Meeting of the Fairfax City Council was called to order by Mayor
Pro Tem Cerveny, Tuesday October 12 , 1993. at 7 : 00 p.m. Council
members present , Peters, Neuhaus , Quillin and Sheely.
Motion of Quillin, 2nd Sheely to approve the Agenda, Minutes of
previous meeting, Budget and Financial Reports . MC.
Motion of Peters, 2nd Quillin for Maintenance Man to attend Iowa
Water Pollution Control Meeting on October 27th. MC
Motion of Quillin, 2nd Sheely the clerk will check on how soon
the City would be able to hold a Cable Franchise Election with Cox
Cable . MC.
No report from the Sheriff ' s department.
Building permits for Joe Smith, a Garage, and Rick Kruse , Deck,
were approved on a motion by Quillin, 2nd. Peters . MC.
Mary Ann Peters gave a report on the Linn County Solid Waste
Meeting.
Motion of Peters,, 2nd Sheely, the city 'will put in place a voice
mail on the City Hall Telephone . MC.
Ordinance 181 -- GIFTS TO PUBLIC OFFICIALS , PUBLIC EMPLOYEES OR
CANDIDATES - was presented and read the first time. Cerveny moved
the approval of the Ordinance on its first reading and that the
procedural requirements as set forth in Iowa Code be suspended, and
that the ordinance be placed on its second and third readings by
Title only. 2nd Neuhaus . MC. Ordinance 181 was then read the second
and third times by its title . Sheely moved the adoption of the
Ordinance as read. 2nd Peters . MC. Mayor Protem Cerveny declared
Ordinance 181 adopted and in effect as per publication
requirements .
Ordinance 182 - LIQUOR LICENSES, WINE AND BEER PERMITS - was
presented and read the first time . Cerveny moved the approval of
the Ordinance on its first reading and that the procedural
requirements as set forth in Iowa Code be suspended, and that the
ordinance be placed on its second and third readings by Title only.
2nd Neuhaus . MC. Ordinance 182 was then read the second and third
times by its title . Sheely moved the adoption of the Ordinance as
read. 2nd Peters. MC. Mayor Protem Cerveny declared Ordinance 182
adopted and in effect as per publication requirements .
Ordinance 183 _.. ALCOHOL CONSUMPTION AND INTOXICATION - was
presented and read the first time . Cerveny moved the approval of
the Ordinance on its first reading and that the procedural
requirements as set forth in Iowa Code be suspended, and that the
ordinance be placed on its second and third readings by Title only.
2nd Neuhaus. MC. Ordinance 183 was then read the second and third
times by its title . Sheely moved the adoption of the Ordinance as
read. 2nd Peters. MC. Mayor Protem Cerveny declared Ordinance 183
adopted and in effect as per publication requirements .
Motion Neuhaus, 2nd Peters to pay the two Volunteer Firemen for
Flood Work. MC .
Motion of Peters, 2nd Quillin to purchase the service agreement
on the new copier. MC.
Motion of Neuhaus, 2nd Peters to remind Banes Construction of
their promise to f'ix the drainage problems around their building.

A reply is requested. Mark Sheely will talk with Mr . Banes .
The Clerk will Contact Jerry Nelson, County Engineer , and find
out why they did not clean all of Southview Road ditch. Also to
write a letter to the Board of Supervisors and get something done
before the Spring rains.
Work Orders will be done for all that remains on the list of
things to do, and 'dud will write down how much time it takes to do
the orders .
Starting immediately the Maintenance personnel will start
alternating working on the Holidays so that one person is not
working all the Holidays .
The Fire Department repaired the Hose 'Tower Roof .
Mark Neuhaus and Mark Sheely will form a committee to formulate
a new working schedule for the maintenance department.
Motion of Neuhaus, 2nd Peters to pay bills presented. MC.

TO THE FAIRFAX CITY COUNCIL:
!
As of December 1991, 1 have worked parttime for the City of Fairfax.
From this time I have fixed and made numerous things for the City, plus
filling in on weekends and holidays. Lately -1 have been scheduled for
every Holiday, until now I have said nothing, but to be fair I would
Like to see alternating Holidays scheduled.
Also, since I have been filling in and repairing 11quipment, flushing
I
fire hydrants regulary, and since I have been with the City for about
i
two (2) years, I would like some kind of health insurance compensation.
In the past I have scheduled my work around the City, but to continue
to do this for $7.50 an hour with no benefits, such as insurance. I may j
have to re-consider my work schedule.

