Regular meeting of the Fairfax City Council was held on November 12 , 1991 .
at 7 : 00 P . M . Mayor Wading presiding . Council present : Bullock, f
Cerveny, Quillin, Stockton . Absent : Hastings .
Motion to approve agenda, minutes of previous meeting , budget and
financial reports , made by Stockton, 2nd Cerveny . Carried .
Deputy Sheriff was in attendance - The discharging of firearms
within the City Limits was discussed . On motion of Stockton, 2nd
Bullock Don Share , Texas Rustfree , a conditional Use Permit to comply
with DOT regulatins . Carried . City Clerk to send a letter to DOT
in regard to granting this permit .
Amendment Resolution 111291 - A RESOLUTION SETTING THE SALARIES FOR
EMPLOYEES OF THE CITY OF FAIRF'AX, IOWA FOR THE F/Y 91-92 . Motion by
Cerveny, 2nd Quillin. Carried .
Russ Carver-Fire Chief- presented a request to get a DNR Conservatin
grant . The Picnic Open House was well attended , 238 citizens came
and enjoyed .
Ken Selzer was granted a building permit for an 8 plex . Motion by
Stockton 2nd Quillin . Carried .
Ordinance 168 presented and read for the first time , Approved on motion
of Stockton, 2nd Quillin. Cerveny moved and Bullock 2nd that the
2nd & 3rd readings of Ordinance 168 be dispensed with and that Ordinance
168 be read by title only for 2nd & 3rd time . Motion to approve made
by Stockton 2nd Quillin. Mayor Nading declared Ordinance 168 passed
and in effect as per publication requirements .
Ordinance 169 presented and read for the first time . Approved on motion
of Stockton, 2nd Quillin. Cerveny moved and Stockton 2nd that the
2nd & 3rd readings of Ordinance 169 be dispensed with and that
Ordinance 169 be read by title only for 2nd & 3rd time . Motion to
approve made by Stockton 2nd Cerveny. Mayor Nading declared Ordinance 169
passed and in effect as per publication requirements .
Ordinance 170 presented and read for the first time . Approved on motion
Stockton 2nd Bullock . Cerveny moved and Stockton 2nd , that the 2nd &
3rd readings of Ordinance 170 be dispensed with and that Ordinance
170 be read by title only for the 2nd & 3rd time . Motion to approve
made by Stockton, 2nd. Bullock . Mayor Nading, declared Ordinance 170
passed and in effect as per publication requirements .
Ordinance 171 presented and read for the first time . Approved on
motion Stockton, 2nd Quillen. Cerveny moved and Quillin 2nd that the
2nd S 3rd readings of Ordinance 171 be dispensed with and that
Ordinance 171 be read by title only for 2nd & 3rd time . Motion to
approve made by Stockton, 2nd Bullock . Mayor Nading declared
Ordinance 171 passed and in effect as per pulication requirements .
An Ordinance Amending Title II - Community ]Protection, Division I -
Law Enforcement , Chapter 2 - Traffic Code, Article 6 - Stop or Yield
Required, Section 2 . 1-2 . 0602 Special Stops Required , of the City
Code of Fairfax, Iowa .. Parking on one side of Prairie Ave . Voted
down on a motion by Quillin, 2nd Cerveny. The Council decided to
delay action, until a survey of parking problems for the City
could be study. The Mayor to appoint a Committee to study the
problem. Approved on a motion by Stockton, 2nd Quillin .
The Mayor is to write a letter to the Board of Supervisors on the
Petition to Annex Southview Road . Motion Quillin, 2nd Cerveny.
The Council will delay action on appointing a recycling Committee
until the new Council is sworn in,
Councilman Cerveny reported on the Trees Forever Program. The City
will receive $1 , 000 from Iowa-Illinois Gas Electric . The Committe will
try to raise matching funds . Cerveny reported on the Library Board
Meeting . Usage has increased since the new Library opened . There are
several items that still need to be fixed before the construction can
be considered complete .
Councilman Quillin reported on the Street Committee . They met in

