Fairfax City Council met on Tuesday November 9 , 1993 at 7 : 00 p. m.
Mayor Pro Tem Cerveny presiding, council members present - Neuhaus,
Peters , Quillin, and Sheely.
Guests in attendance - Mr . & Mrs . Svoboda, Dawn Neuhaus, Virginia
Soukup, Orville Smith, Brian Stallman, Allen Root, Russ Carver,
Bret Brophy, John Banes .
Motion of Quillin, 2nd Sheely to approve the Agenda, Minutes of
previous meeting, Budget and Financial Reports. MC.
Maintenance report given. Motion of Quillin, 2nd Peters to
contact Gongwer Tree Service to remove a tree on a City Rasment.
MC. Discussion on burning around town.
Sheriff ' s Department was reminded to issue tickets to illegally
parked vechicles.
Discussion was held on restructuring the workforce . A meeting is
scheduled for November 29th for further discussion.
ORDINANCE 184 - HANDICAPPED PARKING - was read and presented the
first time . Cerveny moved the approval of the Ordinance on its
first reading and that the procedural requirements as set forth in
Iowa Code be suspended, and that the Ordinance be placed on its
second and third readings by its title . 2nd Quillin. The Ordinance
was then read the second and third time by its title. Sheely moved
the adoption of the Ordinance as read 2nd. Neuhaus . MC. Mayor Pro
Tem Cerveny declared Ordinance 184 adopted and in effect as per
publication requirements,
Motion of Sheely, 2nd Neuhaus to approve RESOLUTION 11993
sumitting to the electors of Fairfax ORDINANCE 185 - granting to
Cox Cable a Franchise for Cable Service. MC. The special election
will be held on December 14 , 1993 .
Discussion held on parking of a trailer on a City Street .
John Banes, Banes Construction discussed the water runoff at his
building. Motion of Sheely, 2nd Neuhaus the city will install a new
culvert across Reynolds St . and run a ditch along Railroad St . to
connect to an existing ditch along the railroad tracks . MC.
Motion Sheely, 2nd Quillin to approve the bills . MC.

Re: Cox Cable Cedar Rapids, Inc. Ordinance
Dear Betty:
Pursuant to your request, we have prepared the enclosed
resolution and ordinance to grant Cox Cable Cedar Rapids,
Inc. , a cable TV franchise in the City of Fairfax. The
resolution will allow you to place the ordinance on the ballot
for approval. The ordinance itself should not be passed until
after the election. In addition, the city will need to reach
agreement with Cox Cable concerning an ordinance regulating
the Cox Cable television system within the city. This is the
ordinance which we previously reviewed and made suggested
revisions. I am attempting to contact Denis Martel at Cox
Cable to discuss the proposed ordinances.
We have also reviewed the cable rate certification
documents which you provided to us and which were prepared by
the city attorney for Ida Grove, Iowa. We want to discuss
the rate certification issue with Denis Martel. We have also
requested information from the National Association of Tele-
communications Officers and Advisors (NTOA) , referred to in
the news article which your forwarded to us. This is a very
complex area of regulatory law and we will need some time to
sift through the pros and cons of whether such an ordinance
is advisable.
If the council decides to pass the resolution, please
advise. You may keep the original ordinance to be signed if
it is approved after the election. We have attached a copy
of this ordinance to the resolution. If you have questions,
feel free to contact us.

RESOLUTION NO.
WHEREAS, the City of Fairfax, Iowa, desires to submit a
proposed Ordinance to the electors of the City of Fairfax,
Iowa, for consideration. The Ordinance, if approved, would
grant Cox Cable Cedar Rapids, Inc. , the non-exclusive right
and authority to construct, operate, maintain, repair,
replace, renew, reconstruct and remove a cable television
system across public property in the city limits of the City
of Fairfax, Iowa. The proposed Ordinance is attached hereto.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
Fairfax, Iowa, as follows: The attached Ordinance shall be
submitted to the electors of the City of Fairfax, Iowa, at an
election to be held at the City Hall, Fairfax, Linn County,
Iowa, on the date to be set, at which time the polls for
voting shall be open from 7 A.M. to 8 P.M.