Codification Services pertaining to liquor licenses and wine
and beer permits; and gifts to public officials, public
employees or candidates. The proposed ordinances appear to
be in order and in effect adopt the Iowa. Code provisions in
these areas. This 'should cut down on the annual expense of
updating the city code in these areas since they are
frequently amended by the Iowa Legislature. Please send us
copies for our code book after they are adopted and you
receive the update from the Codification Service.
Did you request an update from the Codification Service
regarding handicapped parking as we suggested? Please advise.

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY
OF FAIRFAX, IOWA, 1989 , BY AMENDING PROVISIONS
PERTAINING TO GIFTS TO PUBLIC OFFICIALS , PUBLIC
EMPLOYEES OR CANDIDATES
Be It Enacted by the City Council of the City of Fairfax,
Iowa:
SECTION 1 . SECTION MODIFIED. Title I , Chapter 1 , Article 2,
Sections 13 , 14 and 15 of the Code of Ordinances of the City of
Fairfax, Iowa, 1989 , are repealed and the following adopted in
lieu thereof:
1-1 . 0213 GIFTS . Except as otherwise provided in
Chapter 68B of the Code of Iowa, a public official,
public employee or candidate, or that person' s immediate
family member, shall not, directly or indirectly, accept
or receive any gift or series of gifts from a
"restricted donor" as defined in Chapter 68B and a
restricted donor shall not, directly, or indirectly,
individually or jointly with one or more other
restricted donors, offer or make a gift or a series of
gifts to a public official, public employee or can-
didate.

SECTION 2 . SEVERABILITY CLAUSE. If any section, provision
or part of this ordinance shall be adjudged invalid or
unconstitutional, such adjudication shall not affect the validity
of the ordinance as a whole or any section, provision or part
thereof not adjudged invalid or unconstitutional .
SECTION 3 . WHEN EFFECTIVE. This ordinance shall be in
effect from and after its final passage, approval and publication
as provided by law.

BE IT ENACTED by the City Council of the City of Fairfax,
Iowa:
SECTION 1 . ARTICLE MODIFIED. Title II, Division 1 , Chapter
3, Article 2, of the Code of Ordinances of the City of Fairfax,
Iowa, 1989 , is repealed and the following adopted in lieu
thereof:
ARTICLE 2
LIQUOR LICENSES AND WINE AND BEER PERMITS
2. 1-3 .0201 LICENSE OR PERMIT REQUIRED. No person shall
manufacture for sale, import, sell, or offer or keep for sale,,
alcoholic liquor, wine, or beer without first securing a liquor
control license, wine permit or beer permit in accordance with
the provisions of Chapter 123 of the Code of Iowa.

2.1-3 .0202 GENERAL PROHIBITION. It is unlawful to manufacture
for sale, sell, offer or keep for sale, possess or transport
alcoholic liquor, wine or beer except upon the terms , conditions,
limitations and restrictions enumerated in Chapter 123 of the
Code of Iowa, and a license or permit may be suspended or revoked
for a violation thereof.

2. 1-3 . 0203 INVESTIGATION. Upon receipt of an application for a
liquor license, wine or beer permit by the Clerk, it shall be
forwarded to the Police Chief, who shall conduct an investigation
and submit a written report as to the truth of the facts averred.
in the application and a recommendation to the Council as to the
approval of the license or permit. It is the duty of the Fire
Chief to inspect the premises to determine if they conform to the
requirements of the City, and no license or permit shall be
approved until or unless an approving report has been filed with
the Council by such officers .

2.1-3 . 0204 ACTION BY COUNCIL. The Council shall either approve
or disapprove an application. Action taken by the Council shall
be so endorsed on the application and thereafter the application,
necessary fee and bond, if required, shall be forwarded to the
Alcoholic Beverages Division of the State Department of Commerce
for such further action as is provided by law.

