : Balog, Bach, Cerveny & Shakespeare , Nay :. none . Absent Bullock. Resolution 11587A "Approval of Issurance of Construction Warrant #2"' presented on motion of Cerveny, 2nd Shakespeare . Ball Call vote Aye : Balog, Bach, Cerveny & Shakespeare . Nays : none Absent : Bullock. Approval of cost of Lift Station improvements on motion of Balog, 2nd Bach. Carried All voting aye . On motion of Shakespeare , 2nd Bach; cost estimate to be gotten on additional land clearing in Lagoon area and referred to Mayor Peters for his further considertion. Library Board President Nancy Josifek and Librarian Linda Balog presented plans and ideas to the Council in regard to the possibility of the Library Board building a new library. .Information will be given to Council as their plans progress . _. Fire Chief Stallman gave the City Council a report on the new fire truck and show them the truck. He also requested that an additional $5, 000 . 00 be put in the 88/89 budget for the fire truck replacement fund. On motion of Bach, 2nd Cerveny, Doug Exline approved for permanent status on the fire department . Carried. All voting aye . On motion of Bach, 2nd Cerveny, an application for protective clothing for the Fire Deppartment be sent to Dept of Natural Resources , Rural Community Fire Protection Program. Carried All voting Aye . The Council heard said objectors and evidence for or against the proposed Sewer and Water Improvements Proj11ct; whereupon, the Mayor [ declared the hearing closed. After further consideration, it was found that the said objections were without merit, and it was moved by Council Member and seconded by Council Member that all objections be overruled. The Mayor put the question on the motion and the roll being called, the following named members of the Council voted: Ayes : Nays: Whereupon, the Mayor declared the said motion duly carried. ''" Finally approving and confirming plans, specifications and form of contract for the Sewer and Water Improvements Project WHEREAS, this Council has heretofore approved plans , specifications and form of contract for the proposed Sewer and "dater Improvements Project the "Project" ) , as described in the resolution providing for a notice of hearing on proposed plans and specifications , proposed form of contract and estimate of cost for the Project and the taking of bids therefor; and WHEREAS, hearing has been held on objections to the proposed plans, specifications and form of contract and to the cost of the Project and all objections thereto have been overruled; NOW, THEREFORE, IT IS RESOLVED by the City Council of the City of Fairfax, Iowa, as follows: Section 1. The plans, specifications and form of contract referred to in the preamble hereof be and the same are hereby finally approved, and the prior action of the Council approving them is hereby finally confirmed, and the Project, as provided for in the plans, specifications and form of contract, is necessary and desirable. Section 2. All resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. Passed and approved this 29th day of October , 1987.