in September & October . There are questions that need to be answered
before there will be another meetin :
Approved on a motion by Qpillin, 2nd Stockton the City Council decided
to vote to Terminate Linn County Municipalities Association and Transfer
funds .
The City Clerk was instructed to advertise for a Deputy Clerk. The ad
to placed in the Gazette Sunday 11-17-91 to Saturday 11-23-91 . Deadline
for applications will be Friday November 29 .
H . L . "Wig" Shakespeare was appointed to the Planning and Zoning Committee .
The Clerk and Deputy will set up times to visit some Cities to study
their Computer Operations. .
The Policy on the Library Community room was discussed . On a motion
by Stockton, 2nd Bullock . Cerveny was requested to talk to the Library
Board and bring the final policy back for Council approval .
The Council will look into the storage of personal items on City property .
The IC&NW to be contacted in regard to finishing the sidewalk over the
railroad tracks . Bullock is still working on the new letterhead for
the C-ity. The Audit was discussed .
Approved on a motion by Quillin, 2nd Stockton to use RUT funds to pay
for the new gas tank .
The Clerk instructed to write a letter to the Iowa State Utility Board
opposing the proposed rate increase .
Bills presented for payment , approved on motion of Cerveny, 2nd
Stockton . All voting Aye .
On motion of Bullock, 2nd Stockton meeting adjouned at 10 : 00 p . m.

BE IT RESOLVED :
Section 1 . The following named position shall
be paid the wages indicated and the
City Clerk is authorized to issue
checks , leas legally required or
authorized deductions from the amounts
set out below, and make contributions
to IPERS AND FICA or other purposes
as required by law or order of the
City Council, all subject to audit or
review by the City Council .

ISURANCE: Blue Cross/Blue Shield Protector
200 . The City shall be responsible for
the first $500 . 00 each year . (Single
Policy)
HOLIDAYS : New Years , Good Friday, Memorial
Day, 4th of July, Labor Day, Thanksgiving,

SICK DAYS Four per year and may accumulate
up to 30 days .

ADMINISTRATION, CHAPTER 1 - GENERAL PROVISIONS, ARTICLE
II - OFFICERS AND EMPLOYEES, SECTION 1-1. 0207 (10)
CONFLICT OF INTEREST. , OF THE CITY CODE OF FAIRFAX,
IOWA.
BE IT ORDAINED BY THE CITY COUNCIL OF FAIRFAX, IOWA.
Section 1. The purpose of this ordinance is to amend
Section 1-1. 0207(110) Conflict of Interest. Of Title I -
Policy and Administration, Chapter I - General Provisions,
Article II - Officers and Employees of the City Code of
Fairfax, Iowa.
Section 2 . Section 1-1. 0207 (10) Conflict of Interest.
of Title I - Policy and Administration, Chapter I - General
Provisions, Article II - Officers and Employees is amended
by repealing this subsection in its entirety and adopting in
lieu thereof the following:
1110. Cumulative Purchases. (a) Contracts not
otherwise permitted by this section, for the purchase
of goods or services by a city having a population of
more than 2,.500, which benefit a city officer or
employee,. if the purchases benefiting that officer or
employee do no exceed accumulative total purchase price
of 1, 500 in a physical year. , (b) Contracts not
otherwise permitted by. this section for the purchase of
goods or services by a city having a population of
2 , 500 or less, which 'benefit a city officer or
employee, if the purchases benefiting that officer or
employee do not exceed accumulative purchase price of
$2,500 in a fiscal year.
(Code of Iowa, Section 352.5)
Section 3 . All ordinances and parts of ordinances in
conflict hereof or hereby repealed.
Section 4 . S'everability. If any section, provision or
part of this ordinance shall be adjudged invalid or
unconstitutional, such adjudication shall not affect the
validity of the ordinance as a whole or any section,
provision or part thereof not adjudged invalid or
unconstitutional.