2. 1-3 . 0205 PROHIBITED SALES AND ACTS. A person or club holding
a liquor license or retail wine or beer permit and the person' s
or club' s agents or employees shall not do any of the following:
1 . Sell, dispense or give to any intoxicated person, or one
simulating intoxication, any alcoholic liquor, wine or beer.
(Code of Iowa, Sec. 123.49 [1] )
2 . Sell or dispense any alcoholic beverage, wine or beer on
the premises covered by the license or permit, or permit its
consumption thereon between the hours of two o' clock ( 2 : 00 )
a.m. and six o ' clock ( 6 : 00) a.m. on a weekday, and between
the hours of two o'clock ( 2 : 00 ) a.m. on Sunday and six.
o' clock ( 6 : 00 ) a.m. on the following Monday; however, a
holder of a license or permit granted the privilege of
selling alcoholic liquor, beer or wine on Sunday may sell or
dispense alcoholic liquor, beer or wine between the hours of
eight o' clock (8 :00) a.m. on Sunday and two o' clock ( 2 : 00)
a.m. of the following Monday, and further provided that a
holder of any class of liquor control license or the holder
of a class "B" beer permit may sell or dispense alcoholic
liquor, wine or beer for consumption on the premises between
the hours of eight o' clock ( 8 : 00) a.m. on Sunday and two
o' clock ( 2 :00 ) a.m. on Monday when that Monday is New Year' s
Day and beer for consumption off the premises between the
hours of eight o 'clock ( 8 : 00 ) a.m. on Sunday and two o ' clock
( 2 : 00 ) a.m. on the following Monday when that Sunday is the
day before New Year' s Day.

3 . Sell alcoholic beverages, wine or, beer to any person on
credit, except with bona fide credit card. This provision
does not apply to sales by a club to its members nor to sales
by a hotel or motel to bona fide registered guests .

4 . Employ a person under eighteen (1.8) years of age in the
sale or serving of alcoholic liquor, wine or beer for
consumption on the premises where sold.

5 . Sell, give or otherwise supply any alcoholic beverage,,
wine or beer to any person, knowing or having reasonable
cause to believe the person to be under legal age, or permit
any person, knowing or having reasonable cause to believe the
person to be under legal age, to consume any alcoholic
beverage, wine or beer.

6 . In the case of a retail beer or wine permittee,
knowingly allow the mixing or adding of alcohol or any,
alcoholic beverage to beer, wine or any other beverage in or
about the permittee" s place of business

7 . Knowingly permit any gambling, except in accordance with
Iowa law, or knowingly permit any solicitation for immoral
purposes, or immoral or disorderly conduct on the premises
covered by the license or permit.

8 . Knowingly permit or engage in any criminal activity on
the premises covered by the license or permit.
(Code of Iowa, Sec. 123 .49 [2j ]
9 . Keep on premises covered by a liquor control license any
alcoholic liquor in any container except the original package
purchased from the Alcoholic Beverages Division of the State
Department of Commerce and except mixed drinks or cocktails
mixed on the premises for immediate consumption.

10 . Reuse for packaging alcoholic liquor or wine any
container or receptacle used originally for packaging
alcoholic liquor or wine; or adulterate, by the addition of
any substance, the contents or remaining contents of an
original package of an alcoholic liquor or wine; or knowingly
possess any original package which has been reused or
adulterated .

11 . Allow any person other than the licensee, permittee or
employees of the licensee or permittee to use or keep on the
licensed premises any alcoholic liquor in any bottle or other
container which is designed for the transporting of such
beverages, except as allowed by State law.

12 . Permit or allow any person under legal age to remain
upon licensed premises unless over fifty percent ( 50% ) of the
dollar volume of the business establishment comes from the
sale and serving of prepared foods . This provision does not
apply to holders of a class "C" beer permit only.

ALCOHOL CONSUMPTION AND INTOXICATION
BE IT ENACTED by the City Council of the City of Fairfax,,
Iowa:
SECTION 1 . ARTICLE MODIFIED. Title I[I, Division 1 , Chapter
3 , Article 1 , of the Code of Ordinances of the City of Fairfax,
Iowa, 1989 , is repealed and the following adopted in lieu
thereof:
ARTICLE 1
ALCOHOL CONSUMPTION AND INTOXICATION
2. 1-3 . 0101 PERSONS UNDER THE AGE OF EIGHTEEN. A person shall
not sell, give, or otherwise supply alcoholic liquor, wine or
beer to any person knowing or having reasonable cause to believe
that person to be under the age of eighteen ( 18) , and a person or
persons under the age of eighteen shall not individually or
jointly have alcoholic Liquor, wine or beer in their possession
or control; except in the case of liquor, wine or beer given or
dispensed to a person under the age of eighteen within a private
home and with the knowledge and consent of the parent or guardian
for beverage or medicinal purposes or as administered to the
person by either a physician or dentist for medicinal purposes
and except to the extent that a person under the age of eighteen
may handle alcoholic beverages , wine, and beer during the regular
course of the person' s employment by a liquor control licensee,,
or wine or beer permittee under State laws .

