The regular meeting of the Fairfax City Council met on Tuesday
July 13th. Mayor Nading presiding. Council present : Quillin,
Cerveny, Neuhaus and Sheely. Absent , Peters . Citizens in attendance

Meyer , Ray Mizner, Virginia Soukup, Dick Zenisek, Mr . & Mrs . K.

Motion of Neuhaus, 2nd Sheely to approve the Agenda, as posted,
Minutes of previous minutes , Budget and Financial reports . MC.
Maintenance reports : Water Tower Cleaned, Citizens requested not
to dump their grass clippings down along Front St . Motion of
Cerveny, 2nd Sheely to .contact DOT and put NO THRU TRUCK TRAFF'I'C
signs along Lefebure Road and Wright. Bras . Blvd. MC
Motion of Cerveny, 2nd Sheely to approve the Sheriff ' s contract
for the 93-94 F/Y . for 20 hours per week. MC.
Re : Brophy' s garage at 422 Vanderbilt St . Motion of Neuhaus , 2nd
Cerveny the City will get three bids on moving their garage to meet
the City Code . MC. 'The Brophy' s are willing to do whatever is
necessary as long as the City pays for the changes .
WATER PROBLEMS from heavy rains : Citizens expressed their
concerns about the problems with the Sanitary Sewer when the heavy
rains fell. The City will check on cleaning the ditches and the
citizens should clean their culverts so that the water will flow
freely. Motion of Cerveny, 2nd. Sheely to contact the City Engineer
and have him do a survey as to what ditches need to be clean and
anything further that might help. The problem at the Quarry must
start with the owners of the Quarry and the property owner . Mr .. &
Mrs. Philipp were requesting permission to put a line under Front
St . to help as an overflow to drain the Quarry. Dick 2enisek
expressed some ideas that might help his problem. A storm sewer
from Church St . connecting to the one in front of Hastings home on
Vanderbilt. The possibility of running a tube through the Ball park
to drain into the storm sewer along Linn st . improving the Alarm
system. Mrs , Collingwood blamed the City for her problems , but the
Mayor walked her yard and she has a low yard and the water settles
there .
Motion of Sheely, 2nd Quillin the Clerk will send a letter to the
Star Hotel & Livery about the complaints received about the noise ,
and the patrons drinking in the street after the bar closes . A
letter will also be sent to the Sheriff I' s department requesting
that they check randomly for the bar staying open after hours and
under age drinking. MC. The Complaints were received from Mr. &
Mrs. Davis and Mr . & Mrs. Brophy.
Motion of Neuhaus,, 2nd Sheely, to approve the Cigarette pemits
for the Handi Mart and Star Hotel and Livery. MC .
Motion of Cerveny, 2nd Quillin Resolution 71393 - CHANGING THE
TERMS OF CITY OFFICERS :FROM CURRENT iTWO YEAR TERMS TO STAGGERED
FOUR YEAR TERMS - be approved. MC .
Motion of Sheely, 2nd Neuhaus to approve the building permit for
Kevin Costigan for a new home on Front St . MC,
Motion of Quillin, 2nd Cerveny to purchase a new copy machine for
the City. MC.
The Clerk will send out the letters on the sidewalks and set a
public hearing.
Randy Vittetoe was appointed to the Library Board.
Kathy Bullock wanted to express her appreciation for the
Independence Day Celebration, a big Thank you goes to Pat Slater
for all his work. The Mayor also thanked all of the volunteers who
worked long hours during the heavy rains .
Motion of Quillin, 2nd Sheely to approve the bills presented. MC

TO THE FAIRFAX CITY COUNCIL:
BURN BARRELS_ should be outlawed in this town! This wasn't going on twenty years
ago when we moved to this gown. The only way you can get a breath of fresh air now is
to go into Cedar Rapids.
There are many older, retired people in this town with respiratory and heart
problems. If you people don't care about your own health at least care about your
children and their children's children!
Your recycling idea was great} but your dollar a bag for garbage is a rip-off'l
We are already being ripped-off as it is, for water and sewage fees.
People should have been able to vote for that stupid library you're trying to
pay off, you would have found out that most people were against it. You Assholes gust
wanted your names on plaques !
The Linn County Health ]department has been informed about your toxic air poll-
ution. I will go to the FPA if I have too! If that doesn' t work I will take the law
into my own hands and dispoSe of every burn barrel in this two-bit biggtty townl

Mr. Mayor and City Council,
I'm writing in regards to the Star Tavern. When we purchased
our home back in October we asked about the Clientele at
the tavern. Mainly if there were any all night paries,
disturbances, loud music or rowdy people. We were told
by the owners of the house along with other townspeople
that it was a quite place. WELL.... ..WRONG;;
There is loud-very ]Loud music, yelling and screaming in
the bar and on the street, cars racing up and down the
street, loud motorcycles, MASS amounts of beer cans and
bottles long with garbage on the parking and in our yard.
We also have people park in our driveway blocking our
garage all hours of the night. I work nights and I can't
get into the garage because of this. Peoples also drive up
through our driveway down over the culvert and the down into
the parking to park in the last smallest parking spot.
Along with the Davis' and The Greens we would like this
STOPPED! !

We were told down at City Hall to call the sheriff when
ever any of the above things happen or when ever there is a
problem. Well, we feel that the sheriff has more import-
ant things to do and take care of. There are people who
really need the sheriff. This is a residential area and
it should be treated that way.
We would also like a sign put by our property, on one of the
corners stating that this area has "Children at Play". There
are several children us the sidewalks to ride bikes on and
to play on. I feel people should be aware of this and to
watch for these children. Both the people who use the bar
and those who use the Post Office need to remember this.

RESOLUTION CHANGING THE TERMS OF CITY OFFICERS FROM CURRENT TWO YEAR
TERMS TO STAGGERED FOUR YEAR TERMS.
BE IT RESOLVED, by the City Council of Fairfax, Iowa:
That the terms of the Fairfax City Council be changed from the
current two (2) year terms to staggered four (4) year terms, and
that said resolution be placed on the September School Election.
PASSED AND APPROVED ON JULY 13, 1993.