Section 1. The purpose of this ordinance is to amend
Section 2 . 1-3 . 0217('2) Hours of Operation, of Title II -
Community Protection, Division I - Law Enforcement, Chapter
3 - Beer, Liquor and Wine Control, Article II - Beer, Liquor
and Wine Permits of the City Code of Fairfax, Iowa.
Section 2 . Section 2 . 1--3. 0217 (2) Hours of Operation,
of Title II - Community Protection Division I - Law
Enforcement Chapter 3 - Beer, Liquor and Wine Control,
Article II - Beer, Liquor and Wine Permits of the City Code
of Fairfax! Iowa is amended by repealing this sub-section in
its entirety and adopting in lieu thereof the following:
"2 . 1-3 . 0217 (2) Hours of Operation. Sell or dispense
any alcoholic liquor, wine or beer on the premises
covered by the license or permit, or, permit its
consumption thereon between the hours of two (2)
o'clock a.m. and six (6) o'clock a.m. on a week day,
and between the hours of two (2) o'clock a.m. and eight
(S) o'clock a.m. on Sunday and between the hours of two
(2) o'clock a.m. and six (6) o'clock a.m. on the
following Monday.
(Code of Iowa, Section 123 .49 (2b) and 123 . 150) "
Section 3 . All ordinances and parts of ordinances in
conflict hereof or hereby repealed.
Section 4. Severability. If any section, provision or

IMPOSED ON PRIMARY ROAD NO. 149, OF THE CITY CODE OF
FAIRFAX, IOWA

Section 1. The purpose of this ordinance is to amend
Section 8. 1. 0204 Access Controls Imposed on Primary Road No.
149, Title VIII - Transportation Chapter, 1 - Streets and
Alleys, Article II -Controlled Access Facilities of the City
Code of Fairfax, Iowa.
Section 2 . Section 8-1. 0204 Access Controls Imposed on
Primary Road No. 149 of Title VIII - Transportation, Chapter
1 - Streets and Alleys, Article 2 - Controlled Access
Facilities is amended by repealing this section in its
entirety and adopting in lieu thereof the following:
118-1. 0204 Access Controls Imposed on Primary Road No.
151. There are hereby fixed and established
controlled-access facilities on the Primary Road System
extension improvement, project No. FN-255,. Primary Road
No. 151, within the City of Fairfax, described as
follows:
Beginning at the SCL at Sta. 178+70.0, thence
northeasterly to the ECL at Sta. 255+61. 0. Eq. Sta.
191+50. 6 = Sta. 191=54. 5. Eq. Sta. 204+65.9 = Sta.
199+96. 0, regulating access to and from abutting
properties along said highway all in accordance with
the plans for such improvement identified as Project
No. FN-255, on file in the office of the clerk. "

BE IT ORDAINED BY THE CITY COUNCIL OF FAIRFAX, IOWA
Section 1. The purpose of this ordinance is to amend
Title II -- Community Protection, Division I - Law
Enforcement, Chapter 2 - Traffic Code, Article 4 - Speed
Regulations of the City Code of Fairfax, Iowa.
Section 2 . Title II - Community Protection, Division I
Law Enforcement, Chapter 2 - Traffic Code, Article 4 -
Speed Regulations is hereby amended by adding the following
section:
"Section 2 . 1-2.0413 SPECIAL 15 MPH SPEED ZONE. Speed
in excess of fifteen (15) 2miles per hour shall be unlawful
on Front Street. "'
Section 3 . All ordinances and parts of ordinances in
conflict hereof or hereby repealed.
Section 4 . Serverability. If any section, provision or

Section 1. The purpose of this ordinance is to amend
Section 2 . 1-2 . 0602 Special Stops Required of Tittle II -
Community Protection, Division 1 - Law Enforcement, Chapter
2 - Traffic Code, Article 6, Stop or Yield Required of the
City Code of Fairfax, Iowa.
Section 2 . Section 2 . 1-2 .0602 Special Stops Required
of Title 11 - Community Protection, Division 1 - Law
Enforcement, Chapter 2 - Traffic Code, Article 6, Stop is
hereby amended by repealing the section in its entirety and
adopting in lieu thereof the following:
112 . 1-2 . 0602 SPECIAL STOPS REQUIRED. Every driver of a
vehicle shall stop in accordance with the following:
I. Prairie. Avenue. Vehicles traveling on Nickolet
Street shall estop at Prairie Avenue, and vehicles
traveling north on Losey Street ' shall stop at Prairie
Avenue.
2 . Main Street. Vehicles traveling on Park Street
shall stop at Main Street.
3 . Reynolds Street. Vehicles traveling on Main
Street shall stop at Reynolds Street.
4 . Vanderbilt Street. Vehicles traveling on Prairie
Avenue shall stop at Vanerbilt Street.
5. Park Street. Vehicles traveling on Prairie
Avenue shall stop at Park Street."
Section 3 . All ordinances and parts of ordinances in