AN ORDINANCE TO GRANT COX CABLE CEDAR
RAPIDS, INC. , A CORPORATION ORGANIZED AND
EXISTING UNDER THE LAWS OF THE STATE OF
IOWA, ITS SUCCESSORS AND ASSIGNS, THE
NON-EXCLUSIVE RIGHTS, PRIVILEGES AND
AUTHORI"1Y TO CONSTRUCT, OPERATE,
MAINTAIN, REPAIR, REPLACE, RENEW,
RECONSTRUCT AND REMOVE A CABLE TELEVISION
SYSTEM ACROSS PUBLIC PROPERTY IN THE CITY
OF FAIRFAX FOR A TERM OF F'IF'TEEN (15)
YEARS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FAIRFAX, LINN COUNTY, IOWA.
1 . Grant to Franchise. A non-exclusive right is
hereby granted to Cox Cable Cedar Rapids, Inc. , its
successors and assigns, to establish, construct, operate,
maintain, repair, replace, renew, reconstruct and remove a
cable television system across public property in the city
limits of Fairfax, Iowa, for a term of fifteen (15) years, in
accordance with the laws and regulations of the United States
of America and the State of Iowa and the ordinances and
regulations of the City of Fairfax, Iowa, including the non-
exclusive right, privilege and authority.
a. to sell and supply audio and video communication
service to persons with the City;
b. to use public property within the City;
C. to engage in such further activities within the
City as may now or hereinafter be consistent with
the generally accepted principles applicable to the
operation of a cable television system.
2 . Effective Date of Franchise. The franchise shall
become effective from and after the effective date of this
Ordinance and compliance by Cox Cable Cedar Rapids, Inc. ,
with Federal Communications Commission rules and regulations,
and regulating ordinances of the City of Fairfax, Iowa.
3 . Cox Cable Cedar Rapids, Inc. , shall not assign or
transfer any right granted under this Ordinance to any other
person, company or corporation without prior consent of the
Fairfax City Council, which consent shall not be unreasonably
withheld, provided that the company shall have the right to
assign the provisions of this Ordinance to a corporation to
be formed and controlled by it, without prior consent to the
City.
4 . If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held
invalid or unconstitutional by any Court of competent
jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not
affect the validity of the remaining portions hereof.
5. All Ordinances or parts thereof in conflict with
the terms of this Ordinance are hereby repealed, provided,
however, that such repeal shall only be to the extent of such
conflict.
This Ordinance shall be in full force and effect from
and after its adoption and approval by the electors, City of
Fairfax, Iowa, and its written acceptance by Cox Cable Cedar
Rapids, Inc.

Re: Handicap Parking Ordinance
Dear Betty:
We have reviewed the ordinance amending Section 2 . 1-
2 . 1007 Handicapped Parking, which was prepared by the
Codification service. This ordinance appears to be in order.
You should remember, that the Iowa Code provision concerning
handicapped parking signs was recently amended to require that
the sign include a statement that the fine for improperly
using the handicapped parking space is $50. Also, there is
a fine under the Iowa Code for failure to provide proper
handicapped parking spaces or to properly display handicapped
parking signs in the sum of $100 for each violation.
Further, the Iowa Code states that handicapped parking
spaces designated only by the international symbol of
accessibility being painted or otherwise placed horizontally
on the parking space does not meet the requirement of this
section. See Section 321L. 6 (2) of the Iowa Code. You should
also note that if any entity who owns or leases real property
in Fairfax is required to provide handicapped parking spaces,
the city upon request shall provide the signs for the entity
at cost. See Section '_321L. 6 (1) of the Iowa Code.

