Fairfax City Council met on Tuesday May 10 , 1994 at 7 : 00 P.M ,
Mayor Sheely presiding. Council present Shakespeare , Wainwright ,
and Neuhaus . Absent Stallman and Root .
Agenda, Minutes of previous meeting , Budget and Financial
Reoports were approved on a motion by Shakespeare , 2nd Neuhaus . MC ,
Maintenance report : Approve buying rip rap for the lagoon bank,
and to build a storage unit in City Hall .
Lee Naaktgeboren, Waterworks , requested the City to upgrade the
sidewalk in the alley by his business , and he will finish grading
the alley and put rock in it , The City will fix the sidewalk.
Motion of Shakespeare , 2nd Wainwright to allow Cox Construction
to slope the bank along the house at 516 Front Street onto the City
Park area, MC ,
Pat Slater presented the plans for the July 2nd celebration. He
requested permission to close Church St . in front of the Catholic
Church for a Ecumenical Service in conjuction with the celebration.
Motion by Shakespeare , 2nd Neuhaus to allow the street to be
closed . Also for the Celebration Committee to decide the route for
the Parade . MC . Motion by Wainwright , 2nd Shakespeare the city will
pay for three ( 3 ) Port.-O-Jonnys for the celebraton. MC.
Motion by Neuhaus, 2nd Wainwright to have Vavra Landscaping do
the spraying of the Ball diamonds and the park. MC
The Deputy Sheriff was requested to start checking the parking
along Stallman Dr . and watch for speeders in this area . Motion by
Neuhaus , 2nd Shakespeare to approve the Sheriff ' s contract for 94-
95 year . MC.
Request for building permit by Dwight Houck to build a deck at
318 Church, motion by Shakespeare , 2nd Neuhaus to approve the
permit . MC.
Ball diamond behind the school is to be used only for soft ball
or smaller little leagues . If anyone uses it and breaks the windows
in the school they will be held responsible . The Ball team will
take care of mowing the diamond areas and the City will take care
of mowing the outside areas and the ditches .
Mayor Sheely opened the public hearing on the Budget Amendment at
7 : 50 P . M. No objections the public hearing closed at 7 : 52 p. m.
Motion by Shakespeare , 2nd Wainwright RESOLUTION 51094 - Budget
Ammendment was approved.
The Cigarette permit for the Handi Mart was approved on a motion
by Shakespeare , 2nd Neuhaus . MC
Street Lighting Resolution , to install a floodlight on the pole
by the Concession stand, and a smaller street light , approved on a
motion by Shakespeare , 2nd Neuhaus , MC .
Motion by Neuhaus , 2nd Shakespeare to approve ORDINANCE 187
AMENDING ALL NIGHT PARKING, AND SNOW REMOVAL , MC . Shakespeare moved
the approval of Ordinance 187 on its first reading and that the
requirements as setforth in section 380 . 3 , Code of Iowa , be
suspended as provided for in that section, and that Ordinance 187
be placed on its second and third readings by Title only . 2nd

The Council of the City of FAIRFAX in said county (counties) met on
May 10 199 , at the place and hour set in the notice„ a copy of which accompanies this certificate
and is certified as to publication, Upon taking up the proposed amendment, it was considered and taxpayers were heard for
and against the amendment.
The Council, after hearing all taxpayers wishing to be heard and considering the statements made by them„ gave
final consideration to the proposed amendlment(s) to the budget and modifications proposed at the hearing, if any, There-

Water Meter Deposits for rental properties , and have ready for the
June Council meeting.
The City Clerk given permission to attend. Continuing Education in
Ames in July, motion by Wainwright , 2nd Shakespeare . MC .
Motion by Neuhaus , 2nd Shakespeare to approve the bills presented
for payment.. MC .
Bud Burger requested the City to have IES install a street light.
at the end of Main Street near B&E Apts . uniforms will be ordered
from CTS .

AN ORDINANCE AMENDING TITLE II - COMMUNITY
PROTECTION , DIVISION I - LAW ENFORCEMENT
CHAPTER 2 TRAFFIC CODE , ARTICLE 10 -
PARKING REGULATIONS , SECTION 2 . 1-2 . 1009 ,
ALL NIGHT PARKING PROHIBITED , AND SECTION 2 . 1-2 . 1010
SNOW REMOVAL . , OF THE CITY CODE OF FAIRFAX , IOWA
BE IT ORDAINED BY THE CITY COUNCIL OF FAIRFAX , IOWA.
Section 1 , The purpose of this ordinance is to amend section
2 . 1-2 . 1009 - All Night Parking Prohibited, and Section 2 . 1-2 . 1010
Snow Removal of Title II - Community Protection, Division 1 - Law
Enforcement , Chapter 2 , Traffic Code , Article 10 - Parking
Regulations of the City Code of Fairfax, Iowa .
Section 2 . Section 2 . 1-2 . 1009 , All Night Parking Prohibited
of Title II - Community Protection, Division 1 - Law Enforcement ,
Chapter 2 Traffic Code, Article 10 - Parking Regulations is hereby
amended by deleting Section 2 . 1-2 . 1009 in its entirety.
Section 3 . Section 2 . 1-2. 1010, Snow Removal , of Title II -
Community Protection, Division I - Law Enforcement , Chapter, 2
Traffic Code , Article 10 - Parking Regulations is hereby amended by
deleting Section 2. 1-2. 1010 Snow Removal in its entirety and
substituting in lieu thereof the following:
2 . 1-2 . 10110 SNOW REMOVAL - No person shall park, abandon
or leave unattended any vehicle on any public., street ,
or alley unless the snow has been removed or plowed from
said street, alley or parking area and the snow has
ceased to fall . No one shall park, abandon or leave
any vehicle on the designated snow routes per the
attached map.
Section 4 . All ordinances and parts of Ordinances in conflict
hereof are hereby repealed .
Section 5 . Severability - If any section, provision or part
of this ordinance shall be adjudged invalid or unconstitutional,
such adjudication shall not affect the validity of the ordinance as
a whole or any section, provision or part thereof not adjudged
invalid or unconstitutional .
Section 6 . This ordinance shall be in full force and effect
from and after its passage, approval and publication as provided by
law.
