A Special meeting of the Fairfax City Council was held ?/22/90 .
PUkpose of the meeting : Public Hearing on the Construction of a new
Public Library. Mayor lading presiding. Council present: Bullock,
Cerveny & Quillen. Hastings & Svoboda absent ..
Mayor Nading called Public hearing to order at 7 : 05' PM. Hearing no
objections to project , public bearing closed at 7 : 15 PM.
Resolution 82290 "APPROVAL OF INVITATION TO BID, FORM OF CONTRACT
AND SPFCIFICATIONS" was presented for approval by Cerveny, 2nd Bullock.
Voting Aye : Bullock, Cerveny & Quillen. Absent : Hastings , Svoboda .
Deadline for receiving bids for the construction of the Library will
be 7 : OOPM on September 17, was set within the above resolution, as
was the time of 7; 00 PM on September 17 , 1990 to open and read
the bids . Bid notice to be published in the Cedar Rapids Gazette
on August rte", 1990 .
There being no further business motion to adjourn made at 7 : 40PM by

RESOLUTION NO.
To approve and confirm plans, specifications, form of
contract and estimated cost for construction of a public library
in the City of Fairfax, and to provide for a Notice to Bidders
for the taking of bids for construction of the public library,
and to set the amount of the bid security.
WHEREAS, the Fairfax City Council has previously considered
plans, specifications, form of contract and estimated cost for
the proposed construction of a public library in the City of
Fairfax (hereafter "the project") ;
WHEREAS, a public hearing has been held this date to hear any
objections to the proposed plans, specifications, form of
contract, and estimated cost of the project, and all objections
thereto have been duly considered and overruled.
NOW, THEREFORE, IT IS RESOLVED by the City Council of the
City of Fairfax, Iowa,, as follows:
Section 1. The plans, specifications, form of contract and
estimated cost referred to and considered at the public hearing
this date, which have been prepared by the Novak Design Group,
are hereby finally approved and the project, as provided for in
the plans, specifications, and form of contract, shall proceed
forthwith.
Section 2 . The City Clerk is hereby authorized and directed
to give notice to bidders by publication of such notice in the
Cedar Rapids Gazette newspaper, which notice shall be in the form
substantially as attached to this Resolution. All provisions set.
forth in the form of notice are hereby recognized and prescribed
by this council and all Resolutions, Orders or parts thereof, to
the extent the same may be in conflict therewith, are hereby
repealed.
Section 3 . The amount of the bid security to accompany each
bid is hereby fixed at 10% of the amount of the proposal.
Section 4 . The day of i `l 1990, at 7 : 00
o'clock p.m. at the City Hall, Fairfax, Iowa, is hereby fixed as
the time and place of opening and considering bids received in
connection with this project.

Section 5. This Resolution shall be effective upon its
passage and approved in accordance with law.

conflict herewith be and the same are hereby repealed to the
extent of such conflict.

NOTICE TO BIDDERS FOR THE TAKING OF BIDS
FOR CONSTRUCTION OF A PUBLIC LIBRARY
IN THE CITY OF FAIRFAX, IOWA '
Notice is hereby given that the Council of the City of
Fairfax, in Linn County, Ion, will meet ,at the City Hall in the
City of Fairfax, on the _ day of Iz- , 1990 at 7 : 00
o'clock p.m. , local time, at which time and place a hearing will
be held to receive, open, read aloud, and consider bids for the
construction of a public library in the City of Fairfax, Iowa.
The extent of the work involved consists of construction of a
public library in the City of Fairfax, Iowa, with appurtenances
and incidental work. The type of construction for which bids
will be received shall be for a wood frame structure with brick
veneer of approximately 3700 sq. ft. and an adjacent paved
courtyard. Vaulted ceilings and clerestory are supported by two
exposed steel trusses .
Proposals received will be acted upon by the Council at the
time and place above specified or at such later time and place as
may then be fixed.
All work and materials are to be in strict compliance with
plans and specifications prepared by Novak Design Group of Cedar
Rapids, Iowa, and together with the proposed form of contract,
have heretofore been approved by the Council and are now on file.

this reference made a part hereof as though fully set out and
incorporated herein.
All proposals and bids in connection therewith shall be
submitted to the clerk on or ;before 7; 00 o'clock p.m. , local
time, on the day of ', y, =Y �... r - :f , 11990 . All proposals
shall be made on official propbsal forms furnished by the Novak
Design Group. Each proposal shall be accompanied by bid security
in the form of a bid bond, certified check, cashier's check or
credit union share draft in a separate sealed envelope in an
amount equal to ten per cent (10%) of the total amount of the
proposal: If bid bond is submitted, it must be on the form
provided with the Contract Documents. If provided, the certified
check, cashier's cheek or credit union share draft shall be drawn j
on a bank or credit union in Iowa or a bankk or credit union i
chartered under the laws of the United States of America and made
payable to the City of Fairfax, Iowa, as security that if awarded
a contract by resolution of the Council, the Bidder will enter
into a contract at the prices bid and furnish the required
performance and payment bonds and certificate of insurance. The
certified check, cashier's check or credit union share draft may
be cashed, or the bid bond forfeited, and the proceeds retained
as liquidated damages if the Bidder fails to execute a contract
or file acceptable performance and payment bonds or provide an
acceptable certificate of insurance within ten (10) days after
the acceptance of the Bidder's proposal by resolution of the
Council .
The work under the contract shall commence on or before
October 1, 1990, and shall be fully completed and ready for
operation on or before May 1, 1991.
By virtue of statutory authority, preference will be given to
products and provisions grown and coal produced within the State.
of Iowa and to Iowa domestic labor to the extent lawfully
required under Iowa statutes.
"Bidder's Proposals, " plans and specifications may be
obtained from the Novak Design Group. A deposit of $50. 00 will
be required for the plans and specifications.
The successful Bidder will be required to furnish performance
and Davment bonds on approved fo s in amounts sTual to one
hundred per cent (100%) of the contract price, said bonds to be
issued by a responsible surety approved by the Council, and shall
guarantee the faithful performance of the contract and the terms
and conditions therein contained, and shall guarantee the prompt
payment of all materials and labor and shall indemnify and hold
harmless the City of Fairfax, Iowa, from any and all claims and
damages of any kind related to the work of the Contractor and its
subcontractors, agents,, or employees; and shall also guarantee
all work and materials for a period of two years from and after
the completion and acceptance of the work by resolution of the
Council.
The Council hereby reserves the right to reject any or all
bids, to waive informalities and irregularities and to enter into
such contract as it may deem to be for the best interests of the
