ADJOURNMENT Regular meeting of the Fairfax City Council was held at City Hall at 7' : 00 B , M, on 12/10/91 .,. Mayor Nading presiding, Council present : Cerveny, Bullock, Quillin & Stockton . Absent : Hastings , Motion to approve agenda , as posted, minutes of previous meeting, budget and financial reports made by Stockton, 2nd Bullock . Carried . Discussion held with Mike Sankot on the Legion Ivey Deys , which will be held tentatively 6/ 19 & 20 . It is still in its planning stages . Motion by Cerveny, 2nd Quillin to accept Kenneth Barnell , Jr . as a new fireman, and the payroll for 1991 . Ordinance 172 was read for the first time . Councilmember Stockton moved 2nd. Bullock, Carried . Cerveny moved the approval of Ordinance 172 on its first reading and that the procedural requirements as per state law be suspended and that the Ordinance be placed on its 2nd and 3rd -' reading by title only, 2nd Stockton . Ordinance 172 was read for the 2nd & 3rd time . Cerveny moved the adoption of the Ordinance as read, 2nd. Stockton . Mayor Nading, declared Ordinance 172 adopted and in effect as per publication requiremuents . Motion of Quillin, 2nd Cerveny to accept Cory Stockton ' s letter declining his election to the City Council . Carried . Motion of Quillin, 2nd Stockton to certify Mark Sheely as being duly elected to the Council . Carried . The City Clerk ' s were given permission to attend a budget workshop in Waterloo on December 11th . Motion by Quillin, 2nd Cerveny, Carried. Kathy Bullock and Mary Ann Peters were appointed to study the applications for a deputy Clerk and make a recommendation to Council .. Motion of Stockton, 2nd Cerveny to hire a parttime maintance person. After further discussion Council member Stockton withdrew his motion . Motion Stockton, 2nd Cerveny future Elections will be held in the new Library Community Room. Motion Quillin, 2nd Stockton the clerk is to write a letter to Garling Construction from the Council stating that his bill will be paid when all work is completed at the Library to the satisfacation of Don Young, Cindy Divishek;, Greg Sundberg and Linda Balog . Councilmember Stockton will send a letter to Mike Snider_ concerning his renters cleanup . The Community Room Policy of the new Library was given the Council okay. On a motion of Quillin, 2nd Bullock bills presented for payment approved Carried. The Mayor and new Council were sworn in. Motion to adjourn made a 9 : 00 p . m. by Stockton, 2nd Cerveny . Carried. Nading City Clerk Mayor \I I i i ORDINANCE � - AN ORDINANCE AMENDING TITLE II - COMMUNITY PROTECTION, DIVISION 1 LAW ENFORCEMENT, CHAPTER 2 - TRAFFIC CODE, ARTICLE 6 - STOP OR YIELD REQUIRED, SECTION 2 . 1-2. 0607 YIELD INTERSECTIONS, OF THE CITY CODE AT FAIRFAX, IOWA BE IT ORDAINED BY THE CITY COUNCIL OF FAIRFAX, IOWA. Section 1. The purpose of this ordinance is to amend Section 2 . 1-2 . 0607 Yield Intersections of Title II - Community Protection, Division 1 - Law Enforcement, Chapter 2 - Traffic Code, Article 6, Stop or Yield Required of the City Code of Fairfax, Iowa. Section 2 . Section 2 . 1-2 . 0607 Yield Intersections of Title II - Community Protection, Division 1 - Law . Enforcement, Chapter 2 - Traffic Code, Article 6, Stop or Yield Required, is hereby amended by deleting section 2 .1-2 . 0607 in its entirety and substituting in lieu thereof the following: 112 . 1-2 . 0607 YIELD INTERSECTIONS. (a) Every driver of a vehicle traveling north on Vanderbilt Street, Park Street or Nickolet Street shall yield the right of way, slowing down or stopping if need be to so yield, to any vehicular traffic on Front Street. (b) Every driver of a vehicle traveling east on Prairie Avenue shall yield the right of way, slowing down or stopping if need be to so yield, to any vehicular traffic on Park Street. " Section 3 . All ordinances and parts of ordinances in conflict hereof or hereby repealed. Section 4. S'everability. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part 'thereof not adjudged invalid or unconstitutional. Section 5. This ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law. Fairfax Library Board Donald Young, President PO Box 94 Fairfa_:, Iowa Board Members : This is to inform you that the Precinct polling location will be moved to the Community Room of the Library. Some of the requirements for housing a precinct polling place include : 1 . The building needs to be opened at 6 : 00 am, or 12 : 00 Noon (depending on the type of election) , and remain open until the precinct election officials have finished their duties . This could range from 9 ; 00 pm to 10 : 00 pm, depending on the type of election . 2 . All elections are held on Tuesdays " in 1992 , the scheduled election dates are June 2 , September 8 and November 3 . 3 . We send written notification before each election , with information regarding the election date , voting hours and when our voting machine technician will be out to program the machine . Programming is , one two to three weeks before the date of the election . 4 . We need to store the voting equipment on location . A space approximately 36" high, 48" long and 30" deep should be sufficient . 5 . Buildings supported by taxation must make space available at no charge . 6 . The voting area should be large enough to accomodate the election officials , voting equipment and voters . We ask that you provide tables and chairs as needed . 7 . An, elcctrical outlet needs to be available to plug in the voting aachine . The officials must also have access to a telephone . I will notify the Minn County Auditor of this change . I told him at that time that I would bring this matter to the attention of the council at tonights meeting and would let him know in a letter from the City of Fairfax or from the Fairfax Library Board of your decision . As I stated before , some of the information in this letter is unknown to the library beard as it has occurred since they last met . The llibrary ultimately belongs to the City of Fairfax and the final decision regarding the payment to Garling Construction rests with the council . Donations 119 . 40 Library Construction 19 , 172 . 50 i P.O. eat t73 fax, 9aaa 5222 t9-�4dp22® December 23 , 1991 It is agreed between Ronald Dusil and the 'City of Fairfax that Ronald Dusil shall became a part time employee of the City of Fairfax, effective January 1 , 1992 , under the following conditions : 1 . ) Pay shall be at the rate of $7 . 50 per hour with a guaranteed number of hours , not to exceed 60 hours per month - any hours over 60 to be approved by the Mayor . 2 . ) Mr. Dusil to fill in for any absences by the Superintendent of Public Works -- either sick or regular vacation -- to be paid at the rate of $7 . 50 per hour . Only scheduled fill in of vacation time shall be in addition to the 60 hour per month . Any other time shall be applied to the guaranteed 60 hours per month. 3 . ) Mr . Dusil will perform weeKend duties at least two weekends each month, as agreed upon by Mr .
