The Fairfax City Council met in regular :session Tuesday August
110y 1993 , at 7 : 00 p.m. in City Hall , Mayor Protem, Cerveny
presiding, Councilmen bers present Neuhaus and Sheely. Absent : Mayor
Nading, Councilmembers, Peters and Quillin. Approximately forty
citizens in attendance.
Motion of Neuhaus to approve the agenda, minutes of the July
Council Meeting and the Public Hearing, Budget and Financial
reports . MC .
Maintenance reports . Mowing bids were tabled , Dusil will come in
,and flush all the hydrants in town next week.
A special Thank you to all the volunteer Firemen who have helped
out when the city has received all the rains , without their help a
lot of people would have had water in their homes .
Motion of Neuhaus , 2nd Sheely to approve Resolution 81093 -

Motion of Sheely, 2nd Neuhaus to approve appointment of Wiiiiam
Barry and Larry Schrader to the Fairfax Fire Department . MC
Motion of Sheely, 2nd Neuhaus to approve appointment of Randy
Vittetoe to the Library Board. MC
The Building permits of Rosemary Rosdail - Garage and Scott
Joens - Deck approved on motion of Sheely, 2nd Neuhaus .
Motion of Cerveny, 2nd Sheely to release the easment under the
garage at 707 Church St . The City Attorney will write up the
release . MC
Motion Cerveny, 2nd Neuhaus to release the license from the C&NW
,along the tracks so Joe & Beth Smith may purchase the property from
the railroad . The building permit for a deck was tabled until the
final sale of the land . MC
The Sheriff ' s department took any complaints . There is some
:concern about eggs being put in mailboxes .
Regarding the pipe under Front Street from quarry to Prairie
Creek, Clerk will contact city engineer to get someone out to do
the bore tests to determine whether a pipe could be put in. The
city Attorney will contact the home owners attorney to discuss this
situation.
The sidewalk issue was brought up - the attorney will give his
opinion on letting the property owners on Vanderbilt , North of the
railroad tracks remove their sidewalks , build up and reseed. The
attorney will also check into a Grandfather Clause to allow smaller
walks than what. the code calls for . Motion Cerveny, 2nd Neuhaus to
rescind the October 31 , 1.993 deadline and extend to August 1994 .
Residents of East Southview Road wanted some help on the
problems they are having with heavy rains , and the water runoff in
their yards . The clerk will check when the Linn Co , Board of
Supervisors meet and where the Citys responsibilities lie .
Motion of Sheely, 2nd Neuhaus to accept the resignation of the
Deputy City Clerk. MC No new deputy will be appointed at this time ,
The City clerks office will be closed August 16 - 22 .
Laurie Hawks presented her plans for the new City Park on Front
Street .
Motion of Cerveny, 2nd Sheely to pay the Firemen who help out

VACATION AND RELEASE OF SANITARY SEWER EASEMENT
The City of :Fairfax, Iowa, pursuant to a Resolution
passed on August 10,, 1993 , vacates and releases a sanitary
sewer easement on the following described real estate only:
"The north twenty-six and one-half (26 1/2) feet of
the south one hundred seventy (170) feet (except the
west three (3) feet thereof) of the west seventy-
five (75) feet of Lot 40, Giddings Addition to
Vanderbilt, Iowa" .

WHEREAS, the City of Fairfax, Iowa, desires to vacate and
release a portion of a sanitary sewer easement on property
located at 707 Church Street, Fairfax, Iowa and described on
the attached Exhibit Al now therefore be it resolved by the
City Council of Fairfax, Iowa as follows:.
That the sanitary sewer easement held by the City of
Fairfax, Iowa shall be vacated and released upon the following

S I reviewed a few streets in Fairfax, Iowa on July 20 , 1993
U concerning possible ditching adjacent to the existing streets . I
R concluded that the City of Fairfax should address the problem-

E streets by setting priorities . Each year the City should select
Y a few streets to improve by ditching . The City should establish
ditch elevations , remove all driveway pipes , grade the ditch and
re-install the driveway pipes or place new pipes . I have heard
that the owner is responsible for the pipe ..
P The intent of having me look at the ditching of the streets was
L to determine which streets to ditch. The existing culverts are
A
N at such varied elevations ( a downstream culvert higher than an
N upstream culvert ) that I felt that the City would be spending
N money and possibly creating problems (water pockets ) .

In summary I feel that the City should initiate a program for
L ditching in Fairfax and do a priority section at a time .

S I met with Ed Phillips on July 27 , 1993 concerning storm water on
U the Quarry Area in Fairfax, Iowa. I feel that it is possible to

V place a drainage pipe under South Front Street. My main concern
E would be encountering rock during boring the pipe under South
Y Front Street.
C 1 recommended to you to obtain soil borings and you told me to
proceed. The contractors are busy and I have found it difficult.

Dear Russ:
Nan and I appreciated the opportunity to air our conplaints
about the Star Bar . We were both disappointed that the bar
owner chose not to attend the meeting. We very much wanted
the owner to hear first hand our problems with the establish-
ment. We have to assume that the owner and its operator evi-
dently lack any consideration for their neighbors . This was
clearly demonstrated by ignoring the invitation to attend the
Council meeting where complaints were to be discussed. We
were also suprised to find that ours was the only letter of
complaint.
I read the Fairfax Council meeting report in the Gazette Sat-
urday and want to clarify that our complaints involved the late
night noise and behavior of the patrons only. The reference to
serving minors and after hours service was not part of our com-
plaint .
Thank you and the Council for your concern and help to try to
solve our problem. time would like to have copies of the letters
you send to the bar owner and the Sheriff.

Mayor Nading,
It is with respect that I submit my resignation effective Aug 1 .
I have really enjoyed my job, and have learfied much about how water
works are billed and run. Approximately 2 years ago, this job was
done manually and required anywhere from 20-30 hours per month. With
the recent purchase of the computer, the work load is much lighter and
only takes up 2 hours a month. I just feel like the position that I was
hired for is now obsolete. Mather than be "let go", I have chosen to
save 'the city thb embarrasing realization that I have worked this job
for a year now, and I really haven't been needed. Understand that I
mean no disrespect. I am only being frank and honest. I look forward
to the day when I will be able to serve the city in some other capacity.
