CITY OF FAIRFAX
The Fairfax City Council met on Tuesday June 8, 1993 at 7 : 00 p,m.
with Mayor Nading presiding. Council present Quillin, Cerveny,
Sheely, Peters and Neub.a-us .
Motion by Cerveny, 2nd Neuhaus to approve the Agenda, Minutes of
May meeting, Budget and Financial Reports .
Maintenance report : Cleanup day, a Thank you to all who helped
with Cleanup day. A total of 424 tires were taken to the landfill .
New mower blades were ordered and a new snow plow blade will be
ordered before winter .
Glen Meisner , Hall and Hall En9r . , walked around Fairfax and did
a sidewalk assessment . Motion of Cerveny, 2nd Peters , all property
owners with a sidewalk will receive a letter informing them of the
City Ordinance , and if their sidewalks are in need of repair . if
they are to be repaired, they will be given until October 31 , 1993 ,
to do the repairs , and then the City will have them replaced and
the owner will be charged for the repair,,:; . MC .
Pat Slater presented a proposal to change the Fireworks from July
4th, to Saturday July 3rd, Motion of Cerveny, 2nd Neuhaus the
Council agreed with the change if all of the parties agree to the
change < The City would be responsible for the sheriff ' s . MC with
one nay vote .
Motion of Sheely, 2nd Cerveny, the 'Fire Department given
permission to close Linn Street , from Park to Fairfax Road, on
June 19th for a waterball fiqht . They may also use the dump truck.
The clerk will notify all residents of Linn Street . MC
Motion of Quillin, 2nd Peters David Cawthorne will be allowed to
cut the curb to run a drain line from his house to the street . MC
K. Selzer requested that the Council review the Garage built at
422 Vanderbilt St. Motion of Sheely, 2nd Quillin -the Clerk will
contact the City Attorney to check into this matter , MC
Motion of Quillin, 2nd Sheely, Mark Neuhaus will trim the street
contract down to stay within the budget . MC.
Motion of Neuhaus ,, 2nd Cerveny to incorporate the City Attorneys
opinion into the Cox Cable Franchise . MC
Discussion on the following items : The city Newsletter , Park on
Front Street , moving some gravel on Railroad St. , contacting Fisher
Excavating about Linn Street Storm Sewer Ditch, straighten the ties
at the. end of Park street, possible street light on. Quarry Drive
and Park St .
Mr . Thomas wanted 'to know why the City property at the end of
Burger Lane had not been mowed, when be was instructed to remove
his personal property so we could mow its Mr . Podzimek also
requested that the maintenance man pick up the brush he cut down
along Fairfax Road Ditch and then left it 'there .
Neuhaus made the suggestion that some kind of recognition be
given to the Volunteer Fireman who have been with the Department
for a number of years.
Motion of Nehuaus , 2nd Sheely to pay bills presented. MC
Motion of Cerveny, 2nd Peters to adjourn at 9 : 35 pm MC

N Re : Sidewalk Survey

I made a preliminary survey of the sidewalks in Fairfax at the
N direction of Betty Panek, Fairfax City Clerk on Thursday, June 3 ,
1993 . The survey was made prior to having the updated Sidewalk.

V I am enclosing a copy of the Sidewalk Regulation for Fairfax
E together with a map showing the location of existing sidewalks
Iand problem areas that I thought needed attention based on the
N visual inspection. A copy of each is enclosed for each of you
G and the City Clerk.
I am planning on attending the Council Meeting on Tuesday, June
P 8 , 1993 to discuss this project and the exact direction the
A Council wants to proceed .

N I have read the current Sidewalk Regulation and would like to
I reiterate some of the critical areas of the regulation:

8-2 , 01 Purpose
A. Enhance safe
A passage by citizens on sidewalks .
N B. Place the responsibility for the maintenance , repair,
S replacement or reconstruction of sidewalks upon the
5 abutting property owner.

A 8-2 . 02 Definitions
0 A. Each of you should become very familiar and feel
. H comfortable with the definition of "Defective Sidewalk"

8--2 . 04 Responsibility of Maintenance
T
R The regulation clearly states that the responsibility of the
E sidewalk belongs to the abutting property owner .
8-2 . 06 City May Order Repairs
The City of Fairfax has the right to order repairs by
serving notice by certified mail .
8-2 . 07 Sidewalk Construction Ordered
A. The City of Fairfax may order sidewalks to be repaired
or placed on any street .
B. I interpret the ordinance to say that sidewalks
generally are not required in Fairfax.
C. A majority of the abutting property owners may petition
the City to place sidewalks through an assessment
project.
D. A 75% vote of all members of the Council is required to
order an assessment project if not petitioned by a
majority of the adjoining property owners.
8-2 . 10 Sidewalk Standards
A. The Council should become familiar with the current
standards.
B. Some of the defective sidewalks are a result of the
following Standards .
1 . Cement (Portland Cement) - a number of the
sidewalks have been covered with asphalt or seal
coat. The City Hall property is the most
noticeable.
2 . Width - There are a number of sidewalks that are
only 2 and 3 feet wide.
3 . Thickness - the regulation requires a 6" thickness
at driveways . Many of the failures of sidewalks
have occurred in the location of the driveways...
4 . Elevation -- a large share of the sidewalks are
unusable because they are too low. The sidewalks
have become covered with dirt & debris .
In summary I feel that definite repairs need to be completed on
the existing sidewalks. I feel that we need to agree on the
exact criteria before I spend too much time with a final survey
and report .
I would like to compliment the Mayor, Council and Clerk for
initiating this necessary project. I am looking forward to
discussing this with you on Tuesday night .
