Regular meeting of the Fairfax City Council was held at 7:00 PM on November 13. 191910- Mayor Nading presi:ding- Councilmembers present: Bullock. Cerveny. Quillin. Hastings- City Clerk sworn into office Cory Stockton. who was appointed to the Council at the October 9th- 1990 Council meeting_ }n motion of Cerveny. 2nd Bullock. Minutes of previous meeting- budget report and financial reports were appproved as presented, carried_ On motion of Hastings. 2nd Quillin- building permit for Terry Johnson at 150 Cemetery Road 'West was approved . All voting Aye After discussion of drainage problems and the storage of materials out side a building oermit was granted for d commercial building to Donald Share at 506 Williams Blvd n motion of Cerveny. 2nd Hastings- All voting Aye 3uild'ing permit for a single family dwelling at 147 Cemetery Road West requested by Mr & Mrs Ed Lala approved on motion of Cerveny. 2nd Hastings- All voting aye Ordinance 163 "Amending no parking zones was presented and read for the first time Motion to approve th'0jirst:._.re,ading:and. to suspend the rules requiring three readings made by Cerveny. 2nd. Stockton- Carried- Ordinance 63 read the 2nd and 3rd time. Motion to approve made by Cerveny 2nd Stockton , Mayor Nading declared ordinance to be approved and in effect per publication requirements Resolution 111390 "Setting Handicap Parking Space" approved on motion of Cerveny. 2nd Hasting . Carried- All voting aye- Resoltuion 111390A " Affadavit of Possession" approved on motion of Cerveny, 2nd Quillin- All voting AYe_ Mr- James Maattla . Hall Engineering. discussed with Council the cost factors in regard to installation of storm sewer. curb & gutter. and other street work on one block of Church street- Councilmember Cerveny volunteered to work with Mr- Maattla in planning and studying- this project- Concensus of City Council that certain litigation matters be turned over to the City Attorney for his handling. Motion to this effect made by Quillin. 2nd Stockton . Carried- All voting aye- On motion of Quillin. 2nd Bullock- Fire Dept to apply for Rural Community Fire Protection Program grant money for eduction programs and coats and bunker pants This total amount is $2.289-50. Carried, All voting aye. Discussion held in regard to more life insurance coverage for Fire Dept- On motion of Cerveny. 2nd Quillin . Coverage for Fire Dept to be purhased. Roll Call vote : 2 Yeas (Cerveny & Quillin) 2 Mays (Hastings.& Bullock) Stockton abstained Tie vote- - Motion failed- Lud Svoboda- Maintence Supt- discussed various OSHA requirements that will need to be met by the City in the near future. Discussion held in regard to a Ordinance in regard to Yard Waste disposal , Ordinance to be ready for December Council meeting . Discussion held in regard to the planning dfl. F/Y 91/92 Budget- A public hearing will be held before and during the budget process for Citizen input- Mayor Nading. assigned different sections of the budget to the Council - Motion to approve the bills as presented made by Quillin. 2nd Cerveny- Carried'_ Citizen suggested that the Council inquire of the American Legion if the Counci-I children qould be of any help to-them in making Santa Claus ' s visittothe local "chi rhore, fun and getting .more peolple involved. One suggestion was that maybe the Dept might escort Santa into- Fire to town on a Fire Truck- Council took the suggestion under advisement. AN ORDINANCE AMENDING TITLE II - COMMUNITY PROTECTION, DIVISION 1 - LAW ENFORCEMENT, CHAPTER 2 - TRAFFIC CODE, ARTICLE 10 - PARKING REGULATIONS, SECTION 2. 1-2 . 1008 - NO E PARKING ZONES, OF THE CITY CODE OF FAIRFAX, IOWA. BE IT ORDAINED BY THE CITY COUNCIL OF FAIRFAX, IOWA Section 1. The purpose of this ordinance is to amend Section 2 .1-2 . 1008 of Title II. - Community Protection, Division 1 - Law Enforcement, Chapter 2 Traffic Code, Article 10 - Parking Regulations, of the City Code of Fairfax, Iowa. Section 2 . Section 2 .1-2 . 1008 - NO PARKING ZONES of Title II - Community Protection, Division 1 - Law Enforcement, Chapter 2 - Traffic Code, Article 10 - Parking Regulations, of the City Code of Fairfax, Iowa, is amended by repealing the section in its entirety and adopting in lieu thereof the following: 112 . 1-2 . 1008 NO PARKING ZONES. No one shall stop, stand or park a vehicle in any of the following specifically designated no parking zones except when necessary to avoid conflict with other traffic or in compliance with the direction of a peace officer or traffic control signal. (Code of Iowa, Sec. 321.236 [1] ) 1. Vanderbilt Street, on the west side, from the fire station entrance to Linn Street. 2 . Linn Street, on the south side, from Vanderbilt Street to Park Street. 3 . Park Street, on the west side, from Front Street to Railroad Street and on the east side from Church Street to Linn Street. No parking either side on Park Street from Railroad Street to main Street. 4. Losey Street, on either side, from a point one hundred thirty-two (132) feet west of Nickolet Street to Prairie Avenue. 5. Stallman Road, on either side, from Williams Boulevard to Cemetery Road West. 6. Front Street, on the north side, from Park Street to the deadend. 7. Quarry Drive, on either side. 8 . Along the driveway at the fire station and city hall. (Code of Iowa, Sec. 321.276 [1] ) " Section 3 . All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4 . Severability. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Section 5. This ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law.
