ADJOURNMENT Regular meeting of the Fairfax City Council was held 1 /14/92 at 7 : 00 P . M. . Mayor Nading Presiding . Council Present : Bullock, Cerveny, Quillin, Sheely. Peters Absent . Minutes of the previous meeting, budget and financial reports approved on motion of Cerveny, 2nd Quillin. Carried . Mr . John Feld , zowa Electric introduced the new Customer Service Manager , Grant. Harper, who will take over wher.> John retires April lst . I . E . was granted a interim rate increase of 4 . 35% with a final decision to be made August 1 , 1992 . Mr . Tom McCartan and Mr. Dan Brietbach from Entre Computer Center presented a brief summary of their computers . No decision was made, a demonstration will be held at City Hall on Monday January 20 . The following were appointed to two year terms with the City. Betty Panek, City Clerk, Vernon Cerveny, Mayor Protem, Russell Carver , Fire Chief , Scott McLeod, City Attorney, Hall & Hall Engineer , City Engineers , Dawn Richmond, Deputy City Clerk . Donald Young, Nor_rine 2amastil , and Melvin derrick were reappointed to terms on the Library Board . , The Council instructed the Clerk to,,the Sheriff ' s department notifing them of their decision to cut the hours to 20 per week in the F/Y 1992/1993 . Motion Quillin, 2nd Cerveny . Carried . Discussion was held on increaseing Garbage rates , Water rates , past due charges and assesslate charges on the next bill . The Ordinances will be presented at the February Council Meeting for Approval . Motion of Cerveny 2nd Sheely, an agreement will be drawn up with Virginia Soukup for $12 . 50 per hour for services rendered to help in the transition between the Clerk ' s position . A Resolution was passed raising the Council Pay of the Clerk from $10 . 00 to $25 . 00 . Motion of Quillin 2nd Sheely a building permit was issued to Bill Barry for a new home on Longview Drive .. Russ Nading will contact Mr . Mike Snider about the Cleanup of his tenants , Banes Construction, property... A Budget workshop will be held at City Half! on February 4th . Motion of Cerveny 2nd . Quillin a Resolution 11492 was passed, opposing the Proposal of the Governor ' s Committee to Re-Allocate RUTF to the General Fund. Motion of Cerveny 2nd Bullock to approve the Bills as presented . Evelyn Miller asked the council if she would be premitted to remove the sidewalk in front of her home to improve the drainage, . The Council said they would look into the matter and get back to her . The Librain notified the Council that their is still some work that needs to be completed, but Mr . Garling has been putting it off . Linda is to notify Mr . Galing that if the work is not completed in 7 days , we will hire someone to complete the job and deduct the amount from his final bill . RESOLUTION OPPOSING THE PROPOSAL OF THE GOVERNOR` S COMMITTEE ON GOVERNMENT SPENDING REFORM TO ADDRESS IOWA' S STATE BUDGET DEFICIT BY RE--ALLOCATING $50 ,000, 000 . 00 FROM MOTOR VEHICLE USE TAX REVENUES TO THE STATE GENERAL FUND. WHEREAS , the Governor ' s Committee On Government Spending Reform has issued its final report which proposes to reallocate $50 million of use tax revenues annually for four years to retire the GAAP deficit and to start building an emergency reserve fund; and WHEREAS , it is estimated the annual costs of this proposal to municipal governments will range from $4 . 71 per capita to $9 . 65 per capita; and WHEREAS , If is estimated that the city FAIRFAX will lose between $3 , 673 . 80 and $7 , 527 . 00 annually in revenue from the use tax; and WHEREAS , as a result of the Surface Transportation Efficiency Act of 1991, municipal governments ' share of federally-financed transportation programs has increased. from 10 percent to 20 percent of project costs ; and WHEREAS , numerous existing annual diversions from the Road Use Tax Fund (RUTF) , such as funding of the Iowa highway Patrol , reduces municipal governments ' share of RUTF revenues ; and WHEREAS , any loss of road funds by municipal governments will result directly in property tax increases or service reductions to municipal residents ; and WHEREAS , the FAIRFAX City Council is opposed to any diversion of funds from the RUTF to finance state budget deficits ; and WHEREAS, the FAIRFAX City Council desires to publicly declare its opposition to the diversion proposal and wishes its position be communicated to the Governor and the Iowa Legislature . NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRFAX, IOWA, that the City Council is opposed to any proposal which reduces municipal governments ' share of state revenues to , the Road Use Tax Fund . Ordinance 165 - GARBAGE RATES 3-4 . 0211 COLLECTION FLEES . I . Schedule of Fees . lie New fee will be $10 . 00 . 2 . WATER RATES : 6--1 . 0302 RATES AND . SERVICE. 1 to 3 , 000 gallons - $4 . 00 (Minimum bill) 3 . 001 and up $2 . 00 per thousand . 6-1 . 0304 BILLING FOR WATER SERVICE : t: , LATE PAYMENT PENALTY Bills not paid by the 20th of each billing period shall be considered delinquent . A late penalty, of two ( 2 ) dollars shall be added to each delinquent bill . It will be assessed to the next month bill if it is not paid . Each consumer shall pay for water service provided harm by the city based upon his use of water as determined by meters provided for in Article 2 of this chapter . Each location, building , premises or connection shall be considered a separate and distinct consumer whether owned or controlled .by the same person or not. (Code of Iowa , 1985 , Sec. 384. 84 [ 11 ) 6-1 . 0302 RATES AND SERVICE. Water service shall be' furnished at the following monthly rates within the city: (Code of Iowa , 1985 , Sec. 384. 84 [ 11 ) I to 3 , 000 gallons - $4 . 00 (minimum bill) . 3 , 001 to 10 , 000 gallons - $1 . 50 per .thousand . 10 , 001 to 13 , 000 gallons - $1 . 55 per thousand . 