CITY OF FAIRFAZ
The Fairfax City Council met on Tuesday April. 11 , 1995 at 7 : 00
p. m. Mayor Sheely presiding , councilmembers present : Neuhaus , Root ,
Shakespeare and Wainwright . Absent Stallman.
Motion by Wainwright to approve the agenda, minutes of the March
14th council meeting , budget and financial reports . 2nd
Shakespeare . MC .
Capt . Bill Yount of the Linn County Sheriff ' s Dept . was present
to discuss some of the vandalism in town. Motion by Neuhaus , 2nd
Shakespeare to approve the sheriff ' s contract for F/Y 94/95 , with
a change to 19 hours from the 20 . MC .
Maintenance Report : Ron discussed the meetings with the D . O. T.
concerning the road construction on 151 . Motion by Wainwright, 2nd
Neuhaus to start Yard Waste pickup on Tuesday May 2nd , and continue
the 1st and 3rd Tuesday of each month until October . MC Motion IDy
Root , 2nd Neehaus to try Clean up day differently this year .
Saturday May 27th and Saturday June 3rd , 8 : 00 a . m. to 12 : 00 p .m . ,
there will be a truck and men down at the Lagoon area to accept
clean up items , MC. Further information will be put in the
Newsletter about what items will be taken and what items will not .
Linda Balog and Susan Rigdon will be handling the Newsletter for
the city .
Motion by Wainwright , 2nd Neuhaus to appoint Maxine Meeks to the
Library Board to fill the unexpired term of Randy Uittetoe . MC .
Bill Barry Discussed the Civil Defense meeting and their request
for funding . Motion by Shakespeare , 2nd Root that no money will be
given to the Civil Defense . Aye Neuhaus , Shakespeare & Root . Nay
Wainwright .
Mayor Sheely opened the Public Hearing on the increase in Water
and Garbage Rates at 7 : 45 p . m. Discussion on the reasons , and the
hearing was closed at 8 : 00 p .m.
Ordinance 198 - WATER RATES - was read for the first time ,
Motion by Neuhaus , 2nd Wainwright , to approve the first reading. MC
Motion by Neuhaus , 2nd Wainwright to despense with the 2nd and 3rd
readings of Ordinance 198 as per state code . Ordinance 198 approved
can reading by Title only , the 2nd & 3rd time . MC. Mayor Sheely
declared Ordinance 198 adopted and in effect as per publication
requirement .
Ordinance 199 - GARBAGE RATES - was read for the first time .
Motion by Neuhaus , 2nd Shakespeare , to approve the first reading.
MC . Motion by Neuhaus , 2nd Shakespeare , to despense with the 2nd
and 3rd readings of Ordinance 199 as per state code . Ordinance 199
approved on reading by Title only, the 2nd & 3rd time . MC . Mayor
Sheely declared Ordinance 199 adopted and in effect as per
publication requirement .
Ordinance 200 - NO PARKING ZONES - was read for the first time .
Motion by Wainwright , 2nd Shakespeare ,, to approve the first
reading . MC . Motion by Root , 2nd Neuhaus ,, to despense with the 2nd
and 3rd readings of Ordinance 200 as per state code . Ordinance 200
approved on reading by Title only , the 2nd and 3rd time . MC . Mayor
Sheely declared Ordinance 200 adopted and in effect as per
publication requirement .
Motion by Neuhaus , 2nd Wainwright to approve RESOLUTION 41195
Setting Salaries for F/Y 95/95 . MC.
A letter will be sent to Mr . Carver regarding his moving his
junk vehicles , requesting a time table as to when they will be
removed .
Motion by Wainwright , 2nd Shakespeare to approve Starwest ROW
application . MC.
Motion by Shakespeare , 2nd Root to sign a contract with Virginia
Soukup to help at City Hall with a $200 per year limitation. M.C.
Motion by Neuhaus , 2nd Shakespeare to approve the Beer permit
for the Baseball Assoc . MC.
Discussion: A letter will be sent to the Board of Supervisors ,
the Crandic and Linn Co. Road Dept . , about cleaning out the ditch
along Southview Rd . and the Crandic Railroad.
Motion by Root , 2nd Shakespeare to approve the bills presented
for payment . MC .
Motion by Wainwright , 2nd Neuhaus to adjourn at 8 : 55 p . m.

The City Council of Fairfax , Iowa is requesting that the
CRANDIC, clean out its ditch along the tracks that runs on the
South side of Fairfax . The Culverts also need to be cleaned , they
are blocked and cause water to run towards Fairfax .

