Special City Council meeting held 12/6 /90 at 7 : OOAM. Mayor Nading presiding . Council present. : Bullock, Cerveny, Quillin, & Stockton, Hastings absent . Purpose of special meeting: Sign hold Harmless Agreement . Motion to approve Resolution 12690 made by Cerveny 2nd Bullock. All voting aye . Motion to adjourn made at 7 : 10AM by Quillin, 2nd Cerveny. j Virginia Soukup, City Clerk Russell D. Nading, Mayor Re;gular City Council meeting was held 12/11/90 - at. 7 : OOPM. Mayor-pro-tem Cerveny presiding . Council present Cerveny, Bullock, Quillin, & Stockton , Mayor Nading- & Councilmember Hastings absent . Jae_ Zac4ar and John Feld, Representatives -from Iowa Electric informed council of the rate increases for street lights and residentii . Mike Wildung, Iowa Rural Water Association, informed Council of several OSHA regulations that are coming into effect . On motion of Bullock, 2nd Stockton, American Legion Liquor permit approved . All voting aye . On motion of Quillin, 2nd Bullock, the payroll for the Fire Department was approved . Fire Chief Carver thanked the Council for expediting the Burning permit for their training session on 12 /8/90 . Jim Maatta, Hall Engineering, explain to council the type of street improvements needed for Church street and Vanderbilt Street . On motion of Quillin, 2nd Stockton, Hall Engineering to proceed with the street improvement plans . Public hearings will be set when final cost estimates are reading . All voting aye . Discussion held on Ordinance 164 "Yard Waste disposal" . Brad Buchanan, owner of Fairfax Country Market, has offered to be a disposal site for Christmas trees as Steelsmith Sanitation will no longer be allowed to haul yard waste at the same time as the regular Friday garbage pickups . On motion of Stockton, 2nd Quillin, City to buy postcards and address them and Buchanan will pay for the printing of the cards to go to all of our residence . Carried . All voting aye . Ordinance 164 "Yard Waste was read for the first time . Motion to approve lst reading made by Stockton, 2nd Bullock. Carried . Motion to despense with the 2nd & 3rd readings of Ordinance 164 as - per state code Section 380 . 3 madeby Quillin, 2nd Bullock. Motion of Bullock, 2nd Stockton Ordinance 164 approved on reading, by title only, the 2nd & 3rd time . All voting aye . Mayor.-pro-tem Cerveny declared Ordinance 164 adopted and in effect as per publication requirements. Discussion held on contributing to the Cedar Rapids Chamber of Commerce Priority One Organizations . On motion of Quillin, 2nd Stockton, City to send their regrets as they felt a contribution of $500 . 00 for five years could not be handled at this time . Carried . All voting aye Budget meetings to be set at January regular meeting. -�and -also for a pre- budget public hearing . ° On motion of Quillin, 2nd Stockton, Library Construction bill presented by General Contractor Carling be approved. All voting aye . On motion of Quillin, 2'nd Stockton, All bills presented for payment be approved. All voting aye. On motion of Bullock, 2nd Stockton meeting adjourned at 9 : 50 PM Virginia Soukup, City Clerk Vernon Cerveny, Mayor-pro-tem. RESOLUTION NO. I , WHEREAS, the City of Fairfax, Iowa, desires to conduct a training session of its Fire Department at property owned by Fairfax Grain Company located at 305 and 31.1 Railroad Street, Fairfax, Iowa and WHEREAS, Fairfax Grain Company requires an indemnity agreement in consideration for allowing the City to use and demolish the property owned by Fairfax Grain Company at 305 and 311 Railroad Street in Fairfax, Iowa. NOW, THEREFORE, BE IT RESOLVED by the City Council of Fairfax, Iowa, that the attached indemnity agreement is hereby approved and shall be executed by the City for the purposes stated previously. Section 1. This resolution shall be effective upon its passage and approval and in accordance with law. Passed and approved this `�' day of 1990. Russell Nading Mayor ATTEST: City Jerk i i INDEMNITY AGREEMENT I City of Fairfax, Iowa (City) and Fairfax Grain Company (Fairfax Grain) in consideration of Fairfax Grain allowing the City Fire Department to conduct fire training exercises and the demolition of property at 305 and 311 Railroad Street, Fairfax, Iowa, hereby agree that the City shall assume entire responsibility and liability for all damages or injury to all persons and to all property, arising out of, resulting from or in any manner connected with the fire training exercise and demolition of the property located at 305 and 311 Railroad Street in the City of Fairfax, and the City agrees to indemnify and hold harmless Fairfax Grain from any claim or judgment, including attorney fees and costs, arising out of the training exercises and demolition of the property at 305 and 311 Railroad Street, Fairfax, Iowa.
