The City Council of Fairfax, Iowa met in special session at City Hall
on October 29 , 1987 at 7 : 00 PM pursuant to resolution and published notice .
Mayor Peters presiding. Council present : Bach, Cerveny & Shakespeare
Absent Bullock and - Balog.
Mayor announced this was the time and place set for hearing and
inspection of bids for the proposed improvement projects . No persons
appeared to file objections to the proposed plans , spec and or contract .
On motion of Shakespeare, 2nd Bach, Resolution 102987 "Approval of
plans , specifications and formof contract for sewer and water improve-
ment projects" Carried. Voting aye Bach, Cerveny & Shakespeare , Voting
nay none . Absent Bullock & Balog.

Approval of cost of Lift Station improvements on motion of Balog,

On motion of Shakespeare , 2nd Bach, cost estimate to be gotten on
additional land clearing in Lagoon area and referred to Mayor Peters
for his further considertion.
Library Board President Nancy Josifek and Librarian Linda Balog presented
plans and ideas to the Council in regard to the possibility of the
Library Board building a new library. Information will be given to
Council as their plans progress .
Fire Chief Stallman gave the City Council a report on the new fire.
truck and show them the truck. He also requested that an additional
5,000 . 00 be put in the 88/89 budget for the fire truck replacement
fund.
On motion of Bach, 2nd Cerveny, Doug Exline approved for permanent
status on the fire department . Carried. All voting aye .
On motion of Bach, 2nd Cerveny, an application for protective clothing
for the Fire Deppartment be sent to Dept of Natural Resources , Rural
Community Fire Protection Program. Carried All voting Aye ,
Mayor Peters opened public: hearing in regard to the annexation and
zoning classification petitions received by the City Council . Hearing is
no objections Mayor Peters closed the hearing.
P & Z Committees report and recommondation to approve the annexation
and zoning classification read to the council .
Resolution 11587E "Accepting annexation, zoning & subdivision of
Ron Gillunds addition to Fairfax" presented by Balog, 2nd Shakespeare
Roll call vote Aye : Bach, Balog, Cerveny & Shakespeare Nays : None
Resolution #115870 "Accepting Linn County annexation petition of
the N 33" of Cemetery Road a distance of 1 , 600 feet" presented

Ordinance 144 "Amendment to Zoning Code" 2nd reading approved on
motion of Balog, 2nd Cerveny. Motion to dispense with rule requiring
reading of ordinance on three sepe,, ,ate dates by suspended and it
be read for third time by title only presented by Balog, 2nd Cerveny
Carried. Ordinance 144 read for the third time by title only. Motion
to approve 3 rd reading by Cerveny, 2nd Shakespeare Carried . All
voting Aye . Mayor declared Ordinance duly approved and in effective
upon publication.
Building permit was approved for Selzer Construction for house at
111 Main Street .
On motion of Shakespeare, 2nd Cerveny, the designated smoking areas
in City Hall are as follows : Smoking only: Entrance hall and rest
rooms . No Smoking : Council chambers and City Clerks office . Carried
All voting Aye
Fetter read from Senior Citizen group asking for a donation to help
with their activities. On motion of Balog, 2nd Shakespeare., group
to be given $400 . 00 . Carried . All voting aye .
Action on request for street light on corner of Cemetery Road West
Stallman road was tabled on motion of Cerveny, 2nd Balog .
Discussion of speed study on Highway 151 . City Clerk to contact.
Iowa DOT in regard to lowering the speed limit with- in the city
limits to 45MPR.
Mayor Peters discussed with council three complaints that he had
received from two different citizens . No action was taken.
On Motion of Balog, 2nd Shakespeare bills present for payment be
approved . Carried . All voting aye .
"There being no further business meeting adjourned at 9 : 25PM on
motion of Shakespeare, 2n Bach Carried.

reception and consideration of bads for the Sewer and Water
Improvements Project...
It was moved by Council Member ' :. .. and seconded by

proceed with the opening of such proposals as had been filed, after
first ascertaining that the required bid security accompanied each such
proposal. The Mayor put the question on the motion and the Droll being

THE MUNICIPALITY OF FAIRFAX, IOWA

FORM OF CONTRACT
THIS CONTRACT, made and entered into in duplicate originals at Fairfax,
Iowa on the 5th day of November , 1987, by and between
the City of Fairfax, Iowa, by its Mayor, upon order by resolution of the
City Council of said City, Party of the First Part, hereinafter called
the "City" and Weber Bros, `
of Mechanicsville. Iowa Party of the Second Part,
hereinafter called the ' Contractor.
WITNESSETH:
The Contractor hereby agrees to furnish all labor,, tools, plant, equipment,
materials, and services necessary to construct, complete, test and prove
performance, the Sewer and Water Improvements, together with accessories
and appurtenances thereto as described within the plans and specification's
therefor titled "Plans and Specifications for Sewer and Water Improvements
for the municipality of Fairfax, Iowa, 1987: as prepared by Hall and Hall
Engineers, Inc. , Consulting Engineers, 226-29th Street Drive S.E. , Cedar
Rapids, Iowa, which plans and specifications are officially on file in
the office of the City Clerk of said City, and by this reference are made
a part of this contract. The Contractor hereby agrees to execute the work
of construction in strict accordance with said official plans and specifi-
cations, including all of the contract documents as the same are defined in
said specifications, and all of which documents are hereby made a part of
this contract by this reference as surely and certainly as though set out
herein verbatim.
This contract is awarded and entered into on the basis of the classes and
types of construction required by the plans and specifications, at and for
the bid prices applying thereto., all as definitely set forth in a certain
written proposal filed by the Contractor with said City Clerk of the City
of Fairfax, Iowa, on the 29th day of October 1987, and
covering items one through fifteen
appearing on said Form of Proposal, and the basic contract sum is hereby
determined to be sevepty nine thousand sixty five qn4 24/100
Dollars U 79.065.24 ) , which said sum
is the amount of the required corporate surety and maintenance bond.
The City hereby agrees to pay the Contractor for all of said construction
in the manner specifically set forth in the Notice of Hearing and Letting,.
The prices bid on each class or unit of work and the prices bid on lump
sum items shall be the basis upon which the final contract sum due the
Contractor shall be computed, subject to additions or deductions only as
may be regularly and officially ordered in writing by the Engineer repre-
senting the City within the limits provided in the specifications.
IN WITNNESS WHEREOF, the parties hereto have executed this instrument the
day and year first above written.

WHEREAS, all of the said bids and proposals have been carefully
considered, and it is necessary- and advisable that provision be Made
for the award of the contract for the Project;
NOW, THEREFORE, IT IS RESOLVED by the City Council of the City of
Fairfax, Iowa , as follows :
Section 1. The bid for the Project submitted by the following
contractor is fully responsive to the plans and specifications for the
Project, heretofore approved by the Council, and is the lowest
responsible bid received, such bid being as follows:

awarded to such contractor at the total estimated cost set out above,
the final settlement to be made on the basis of the unit prices therein
set out and the actual final quantities of each class of materials

aforementioned resolution, the notice of hearing and letting, the plans
and specifications and the terms of, the bidder ' s written proposal.
Section 3 . The Mayor and City Clerk be and they are hereby
authorized and ordered to enter into a written contract with said
contractor for the Project, said contract not to be binding until
approved by resolution of this Council.