The City Council wrote to you in 1993 , because of the water
problems , the county partailly cleaned the ditches but they need to

A RESOLUTIONS SETTING THE SALARIES FOR APPOINTED EMPLOYEES OF 'THE
CITY OF FAIRFAX FOR THE FISCAL YEAR OF 1995/1996 ,
BE IT RESOLVED BY THE CITY COUNCIL OF FAIRFAX , IOWA:
Section 1 . The following positions named shall be paid the
Salaries or wages indicated and the City Clerk is
authorized to issue checks, less legally required or
authorized deductions from the amounts set out below,
and make such contributions to IPERIS , FICA, and other
purposes as required by law, or order of the City
Council, all subject to audit and/or review by the City
Council .
CITY CLERK : $8. 32 per hour M,T,W, & F ( 32 office
ice
hours , 4 non office
hours . )
LIBRARIAN: $8. 00 per hour @ 23 Hrs per wk.
CHILDRENS LIBRARIAN: 5 . 30 per hour @ 13 Hrs per wk,
SATURDAY HELP: 5 . 00 per hour @ 3 Firs per wk.
Substitute Help: 5 . 00 per hour. @ 59 Hrs per yr .
MAINTENANCE MEN: $10 - 00 per hour 40 hours per week
Section 2 . OVERTIME: Any time over the regular hours shall be
taken off on another day as regular time.
Section 3 . The City shall provide the City Clerk and the
Maintenance Men with Blue Cross/Blue Shield insurance .
The City shall be responsible for the first $500 ( $,200
deductible plus $300 ) for each person covered. ( SINGLE
POLICY ONLY. )
Section 4 . The City Clerk and Maintenance Men shall be paid for 'the
following Holidays : NEW YEAR ' S DAY , GOOD FRIDAY,
MEMORIAL DAY , 4TH OF JULY, LABOR DAY, THANKSGIVING DAY ,
DAY AFTER THANKSGIVING, CHRISTMAS EVE DAY , AND CHRISTMAS
DAY.
Section 5 . The City Clerk and Maintenance! Men shall be allowed four
(4 ) sick days per year . The sick days may be accumulated
up to thirty ( 30,) days , They shall be allowed two ( 2 )
Personal Days per year . Personal days may not be
accumulated, After using five ( 5 ) consectutive sick days
at the discretion of the Mayor , a Doctor ' s verification
may be requested .
Section 6 , Vacation Schedule . Forty ( 40 ) hours after one year ,
eighty (80 ) hours after three 'years , and 120 hours after
seven years

Section 1 . The purpose of this ordinaDee is to amend.
section 1201-2 � 1008 NO PARKING ZONES, of Title 11 - Community
Protection , Division I - Law Enforcement , Chapter 2 , Traffic Code ,
Article 10 -- Parking Regulations of the City. Code of Fairfax, lowa,
Section 2 , Section 2 . 1-21008 NO PARKING ZONES of Title
II - Communi9ty Protection, Division I - Law Enforcement , Chapter
2 Traffic Code , Article 10 - Parking Regulations is hereby amended
by deleting Section 2 . 1-2 . 1008 , Paragraph 10 ,
Section 3 . All Ordinances and parts of Ordinances in
conflict hereof are hereby repealed.
Section 0 Severability, if any section, provision or
part of this ordinance shall be adjudged invalid or
unconstitutional , such adjudication shall not affect the validity

Section 1 . The purpose of this ordinance is to amend
Section 3-4 . 0211.( 1 ) Schedule of Fees of Title TIT - Mental, and
Physical Health, Chapter 4 , Solid Waste Control , Article 2 ,
Collection and Transportation of the City Code of Fairfax, Iowa.
Section 2 . Section 3-4 . 0211( 1 ) Schedule of Fees of Title
III - Mental and Physical Health, Chapter 4, Solid Waste Control,

deleting Section 3-4. 0211( 1 ) in its entirety and substituting in
lieu thereof the following :

- WATER RATES, SECTION 6-1 . 0302 - RATES AND SERVICE OF
THE CITY CODE OF FAIRFAX , IOWA
BE IT ORDAINED BY THE CITY COUNCIL OF FAIRFAX, IOWA.
Section 1 . The purpose of this ordinance is to amend
Section 6-1 . 0302 Rates and Service Title VI - Community Development
and Environment, Chapter 1 - Water Service , Article 3 - Water Rates
of the City Code of 'Fairfax, Iowa.
Section 2 . Section 6-1 . 0302 Rates and Service of Title
VI - Community Development and Environment , Chapter 1 - Water
Service , Article 3 - Water Rates of the City Code of Fairfax, Iowa
is hereby amended by deleting Section 6-1 . 0302 in its entirety and
substituting in lieu thereof the following:
"6-1 . 0302 RATES AND SERVICE . 'Water Service shall be
furnished at the following monthly rates within the
City-
I to 3 ,000 gallons - $4 . 00 (minimum bill ) .
3 ,001 gallons and up - $2 . 50 per thousand. "
Section 3 . All ordinances and parts of ordinances in
conflict hereof are hereby repealed.
Section 4. Severability. If any section, provision or
part of this ordinance shall be adjudged invalid or
unconstitutional, such adjudication shall not affect the validity
of the ordinance as a whole or any section, provision or part
thereof not adjudged invalid or unconstitutional .

It is agreed between Virginia Soukup and the City of Fairfax ,
that Virginia Soukup shall enter into a contract with the City of
Fairfax , for a one ( 1 ) year period, to help the City Clerk with
various duties at City Hall , effective January 1 , 1995 , under
the following conditions . With a $200 . 010 per year maximum.
1 . Pay shall be at the rate of $12 . 50 per hour .
2 . Either party may terminate this agreement by
giving the other two ( 2 ) weeks advance notice
in writing.
