Regular Meeting of the Fairfax City Council was held Tuesday September 8, l 9"92,
Mayor Russell Nading presiding. Council Present: Cerveny, Peters, Quillin, Shealy,
Councilman Neuhaus arrived at 7:05p.m. .
Motion of Cerveny, 2nd Quillin to approve Agenda, minutes of previous meeting,
Budget and Financial Reports.
Maintenance report: The water mains that are looped will be flushed once a month,
dead end ones twice a month. Lud is to purchase a set of tools. Lud is to mow only
the flat ground with the new mower, that which was formally contracted out.
Motion of Quillin, 2nd Cerveny to approve the renewal of liquor license for
the Star Hotel, and the Beer permit for the Handi Mart. Carried.
-The following building permits were approved on a motion by Sheely, 2nd Neuhaus .
D. Merta, addition to storage building. J. Osborn, addition and deck on house. M. Karal,
addition to house. Carried.
Ordinance 175 - AMENDING TITLE III - MENTAL AND PHYSICAL HEALTH, CHAPTER 4 -
SOLID WASTE CONTROL, ARTICLE 2-COLLECTION AND 'TRANSPORTATION, SECTION 3-4.0211(1)
SCHEDULE OF FEES, OF THE CITY CODE OF FAIRFAX, IOWA. Motion of Cerveny, 2nd Quillin,
to approve on first reading. MC. Motion of Cerveny, 2nd Peters to suspend, 2nd and
third reading. MC, Motion of Peters, 2nd Cerveny to Approve Ordinance 175 on reading
by title only. MC. Mayor Nading declared Ordinance 1.75 adopted and in effect as per
publication requirement. MC.
Ordinance 176 - AMENDING TITLE III - MENTAL AND PHYSICAL HEALTH, CHAPTER 4 -
SOLID WASTE CONTROL, ARTICLE 1 - GENERAL PROVISIONS, SECTION 3-4.0109(1) , CONTAINER
SPECIFICATION, OF THE CITY CODE OF FAIRFAX, IOWA. Motion of Quillin, 2nd Cerveny,
to approve on first reading. MC. Motion, of Cerveny, 2nd Peters to suspend, 2nd and
3rd, reading. MC. Motion of Cerveny, 2nd Neuhaus to Approve Ordinance 176 on
2nd and 3rd reading by title only. M.C. Mayor Nading declared Ordinance 176 adopted
and in effect as per publication requirements . MC. .
Cerveny discussed the applications for Trees programs. They are hoping to get
more money to plant more trees in Fairfax.
The recycling Committee would like to thank the Fairfax Legion for the use of
the hall, furnishing pop, and all the volunteers that helped on Sunday August 23rd.
The sheriff's department will be watching for the speeding and reckless driving
on the north side of town.
Discussion was held on which streets would be better served if parking was
limited to just one side. Prairie Ave will be limited to parking on the North side
of the street. Burger Lane and Siepman will have No Parking on the West side- of the
street from November lst. to March 31st. , to keep the street open for snow plowing.
Motion by Neuhaus, 2nd by Cerveny, for Sheely to check to the streets. MC. The

The clerk was instructed to contact Glen Selzer to find out what they have done
at the Dairy Queen about securing grease traps.
Tom Hutchcroft was present and told the Council he thought the house would be

moved sometime the week of Sept. 14th.

Motion of Sheely, 2nd ]deters the Clerk given permission to attend the
Finance Officers meeting in Des Moines Octobgr 21-23. MC.
Discussion on the increasing taxes, the Mayor said all department will be asked
to hold the line on spending, and all budgets will remain the same next year or
may be cut. The clerk is to iTrate to Library board and let them know of this decision.
Motion of Quillin, 2nd Sheely to pay the bills presented. MC.
Congratulations to Mark and Judy Sheely on the birth of their new son.

AN ORDINANCE AMENDING TITLE III MENTAL AND PHYSICAL
HEALTH, CHAPTER 4 - SOLID WASTE CONTROL, ARTICLE 1 -
GENERAL PROVISIONS, SECTION 3-4. 0109 (1) , CONTAINER
SPECIFICATION, OF THE CITY CODE OF FAIRFAX, IOWA
BE IT ORDAINED BY THE CITY COUNCIL OF FAIRFAX, IOWA.
Section 1. The purpose of this ordinance is to amend
Section 3-4 . 0109(1) Container Specification of Title III -
Mental and Physical Health, Chapter 4, Solid Waste Control,
Article 1, General. Provisions of the City Code of Fairfax,
Iowa.
Section 2 . Section 3-4 . 0109 (1) Container Specification
of Title III - Mental and Physical Health, Chapter 4, Solid
Waste Control, Article 1, General Provisions is hereby amended
by deleting Section 3--4 . 0109 (1) in its entirety and
substituting in lieu thereof the following:
"l. Container Specification. Residential waste containers
shall be more than thirty-four (34) gallons in nominal
capacity; shall be leak proof, waterproof and fitted with a
fly tight lid which shall be kept in place except when
depositing or removing the contents thereof. They shall have
handles, bails or other suitable lifting devices or features
and be of a type originally manufactured for the storage of
residential wastes with tapered sides for easy emptying. They
shall be of light weight and sturdy construction with the
total weight of any individual container and contents not
exceeding forty (40) pounds. Galvanized metal containers,
rubber or fiberglass containers and plastic containers which
do not become brittle in cold weather may be used. Disposable
containers or other containers meeting the size and weight

limitations specified above and as approved by the city may
also be used. "
Section 3 . All ordinances and parts of ordinances in
conflict hereof are hereby repealed.
Section 4. Severability. If any section, provision or
part of this ordinance shall be adjudged invalid or
unconstitutional, such adjudication shall -not affect the
validity of the ordinance as a whole or any section, provision
or part thereof not adjudged invalid or unconstitutional.
Section 5. This ordinance shall be in full force and
effect from and after its passage, approval and publication
as provided by law.

Section 1. The purpose , of this ordinance is to amend
Section 3-4. 0211(1) Schedule of Fees of Title III - Mental
and Physical Health, Chapter 4 , Solid Waste Control, Article
2 , Collection and Transportation of the City Code of
Fairfax, Iowa.
Section 2 . Section 3-4 . 0211 (1) Schedule of Fees of
Title III - Mental and Physical Health, Chapter 4, Solid l
Waste Control, Article 2, Collection and Transportation is
hereby amended by deleting Section 3-4 .0211(1) in its
entirety and substituting in lieu thereof the following:
"1. Schedule of fees. The fee for solid waste
collection and disposal services from residential
premises shall be:
A. For each single family residence -$8.
B. For each dwelling unit of a multiple
family dwelling
C. A One Dollar ($1. 00) FAIR (Fairfax:
Active in Recycling) tag must be purchased
and attached to each waste container to be
collected.
Section 3 . All ordinances and parts of ordinances in
conflict hereof are hereby repealed.
