Regular meeting of the Fairfax City Council was held on November 3 , 19188 at 7 : 00 PM. Mayor ]Pro-Tem Vernon Cerveny presiding in the absence of Mayor Peters . Council present : Bullock, Cerveny, Nading, Svoboda and Quillin. Agenda was approved as posted and minutes as mailed on motion of t Fading 2nd Bullock. Carried. Receipts to be accounted for : General Fund $14, 955 . 71 , RUT $2, 232 . 68, Debit Sery $1 , 760 . 23, Library trust 81 . 13, FD, Trust $78 . 47 , Water Dept $2, 232 . 94, Landfill fee $1 , 662 . 00 , Sewer Dept $2, 181 . 64 . iLarry Wendt , Customer Sales & Service Representative from Iowa Electric 4 Light attended meeting and discussed several items with Council in regard to their service to Fairfax. Ordinance 148 (LIEN FOR NONPAYMENT) 149 , (WATE'R SERVICE DISCONNECT) & 150 (CROSS CONNECTIONS) were presented and read for the first time . Councilmember Svoboda moved the approval of the Ordinances on their lst reading and the the procedural requirements be suspended and that the Ordinance be placed on their 2nd and 3rd reading by titles . 2nd by Nadding . Roll Call vote . All voting aye . Ordinances 148, 149 & 150 then read the second and third time by their titles . Councilmember Bullock moved the adoption of the Ordinance as read .. 2nd by Svoboda. Roll Call vote . All voting Aye . Mayor Pro-tem Cerveny declared Ordinance 148 , 149 & 150 adopted and in effect as per publication requirements . Building permits for Lot 3 & 5 , Selzers Lakeside 3rd Additon, were presented for approval by Selzer Construction Co. On motion. of Svoboda, 2nd Bullock build-ing pewits approved. Carried. All voting Aye . On motion of Nading, 2nd Quillin, Application of Fire Dept for a Rural Community Fire protection Grant to help pay for the pagers that were just purchased approved . All voting aye . On motion of Svoboda, 2nd Bullock, Cory Stockton approved as a probationary member of the Fire Department . All voting aye . On motion of Nading, 2nd. Bullock, City Clerk to have an Ordinance drawn up changing the CityCouncil meeting fees to $15 . 00 per meeting and the Mayors Salary to $1, 000 . 00 per year, Voting :Aye Bullock, Cerveny, Quillin, & Nading Nay: Svoboda. On- motion of . Nading 2nd Quillin, City Attorney to be contacted in regard to the approval of Cory Stockton to the Fire Department because he is not 18 . Carried. All voting aye . Because of a conflict the December Council meeting will be held on Monday, December 5 , 1988 . Offer has been tendered by the Library Board on certain property but they have not received it back yet . Discussion was held on the playground equipment . Some of the swings must be removed because of wear . Further planning will be forth coming in regard to new equipment . i On motion of Nading, 2nd Svoboda, $400 . 00 that was in allotted to the local Senior Citizens group be sent to them. Carried . All voting a3=e. On motion of Bullock, 2nd Nading all bills presented for payment approved . Carried . All voting aye On motion of Nading, 2nd Svoboda meeting adjourned at 9 : 00 PM. BE IT ORDAINED BY THE CITY COUNCIL OF FAIRFAX, IOWA Section 1 The purpose of this ordinance is to amend Title. 171 - Community Development and Environment , Chapter I -- Water Service , Article 3 -- 'Water Rates , of the City Code of Fairfax , Iowa, Section 2 . The following section is added to Article 3 - Water Rates , of Title VI _ Community Development and Environment, Chapter 1 - Water Service , of the City Code of Fairfax, Iowa ::. "6-1 . 0307 LIEN FOR NONPAYMENT.. Water service charges ro-maining unpaid and delinquent shall constitute a lien upon the premises served and shall ba certified by the clerk to the county treasurer that the rates or charges are due. " ( Section 384 , 84 , Code of Iowa ) Section, 3 . All ordinances or parts of ordinances in co nflict. herewith are hereby repealed . Section 4 . BE IT ORDAINED BY THE CITY COUNCIL OF FAIRFAX, IOWA Section 1 . The purpose of this ordinance is to amend Title VI - Community Development and Environment, Chapter I - Water ,Service , Article 2 - Water Meters, of the City Code of Fairfax , Iowa. Section 2 . The following section is added to Article 2 Water Meters , of Title VI - Community Development and Environment , Chapter I - Water Service , of the City Code of Fairfax , Iowa : "6-1 . 0209 SERVICE DISCONTINUED. After giving reasonable notice , the superintendent may shut off the supply of water to any consumer who tampers with any water meter, meter seal , water service pipe or valves. " Section 3 . All ordinances or parts of ordinances in conflict herewith are hereby repealed . Section 4 . This ordinance shall be in full force and effect front and after its passage , approval and publication as provided by law. Adopted this 3rd day of November 1988 , and ,approved on the same date. BE IT ORDAINED BY THE CITY COUNCIL OF FAIRFAX, IOWA Section 1 . The purpose of this ordinance is to amend Title VI Community Development and Environment , Chapter I - Water Service , Article 1 - Public Water System, of the City Code of Fairfax , Iowa. Section 2 . The following section is added to Article 1 - Public Water System, of Title VI - Community Development and Environment , Chapter I - Water Service , of the City Code of Fairfax , Iowa : " 6-1 . 0121 A consu.mer shall not connect or cross connect any separate . water supply to any premises which is also receiving water from the city ' s water system.
