Adjournment , I CITY OF FAIRFAX The City Council of Fairfax met on Tuesday July 12 , 1994 at 7 : 00 p. m. Mayor Sheely presiding, with council Stallman, Root, Neuhaus , Wainwright and Shakespeare present . Citizens in attendance : Keith & Mike Sankot , Linda Root , Harold Zenisek, Corey, Floy, Don Stockton, Sheri Cadbow, Kathy Bullock, Sheri Collingwood, Bryan & Linda Balog, Pat Slater , K . C. Waychof , D. Yanecek, Mr . & Mrs . Jeff Freeze , Todd Philipp, Mr . & Mrs . Joe Ostrenga . Motion by Neuhaus , 2nd Stallman to approve the Agenda , Minutes of Previous Meeting, Budget and Financial Reports . MC . The Sheriff ' s department was requested to check to see if a car would be in Fairfax later in the evening to prevent some of the theft ' s . Maintenance Report : Top prioity will be to replace the Lift Station, finish the sand bunker , and put the ceiling in the pavillion at the park, Motion of Neuhaus , 2nd Wainwright to continue to pay Lud the fifty dollars per month he was given on the 93/94 budget . MC. The city will clean out the ditch from Balog` s driveway down to the viaduct , and then Tonnenson ' s may put in a. culvert to help their, drainage problems . The bid on the dugout at the baseball field was tabled until the August Meeting, to get further bids . The clerk will check with the C&NW about the lease for the water line under the railroad. Motion by Stallman, 2nd Wainwright the city will pay for the flags and trophy ' s for the July 2nd celebration . MC . Fire Department : Motion by Stallman, 2'nd Root to approve the appointment of Joel Zeb to the Fire Department . MC . Motion by 'Shakespeare , the Fire Chief will handle the advertising for the sale of the Fire Truck received from Cedar Terrace . Minimun bid of $1 , 500 will be required . 2nd Neuhaus . MC , Building Pemits: Motion by Wainwright , 2nd Neuhaus for Todd: Philipp to remodel , add garages and an entryway at 331 Vanderbilt.. Motion by Neuhaus , 2nd Stallman for Jeff Freeze to build a house on W. Cemetery Rd . Motion by Neuhaus , 2nd Stallman for Sankot ' s garage to build an addition to their garage . Motion by Wainwright , 2nd Neuhaus , Joe Ostrenga to build a carport and garage at 209 Front St . Letter from neighbor Coppess will be attached to the permit .. All ayes . Complaint filed by Don Stockton , 123 Main St . , about a "Saw Mill" operation at 1.11 Main St . Neighboring citizens were in attendance and expressed their complaints about the smoke from the kiln , and the wood piled in the yard . The City Attorney ' s opinion is that operating a ".Saw Mill" in their yard is not consistent with the zoning . Motion by Neuhaus , 2nd Shakespeare that the Root ' s cease all operations immediately. Box 93 Fairfax, IA 52228 Re: C-2 Arterial Commercial District Zoning Dear Betty: You requested our opinion whether operation of a portable sawmill and a kiln at 111 Main Street in Fairfax is a use permitted in a C-2 Arterial Commercial District. In reviewing the Fairfax zoning ordinance adopted April 9 , 1991, it would be our opinion that such a business operation would not be included within the C-2 Arterial Commercial District. Our opinion is based in part upon your advise that the sawmill began operating after April 9 , 1991. There may be some room for interpretation under paragraph B(8) of the C-2 Arterial Commercial District. However, we believe that it is probable that a court would not interpret such language to include a sawmill and kiln operation on the property. We enclose a copy of City of Lamoni y. Livingston, 392 N.W. 2d 506 (Iowa 1986) , which held that a sawmill constituted a manufacturing enterprise within the meaning of a zoning ordinance. We believe it is probable a court would similarly hold that the C-2 Arterial Commercial District in the 1991 Fairfax Zoning Ordinance would not include a manufacturing operation such as a sawmill. On 06/24/94 at approximately 0945 hours, I witnessed Allen and Linda Root of 111 Main Street, operating a "Saw mill" on their premises. -Since this is unsafe and not a very quiet operation I approached the Roots. Knowing, that without City Council approval, I could not have them stop operating permanently, I asked if they could at least stop until 11:00 AM or even 12:OOPM due to a late work shift the previous night. At this point, I received a -non-verbal agreement to do so. I went back home. At approximately 11:00 AM they began operating the "Saw mill" again. When I approached them again Linn County Sheriff's deputy John Davidson, #153 was there, in uniform. I asked Allen why he had started back up and his reply was "I'm conducting business with a customer!" and gestured to the uniformed deputy. Linda stated "Our lives cannot be put on hold just for you!" At this point I turned around and went back home and contacted City Hall for advisement. Box 93 Fairfax, IA 52228 Lear Ms. Panek: We are the attorneys who represent Mr. and Mrs. Ronald Tonneson, 126 Church Street, Fairfax, Iowa. As you. are no doubt well aware, Mr, and Mrs. Tonneson are continuing to have problems obtaining access to their property frorn Church Street because the bottom portion of their driveway continues to wash out with each significant rainfall. It is our understanding that although the City Council has in the past contemplated the imposition of an assessment to do curb and gutter work along Church Street, such an assessment has never, in fact, been approved, and no such curb and gutter work is currently scheduled to take place. In addition, we understand that Mrs. Tonneson has raised this problem on several occasions in the past, only to be told that it is her responsibility to install a culvert at the base of her driveway to allow water to pass through her property. Unfortunately the practicalities of the situation simply will not allow the Tonnesons to follow the City's instructions in this regard. As a practical matter, it simply will do no good for them to install. a culvert at the base of their driveway because there are no ditches along the roadside or ran the surrounding property which would serve to promote drainage through such a culvert. In short, the solution proposed by the City is unworkable. In the meantime Mr. and Mrs. Tonneson continue to experience difficulties ensuring access to their home from Church Street. They have attempted to find a stop-gap solution by pouring rociz into the washed out roadway area at the base of their driveway. This measure, however, only lasts until the next good rain. It is our opinion that the City of Fairfax bears responsibility for maintaining the public roadways within the city limits. Further, our clients believe strongly that the drainage problems in front of their hone have been exacerbated over the years by repeated Ms. Betty Pan.ek June 27, 1994 Page 2 ,resurfacing of the street. Thus, we believe it is incumbent upon the City to assist the Tonnesons, and, for that matter, their neighbors facing similar problems, in finding a workable solution to this problem. I respectfully request that you forward the concerns we have raised on to the appropriate authority, be it the council or the City's legal representative, for handling. My clients are willing to pay their fair share for a permanent solution and are anxious to see that these matters are addressed.
