j The regular meeting of the Fairfax City Council was held 6/11/91 at
7 : 00 PM with Mayor Nading presiding . Council present Quillin, Cerveny,
Bullock & Stockton. Absent : Hastings , Also 30 residents .- were present.
Minutes of previous meetings, Budget & Financial reports were approved
on motion of Quillin, 2nd. Stockton . Carried.
Cigarett Permits were approved for the Star Hotel & Handimart on
motion of Bulling 2nd Quillin. Carried.
Permission to transfer unused budgeted amounts and receipts from the
Library Operational budget to the Construction account on moiton of
Stockton, 2nd Cerveny.
Councilmember Stockton will find a replacement for him on the Llnn
County Civil Defense board.
Ron Snell request that something be done about his driveway that was
damage several years ago when sewer repairs were being made . On motion
of Stocketon, 2nd Cerveny, each Councilmember is to look at the
area and report back to the Mayor on their findings . Carried.
Discussion was opened with residents who were in attendence at the
meeting in regard to the 1991 Street Improvement Projct . Jim Matta,
Hall & Hall Engineering, went over the area affected and answered
questions .
Councilmember Stockton moved the adoption of a preliminary Resolutiotl .
of Necessity #61191, pursuant -to . Section 384 . 42 Code of Iowa and rescindes
Council action-. on 3/12/91 in regard to not Special:,Assessing the 1991
Street Improvement Project . 2nd Cerveny. _ Roil Call Vote : Aye , Quillin
Cerveny, Stockton & Bullock. Nays : None . , Absea-;_ Has.tings .
City Clerk state that the Project Engineers had completed and filed
the plat . The Council proceeded to determine the valuation of each lot
within the assessment district and reported such vaulations to the
Project Engineers with instuctions to show them on the scedule to be
filed .
City Clerk stated that the Engineers had prepared and filed the
preliminary plans and specifications , an estimated total cost of the work
and plat schedule as directed in the preliminary resolutionjust adopted.
Council member Bullock propcEsa�-d the adoption of the resolution 61.1-91-A approving &
adopting the said preliminary plans , specifications , plat, schedule and
estimated cost . 2nd Cerveny. Roll Call vote : Aye : Quillin, Cerveny,
Stockton, Bullock . Nays : None . Absent Hastings .
Councilmember Quillin introduced and moved the adoption of proposed
Resolution Necessity (#61.191B) covering the aforementioned Improvement
Project, and set July 8th at 7 : OOPM as date of Public Hearing on said
. Project, 2nd Stockton . Rollcall votes : Ayes-Cerveny, Bullock, Quillin
Stockton, Nays : None Absent : Hastings .
On motion of Quillin, 2nd Cerveny, PraixieRoadbuilders to proceed with
the street repairs as outlined in their estimate . Carried.
On Motion of Cerveny, 2nd Bullock, City Attorney to begin action in
regard to removal and/or cleaning up property at 308 Vanderbilt St .,
Carried. All voting aye .
Melville Wolf inquired of Council if something could be done about
the quality of water being received at his house and several of his
neigbors . On motion of Stockton, 2nd Cerveny, City Clerk to get
estimates of cost to correct this matter. Carried . Motion by , Cerveny
2nd Quillin, Mayor Nading give authorization to proceed with improvements
when cost are received. Carried . All voting Aye .
DavidMcNamara ask that a cost estimate be made in regard to extending
water and sewer across Highway 151 . City Clerk instructed to get some
cost estimates from the City Engineer .
Motion made by Cerveny, 2nd Quillin for approval of payments of bills
as presented and permission to pay any bills, within the budget received
before the end of Fiscal Year ( 6/30/91) Carried. All votingAYe .

On motion of Stockton, 2nd Cerveny, Additional, fencing to be installed
along the '-t3txterlines of the small diamond at the Park and a set of
bleacher to be purcha;.- edfor the small diamond. Carried . All voting Aye .

City Clerk report on City Wide Clean--up Days showed that the City
hauled 8 . 85 Tons ( 17 , 700 lbs . ) to the CR Landfill and disposed of 25
appli ances . The cost of the Landfill was $24 . 25, plus the time
of Steelsmith Sanitation. There were seven ( 7) volunteers that helped
the City Maintence man do the collecting . In spite of a notice to everyone
that there would be no tires picked up, 13 were collected and it cost.
the city $21 . 00 dollars to get rid of them. If there is a clean-up day
held next year, greater restriction and enforcement of regulations
must be carried out .
On motion of Quillin 2nd Stockton, meeting adjourned at 10 : OOPM.

A special meeting of th- Council of the City of Fairfax was held
at City Hall at 7 : OOPM on 7/8/91 . Mayor Nading presided and the
roll was called showing members present, Cerveny, Hastings , Bullock
Quillin & Stockton. Absent : None .
The Mayor announced that this was the time and place set for the
hearing upon the proposed resolution of necessity covering the 1991
Street Improvement Project. All written objections filed and all
written or oral objections filed or made during the hearing were
considered by the Council . Written objections received from the
following property owners who were to be assessed . Duncan Suthers
Michael Snider, George Van Dee, Donald Share,, & Lyle Vance .
j Oral Objections from property owners who were to be assessed; John E .
Nehaus, Alice Barnett, Gary Dwyer, Donald Larson, Lawrence Matthess,
Bernice Mulherin & Betty Krahmer, and other residence of the City of Fairfax
Resolution 7891 "Amending the Resolution of Necessity" was approved
on motion of Bullock, 2nd Cerveny. Carried. All voting Aye
After further discussion with those in attendence, Councilmember
Cerveny moved and Councilmember Ken Quillin, that the Resolution
of Necessity'_' of the 1991 Street Improvement project, as amended,
be finally adopted . After due consideration therof by the Council.
the Mayor .put the question upon the motion and roll call being called,
the following Councilmembers voted . AYES : Stockton & Bullock,
NAYS ; Cerveny, Quillin, Hastings . Whereupon the Mayor declared
said resolution defeated.
Motion for adjournment was made by Bullock at 9 : 30PM 2nd Stockton.
Carried . All voting aye .
