Regular meeting of the Fairfax City Council was held at City hall.
at 7 : 00 P . M, on March 10, 1992 , Mayor Nading presiding . Council present
Bullock, Cerveny, Sheely, Peters . Absent : Quillin.
Motion to approve agenda as posted, minutes of previous meetings ,
budget and financial reports made by Cerveny, 2nd Peters . Carried .
Rebecca Palmer , Planning Coordinator , Linn County, was present to
discuss the new outlines for the Linn County Landfill policies and
Community Recycling Plans . Mary Ann Peters was appointed by the Mayor
to head up the Recycling Committee for the City.
'The clerk is to check into the possibility of purchasing a pager
for the Sewer Alarm System. A list of some of the.....work: that needs to
be: done around - the City was presented . The Council said the Maintenance
persons should keep the Council informed as to when these items have
been done .
Ordinance 173 was read for the second time, changing the Garbage.
rate from 8 . 00 per month to $10 . 00 per month. Motion Cerveny, 2nd Sheely
Carried . Cerveny moved and Peters 2nd that the 3rd reading be dispensed
with, and that Ordinance 173 be read with title only . Carried .
Ordinance 173 read by Title Only for third time . Motion to approve
Cerveny, 2nd Peters , Carried. Mayor Nading declared Ordinance 173
gassed and in effect as per publication requirements .
Ordinance 174 was read for the second time , changing the Water rates
and increasing the past due charges . Motion Cerveny; 2nd Sheely, Carried .
Cerveny moved and Peters 2nd that the 3rd reading be dispensed with,
and that Ordinance 174 be read with title only. Carried . Ordinance 174
read by Title only for third tim. Motion to approve Cerveny, 2nd Peters .
Carried . Mayor Nading declared Ordinance 174 passed and in effect as
per publication requirements .
Motion Cerveny, 2nd Bullock the City Clerk was given permission to
attend the IMFOA Meeting in Des Moines April 22 , 23 & 24 . Carried .
Motion Peters , 2nd Bullock Maintenance Person given permission to
attend AWWA Meeting in Tres Moines April 23rd . Carried . Any further
j requests for attending meetings must have the meeting brochures , so
the Council will know what the meeting is for .
The 'telephone Company will be installing a new line along Railroad
Street, to accomodate the new 8-plex that will be constructed there .
Iowa Communications Network will be doing some laying of new fiber
optic cable systems per the State of Iowa .
The Clerk was instructed to send letters to some Citizens about
their junk vehicles , and farm animals kept within the City Limits ...
Kenny Selzer will be extending the Water Main along Railroad Street
to his new 8-plex .
Vernon Cerveny gave a report on the Fairfax Arbor Team Breakfast,
it was a hugh success . Vernon said may hands made it go so well .
The money will go to pay for the trees at the Library.
The Fire Chief said that a pager was lost , and wanted to know how to
handle the matter . The Council said that whoever looses a pager_ will
pay $50 . 00 the first lost and the full $250 . 00 deductible if a second
lost occurs . Motion by Cerveny, 2nd Peters , Carried .
Cerveny gave a Library report . The usage at the Library is way up
j from last year .
The City will again contract with Steelsmith Sanitation to do yard
waste pickups the Ist and 3rd Tuesdays of the Month, beginning in May .
If the weather gets warm before , we will move it up . Remember they must
be put in reusable containers , no plastic bags , cardboard boxes or paper
bags .
The Mayor is to set up a meeting with Mr . Mike Snider and Mr. John
Banes to see if they can come -up with a workable plan to clean up the
property along Railroad Street .
j The Council then went out to the Maintenance building to look around .
No further business the meeting was adjourned at 9 : 35 P . M. Motion Bullock

AN ORDINANCE AMENDING TITLE III - MENTAL AND PHYSICAL
HEALTH, CHAPTER 4 - SOLID WASTE CONTROL, ARTICLE 2 -
COLLECTION AND TRANSPORTATION, SECTION 3-4 . 0211 (1)
SCHEDULE OF FEES, OF THE CITY CODE OF FAIRFAX, IOWA
BE IT ORDAINED BY THE CITY COUNCIL OF FAIRFAX, IOWA.
Section 1. The purpose of this ordinance is to amend
Section 3-4. 0211 (1) Schedule of Fees of Title III - Mental
and Physical Health, Chapter 4, Solid Waste Control, Article
2, Collection and 'Transportation of the City Code of
Fairfax, Iowa.
Section 2 . Section 3-4 . 0211(1) Schedule of Fees of
Title III - Mental and Physical Health, Chapter 4, Solid
Waste Control, Article 2 , Collection and 'Transportation is
hereby amended by deleting section 3-4.0211(1) in its
entirety and substituting in lieu thereof the following:
"1. Schedule of fees. The fee. for solid waste
collection and disposal services from residential
premises shall be:
A. For each single family residence -$10.
B. For each dwelling unit of a multiple
family dwelling - $10. 11
Section 3 . All ordinances and parts of ordinances in
conflict hereof are hereby repealed.
Section 4 . Severability. If any section, provision or
part of this ordinance shall be adjudged invalid or
unconstitutional, such adjudication shall not affect the
validity of the ordinance as a whole or any section,
provision or part thereof not adjudged invalid or
unconstitutional..
Section 5. This ordinance shall be in full force and
effect from and after its passage, approval and publication
as provided by law.

- WATER RATES, SECTION 6-1. 0302 RATES AND SERVICE AND
SECTION 6-1.0304 (4) LATE PAYMENT PENALTY OF THE CITY
CODE OF FAIRFAX, IOWA
BE IT ORDAINED BY THE CITY COUNCIL OF FAIRFAX, IOWA.
Section 1. The purpose of this ordinance is to amend
Section 6-1. 0302 Rates and Service and Section 6-1. 0302 (4)
Late Payment Penalty of Title VI - Community Development and
Environment, Chapter 1 - Water Service, Article 3 - Water
Rates of the City Code of Fairfax, Iowa..
Section 2. Section 6-1. 0302 Rates and Service of Title
VI - Community Development and Environment, Chapter 1 -
Water Service, Article 3 - Water Rates of the City Code of
Fairfax, Iowa is hereby amended by deleting Section 6-1. 0302
in its entirety and substituting in lieu thereof the
following:
116-1. 0302 RATE'S AND SERVICE. Water service shall be
furnished at the following monthly rates within the
city:
1 to 3, 000 gallons - $4. 00 (minimum bill) .
3, 001 gallons and up - $2. 00 per thousand. "
Section 3 . Section 6-1. 0302 (4) Late. Payment Penalty of
Title VI - Community Development and Environment, Chapter 1
-Water Service, Article 3 - Water Rates of the City Code of
Fairfax, Iowa is hereby amended by deleting Section 6-
1.0302 (4) in its entirety and substituting in lieu thereof
the following:
114. Late Payment Penalty. Bills not paid by the 20th
of each billing period shall be considered delinquent
and a late penalty of two (2) dollars shall be
assessed. The late penalty shall be added to the next
month's bill. "'
section 4. All ordinances and parts of ordinances in 1
conflict hereof are hereby repealed.

to inform you that the only solution for
your driveway is "to put in a culvert . The
water has no where to go but acrols your drive .
golverts are the responsiblity of the Home
owner . We will be glad to work with you
in anyway we can , once the culvert is in
the ditches will he kept cleaned so the
water will flow freely .