2.1-3 . 0102 PERSONS AGE EIGHTEEN, NINETEEN' AND TWENTY. A person
shall not sell, give or otherwise supply alcoholic liquor, wine
or beer to any person knowing or having reasonable cause to
believe that the person is age eighteen (18 ) , nineteen ( 19 ) or
twenty ( 20 ) . A person age eighteen, nineteen or twenty shall not
purchase or possess alcoholic liquor, wine or beer. However, a
person age eighteen, nineteen or twenty may possess alcoholic
liquor, wine or beer given to the person within a private home
with the knowledge and consent of the person' s parent or
guardian, and a person age eighteen, nineteen or twenty may
handle alcoholic liquor-, wine and beer during the course of the
person' s employment by a liquor control licensee or wine or beer
permittee.

2 . 1-3 . 0103 PUBLIC CONSUMPTION OR INTOXICATION.
1 . As used in this section unless the context otherwise
requires :
A. "Arrest"' means the same as defined in Section. 804. 8
of the Code of Iowa and includes taking into custody
pursuant to Section 232 . 19 of the Code of Iowa.
B. "Chemical testy' means a test of a person' s blood,
breath, or urine to determine the percentage of alcohol
present by a qualified person using devices and methods
approved by the Commissioner of Public Safety.
C. "Peace. Officer" means the same as defined in
Section 801 .4 of the Code of Iowa.
D. "School" means a public or private school or that
portion of a public or private school which provides
teaching for any grade from kindergarten through grade
twelve.
2 . A person shall not use or consume alcoholic liquor, wine
or beer upon the public streets or highways . A person shall
not use or consume alcoholic liquor in any public place,
except premises covered by a liquor control license. A
person shall not possess or consume alcoholic liquors, wine
or beer on public school property or while attending any
public or private school-related function. A person shall
not be intoxicated or simulate intoxication in a public
place. A person violating this subsection is guilty of a
simple misdemeanor.
3 . When a peace officer arrests a person on a charge of
public intoxication under this section, the peace officer
shall inform the person that the person may have a chemical
test administered at the person' s own expense. If a device
approved by the Commissioner of Public Safety for testing a
sample of a person' s breath to determine the person' s blood
alcohol concentration is available, that is the only test
that need be offered the person arrested . In a prosecution
for public intoxication, evidence of the results of a
chemical test performed under this subsection is admissible
upon proof of a proper foundation. The percentage of alcohol
present in a person' s blood, breath, or, urine established by
the results of a chemical test performed within two hours
after the person's arrest on a charge of public intoxication
is presumed to be the percentage of alcohol present at the
time of arrest.

2 . 1-3 . 0104 OPEN CONTAINER ON STREETS AND HIGHWAYS . A person
driving a motor vehicle shall not knowingly possess in a motor
vehicle upon a public street or highway an open or unsealed
bottle, can, jar, or other receptacle containing an alcoholic
beverage, wine, or beer with the intent to consume the alcoholic
beverage, wine, or beer while the motor vehicle is upon a public
street or highway. Evidence that an open or unsealed receptacle
containing an alcoholic beverage or beer was found during an
authorized search in the glove compartment, utility compartment,.
console, front passenger seat, or any unlocked portable device.
and within the immediate reach of the driver while the motcr
vehicle is upon a public street or highway is evidence from which
the court or jury may infer that the driver intended to consume
the alcoholic beverage or beer whale upon the public street or
highway if the inference is supported by corroborative evidence.
However, an open or unsealed receptacle containing an alcoholic
beverage or beer may be transported at any time in the trunk of
the motor vehicle or in some other area of the interior of the
motor vehicle not designed or intended to be occupied by the
driver and not readily accessible to the driver while the motor
vehicle is in motion. A person convicted of a violation of this
paragraph is guilty of a simple misdemeanor.

SECTION 2 . SEVEHABILITY CLAUSE. If any section, provision
or part of this ordinance shall be adjudged invalid or unconsti-
tutional, such adjudication shall not affect the validity of the
ordinance as a whole or any section, provision or part thereof
not adjudged invalid or unconstitutional.
SECTION 3 . WHEN EFFECTIVE. This ordinance shall, be in
effect from and after its final passage, approval and publication
as provided by law.