13 , 001 to 15 , 000 gallons - $1 . 60 per thousand . 15 , 001 to 18 , 000 gallons - $1 . 65 per thousand . 18 , 001 to 20 , 000 gallons - $1 . 70 per thousand . 20 , 001 to 23 , 000 gallons - $1 . 75 per thousand . 23 , 001 to 25 , 000 gallons - $1. 80 per thousand . 25 , 001 gallons and up -- $1 .80 plus $.. 10 for each thousand over 25 , 001 . 'Water service shall be provided any consumer located outside the corporate limits of the city which the city has agreed to serve at rates one hundred fifty (1-50 ) percent of the rates provided in Section 6-1 . 0302 . No such consumer , however , will be served unless he shall have signed a service contract ag.rQeing to be bound by the ordinances , rules and regulations applying to water service established by the council. Billing and payment 'llo water service shall. be in accordance with the fowing : Iowa , 1985 , Sec. 38 - 84 (Code of j 1 , Meters Read. Water meters shall be read monthly. 2 . Bills Issued . The clerk shall prepare and issue 2 . for water service on or before the tenth ( 10th) clay month following each monthly period , ills payable . Bills for water service shall be due e 3 . B the twentieth ( 20 th) payable at the office of the clerk by period . of the month following the end of each monthly Bills not paid by the 20th of 4 . Late payment Penalty. A late each billing period shall be considered delinquent., Of {1) dollar shall be added to each delinquent pen alt y one bill . The City of Fairfax will not collect dead animals; animal manure; motor vehicles; car bodies; liquids; hazardous or toxic wastes; explosives; hot ashes; solid or semi-solid waste resulting from industrial, commercial or agricultural � activities; industrial by sewage treatment Ii wastes ; combustible liquids; any article or bundle more than 48 inches long and/or 18 inches in diameter and/or weighing more than fifty (50) pounds; materials resulting from construction., demolition or repair of buildings except for properly contained or bundled materials resulting from work done by the owner or occupant of the residential p remises. No article or bundle which by its nature constitutes a hazard to a collector of solid waste. 3-4 . 0208 TREE LIMBS AND BRUSH. Tree limbs of less than four (4) inches in diameter and brush will be collected provided they are placed at the curb or alley line, securely tied in bundles not more than forty-eight (48) inches long eighteen (18) inches in diameter when not in approved containers and weigh no more than fifty (50) pounds. 3-4 . 0209 YARD WASTES. Yard wastes shall be collected provided they are separated by the owner or occupant from all other garbage and refuse accumulated on the premises and stored in containers or securely tied as provided in Section 3-4 . 0110,' so as to prevent the dispersal of such wastes upon the premises served or upon adjacent property or public rights of way. The weight of any indivx.dual container or bundle shall not exceed fifty (50) pounds. 3-4 . 0210 RIGHT TO ENTRY. Solid waste collectors are hereby authorized to enter upon private property for the purpose of collecting solid waste therefrom as required by this article; however, solid waste collectors shall not enter dwelling units or other residential buildings. 3-4 . 1211 COLLECTION FEES . The collection and disposal of solid waste as provided by this article is declared to be a benefit to the property served or eligible to be served and there shall be levied and collected fees therefor in accordance with the follouring: 1. Schedule of 'Fees. The fee for solid waste collection and disposal services from residential premises shall be: A. For each single family residence - $8 . 00 B. For each dwelling unit of a -multiple family dwelling - $8 . 00 2 . Payment of Bills. All fees shall be due and payable under the same terms and conditions provided for payment for water service except that the January 4, 1992 Dear Mayor Nading, on Saturday evening, December 26th,as I was walking home from Mass I tripped and fell on the sidewalk by what was the Duggan property. For about three days I felt like a truck had run over me and troy knees are still very sore. I could have broken a hip, leg etc, but luckily I did not . I am verb= surprised that someone has not gotten badly hurt on some of the sidewalks here in our city. From past experience I know that anytime "sidewalk repair or replacement" appears on the Council agenda the meetings are packed with protesters . Myself and my neighbors on both sides of me have always kept our :sidewalks in good repair why can not the rest of the property owners do the same. I am quite sure you are aware that if a City (Knows that sidewalks are in need of repair or replacement/ a t�eyoareng�st as liable for damages as the property owner . I suggest that a sidewalk program should b e started in our city and possibly enforcing the sub-divisors ordinance that requires sidewalks in all new additions . I suggest that you and the City Council look again into a sidewalk re- placement program and this time carry through on it before you have a law suit on your hands . I On another matter , just before Christmas I received a invitation from the City ' s current maintance person and his wife to attend a "last minute Christmas shopping party" at their home and among the items for sale was a water conditioning system that removes chlorine, lead , copper and some nitrates from our drinking water. . . . .HE is the one that puts the chlorine in the water and test will show that our lead content, as well as copper and nitrates are negligible amounts . (A copy of this letter is enclosed) I believe that this kind of products should not be sold by an employee of the city. I am in hopes that you will be able to take care of the two matters referred to in this letter. May I hear from you in this regard .