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY
OF FAIRFAX, IOWA,, 1989 , BY AMENDING PROVISIONS
PERTAINING TO ESTABLISHMENT AND USE OF HANDICAPPED
PARKING SPACES
Be It Enacted by the City Council of the City of Fairfax,
Iowa:
SECTION 1 . SECTION MODIFIED. Title II, Division 1 , Chapter
2, Article 10, Section 7, of the Code of Ordinances of the City
of Fairfax, Iowa, 1989, is repealed and the following adopted
in lieu thereof:
2. 1--2 . 1007 HANDICAPPED PARKING. The following regulations
shall apply to the establishment and use of handicapped parking
spaces :
1 . Nonresidential Off-street Facilities. Nonresi-
dential off-street parking facilities shall set aside
handicapped parking spaces in accordance with the
following:
A. Municipal off-street public parking facilities
or an entity providing nonresidential, parking in
off-street public parking facilities shall provide
not less than two percent (2% ) of the total parking
spaces in each parking facility as handicapped
parking spaces, rounded to the nearest whole number
of handicapped parking spaces. However, such
parking facilities having ten (10 ) or more parking
spaces shall set aside at least one handicapped
parking space.

B. An entity providing off-street nonresidential
public parking facilities shall review the utiliza-
tion of existing handicapped parking spaces for a
one-month period not less than once every twelve
months. If upon review, the average occupancy rate
for handicapped parking spaces in a facility
exceeds sixty percent ( 60%) during normal business
hours, the entity shall provide additional handi-
capped parking spaces as needed.

C. An entity providing off-street nonresidential
parking as a lessor shall provide a handicapped
parking space to an individual requesting to lease
a parking space, if that individual possesses a
permanent handicapped identification device issued
in accordance with Section 321L.2 of the Code of
Iowa.

D. A new nonresidential facility in which
construction has been completed on or after July 1 ,
1991 , providing parking to the general public shall
provide handicapped parking spaces as stipulated
below:

2 . Residential Buildings and Facilities. All public
and private buildings and facilities, temporary and
permanent, which are residences and which provide ten
( 10 ) or more tenant parking spaces, excluding extended
health care facilities, shall designate at least one
handicapped parking space as needed for each individual
dwelling unit in which a handicapped person resides .
Residential buildings and facilities which provide
public visitor parking of ten (10 ) or more spaces shall
designate handicapped parking spaces in the visitors
parking area in accordance with the table contained in
subsection (1 ) (D') of this section.

3 . Business District. With respect to any on-street
parking areas provided by the City within the business
district, not less than two percent ('2%) of the total
parking spaces within each business district shall be
designated as handicapped parking spaces.

4 . Other Spaces. Any other person may set aside
handicapped parking spaces on the person' s property
provided each parking space is clearly and prominently
designated as a handicapped parking space. No person
shall establish any on-street handicapped parking spaces
without first obtaining Council approval.

5 . Improper Use. The use of a handicapped parking
space, located on either public or private property, by
a motor vehicle not displaying a handicapped
identification device, displaying such a device but not
being used by a handicapped person, or in violation of
the rules adopted under Section 321L.8 of the Code of
Iowa, constitutes improper use of a handicapped
.identification device, which is a misdemeanor.

SECTION 2 . SEVERABILITY CLAUSE. If an;y section, provision
or part of this ordinance shall be adjudged invalid or
unconstitutional, such adjudication shall not affect the validity
of the ordinance as a whole or any section, provision or part
thereof not adjudged invalid or unconstitutional.
SECTION 3 . WHEN EFFECTIVE. This ordinance shall be in
effect from and after its final passage, approval and publication
as provided by law.

What's with it, with your so-called volunteer fire department? 90% of your fire-
fighters are alcholics. They spend most of their time in the Star Hotel. In my
opinion they are not very dependable. People like, Ken Barnell who gives CPR
classes. Check the record, most of his victims die. I certainly don't want any
of my family lives in his hands. He's a known child molester with a criminal rec-
ord as long as your arm in the state of California. Check it out and think twice
before he puts his hands on anyone else. He also does a lot of drugs and has spent
time in the St. Luke's mental ward. I can't believe that they would trust him with
a key to the department after all the cars he has stolen in his past, he frequently
brags about. All your firefighters should be checked out for alcohol and drug abuse
for their sakes, as well as ours. Get this man help or, get him out!
