CITY OF FAIRFAX
Regular meeting of the Fairfax City Council , Tuesday September
13 , 1994 . Mayor Sheely opened the meeting at 7 : 00 p.m. Council
members present : Neuhaus , Shakespeare , Wainwright , Root , Stallman
arrived at 7 : 50 p.m,
Scott McLeod, City Attorney and Maury Burr D. Q.T . were in
attendance .
Wainwright made a motion to approve the Agenda, Minutes of August
9th meeting, Budget and Financial Reports . 2nd Neuhaus . MC.
Wainwright made a motion to approve ORDINANCE 190 - AN ORDINANCE
AMENDING AND CHANGING THE ZONING CLASSIFICATION OF CERTAIN PREMISES
AS ESTABLISHED AND SHOWN ON THE OFFICIAL ZONING MAP OF THE CITY OF
FAIRFAX , IOWA. Ten (10 ) acres on East Cemetery Rd. by Tom Arp. 2nd
Shakespeare . Shakespeare moved the procedural requirements as set
forth in section 380 . 3, Code of Iowa be suspended, and Ordinance
190 be placed on its second and third readings by its title . 2nd
Neuhaus . Mayor Sheely, declared ordinance 190 adopted and in effect
as per publication requirements. MC
Nothing for the Sheriff ' s Department . Maintenance Report : Merry -
go - round, from C'ox is in place , the Contract for cleaning the
sewer lines has been finished, they are replacing a water line on
Prairie , Ron was requested to get a Drs . release to work. Motion by
Neuhaus , 2nd Wainwright the city will purchase new water test
equipment . MC. The Clerk will send letters to Banes Construction
and John Thomas about mowing the weeds in their lots .
Root made a motion to approve the building permit for Richmond' s
for a garage . 2nd. Wainwright . MC Wainwright made a motion to
approve the building permit of Tom Meyer for a garage if after the
survey, everything is within the legal requirements . 2nd
Shakespeare . MC .
Neuhaus moved the approval of the Beer Pemit for the Handi Mart,
2nd Wainwright . MC.
Scott Mcleod, City Attorney, discussed the Blue Stem Agreement ,
He stated that a council person should attend the meeting in Mt.
Vernon on September 29th. Wainwright made a motion that the City
defer joining Blue 'Stem at this time, and it will be discussed
further at the October Council meeting, 2nd Shakespeare . MC .
Maury Burr , D.O.T. , discussed the construction on Hwy 151 . Motion
by Neuhaus , 2nd Wainwright to sign a Pre construction Agreement.
MC .
Motion by Wainwright, 2nd Stallman to request a street light on
the West end of Main Street . MC . Clerk will request Ron to do a
light survey to find other dark areas that might need lights .
Motion by Wainwright , 2nd Root to approve the bills presented for
payment . MC .
Motion by Shakespeare , 2nd Wainwright to adjourn at 8 : 50 p.m.

ORDINANCE
AN ORDINANCE AMENDING AND CHANGING THE ZONING
CLASSIFICATION OF CERTAIN PREMISES AS ESTABLISHED AND
SHOWN ON THE OFFICIAL ZONING MAP OF THE CITY OF
FAIRFAX, IOWA.
BE IT ORDAINED BY THE CITY COUNCIL OF FAIRFAX, IOWA
Section 1. The purpose of this ordinance is to amend
and change the zoning classification for certain premises as
established and shown on the official zoning map for the
City of Fairfax, Iowa. j
Section 2. The zoning classification of
CNP for the premises
described as 10 ACRES - ARP ' s - EAST CEMETERY RA . as
adopted and shown on the official zoning map of the City of
Fairfax, Iowa, is ]hereby amended and changed by repealing
the above zoning classification and adopting in lieu thereof
the zoning classification of 44 RS
for the above described premises.
Section 3 . All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 4 . If any section, provision or part of this
ordinance should be adjudged invalid or unconstitutional,
such adjudication shall not affect the validity of the
ordinance as a whole or any section, provision or part
thereof not adjudged invalid or unconstitutional.
Section 5. This ordinance shall be in full force and
effect from and after its passage, approval and publication
as provided by law.
