Regular meeting of the Fairfax City Council was held 5/ 9 /89 . Mayor
Charles Peters called to order at 7 : 00 PM. Council present : Bullock
Cerveny, Quillin, & Svoboda. Absent : Nading.
Agenda, Minutes of previous meeting, budget and financial reports
approved on motion of Svoboda, 2nd Cerveny.
Receipts to be accounted for . General $14, 826 . 01 , RUT 2 , 331 . 19
Debit Service : 1, 767 . 74,, Garbage fee : 1 , 540 . 00, Water dept : 1, 919 . 03 ,
Sewer dept : 3, 726 . 16 .
Mayor Peters opened public hearing on the petition of Norwest Bank
to annex, . zone and plat 9 . 66 acres of ground located between Southview
Road and Highway 151 . Discussion held between Council and potential
purchaser of Lot 1 , Mr & Mrs Mark Prabel , , James Bell , Norwest bank
and citizens in attendence . Mayor Peters closed the public hearing
at 7 : 40 PM.
Resolution 5989, "PETITION FOR ANNEXATION" was presented on motion of
Svoboda, 2nd Bullock. Carried . Voting Aye : Bullock, Cerveny, Quillin
and Svoboda . Mayor & City Clerk then signed resolution and certified
same .
The preliminary and final plat of Bailey' s First addition was presented
for consideration. City clerk read P & Z recommendations for approval
to City Council .
Resolution 5989A "APPROVING BAILEY' S FIRST ADDITION" was presented
on motion of Cerveny, 2nd Svoboda. Voting Aye : Bullock, Cerveny
Quillin, & Svoboda . Absent Nading. Mayor & City Clerk then signed
resolution and certified same .
Mr Larry Wendt, from Iowa Electrice, discussed several items with
the Council in regard to Iowa Electrics service to the City of Fairfax .
A seasonal beer permit was granted to the Fairfax Baseball Association
on Motion of Quillin, 2nd Cerveey. Carried. All voting aye .
On motion of Quillin; 2nd Cerveny, the American Legion to be
granted a beer permit for Hey Days pending receipt of dram shop
insurance and check for permit and granting them permission to
close parts of Vanderbilt and Main street for Hey Days . Carried.
All voting aye ;
0n motion of Svoboda, 2nd Quillin, Baseball team given permission
to spend up to $500 . 00 for dirt for on diamond . Carried . All voting aye .
Discussion held with City Attorneys Scott McLeod and Lisa Kenyon in
regard to purchasing of land for library and certain easements .
On motion of Cerveny, 2nd Bullock, P & Z committee given permission
to consult with and hire Iowa Codification Service to up-date
the City of Fairfax Zoning Code . Carried. All voting Aye .
City Clerk to contact the Iowa Department of Transportation in regard
warning lights on highway 151 when Fire trucks are approching the.
intersections of 151 and Wms Blvd and 151 and Losey, Prarie St .
Only one quote received for sewer main repairs . City Clerk was requested
to obtain some more quotes before the June 13th Council meeting.
On motion of Svoboda, 2nd Cerveny, City to pay the back taxes on land
acquired from Linn County in 1987 in the amount of $195 . 00 . Carried
All voting Aye .
On motion of Svoboda, 2nd Quillen, bills presented for payment
approve . Carried . All voting aye .
Motion to adjourn made at 10 : 25PM by Bullock, 2nd Cerveny. Carried.

RESOLUTION APPROVING PLAT
WNERE'AS, a Plat of BAILEY`S FIRST ADDITION TO FAIRFAX, IOWA, containing Two (2)
"hots, has been filed with the City Clerk and after consideration the same is found to
be correct and in accordance with the provisions of the laws of the State of Iowa, and
the ordinances of the City of Fairfax, Iowa, in relation to Flats and Additions to Cities,
NOW WHEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF FAIRFAX, IOWA, that the said
Flat and dedications of said BAILEY'S FIRST ADDITION TO FAIRFAX, IOWA, be and the same
is hereby .acknowledged and approved on the part of the City of Fairfax, Iowa, and the
street therein shown be, and is hereby excepted, and the Mayor and City Clerk are hereby
