The Fairfax City Council met on Tuesday October 10, 1995 at 7'' c 03
p.m. , Mayor Sheely presidiing. With co'uncilmembers Wainwright,
Shakespeare , Root, and Neuhaus. Stallman Absent. Several guest in
attendance, also local Boy Scouts .
The Mayor requested that everyone please hold thier comments to
the items that are on the agenda.
Motion by Neuhaus, 2nd Wainwright to approve the agenda, minutes
of the September meeting, clerk' s budget and financial reports . MC,
Maintenance Dept. Sand bunker is almost finished, except for the
doors . Requested permission to cement the dip by maintenance
building, no action. Mayor requested the maintenance dept. to clean
out Fairfax road ditch, from Church Street to the Railroad. Motion
by Wainwright, 2nd Sshakespeare for Lud to attend a Water and
Wastewater meeting. MC.
Decision by the Board of Review to allow the variance for Bill
Barry.
The following building permits were approved;
ud Svoboda - Motion Neuhaus, 2nd Shakespeare - Garage.
Ralph Emanuel - Motion Wainwright, 2nd Neuhaus - Shed.
Dale Carter - Motion Neuhaus 2nd Shakespeare - Replace back porch.
Ornamental Concrete - Motion Shakespeare,, 2nd Wainwright - new
building addition.
Richard Berstler - Motion Neuhaus, 2nd Root - Garage .
Bill Barry - Motion Wainwright, 2nd Neuhaus - Garage.
Rustfree Auto Parts and Wholesale Auto requested a letter for
a conditional use for thier businesses. Motion by Shakespeare , '2nd
Neuhaus to approve Rustfree Auto. Motion by Shakespeare , 2nd
Neuhaus to approve Wholesale Auto Parts ., MC. They were instructed
to make sure that they put all parts in buildings.
Motion by Neuhaus, 2nd Shakespeare to approve Street Light
Resolution requesting an additonal Street Light in front of the
Brick School. MC.
Bill Barry, the city representative on the Emercency Management,
explained to the Council about thier requests for funding. The City
Council said they thought the budget should not go over the
$180,000 .
Lt . Rik Haendler, Sheriff ' s Dept. , gave a brief decription on a
Radar Trailer they would like to purchase. Cities in Linn County
would help defray the costs and then would be used in each city at
various times .
Fire Department. Chief Sankot talked about the new medical truck
that they are going to purchase. Motion by Neuhaus , 2nd Shakespeare
that they should check out all thier quotes and compare, and then
go with the best deal , within reason.
Discussion on the Crandic Ditch, and Union Pacific Railroad
followed. The City Attorney will be contacted about both items.
The City will replace the basketball backboard at the park, and
will talk to Prairie about the Tornado Slide.
Approval was given for the Clerk to attend IMFOA meeting, motion
by Wainwright 2nd Shakespeare. MC.
Motion by Wainwright , 2nd Shakespeare to approve payment of
bills . Motion by Shakespeare, 2nd Wainwright to adjourn at 9 .30
p.m.

A motion was made by Merle Hastings to allow the variance
and seconded by Ray Zamastil. The motion carried.

Dear Mark:
As you know, News Channel 2 did a story on the Railroad problem, Some of the
footage from that story was footage that I submitted. I am glad that they were able to bring to
light a problem that has existed ever since they put in a switching station just East of the
intersection, but I feel that the issues surrounding the Engines parking in town were not covered.
My concerns start with the fumes and smoke that is emitted from the engines. If you
were able to see the footage that News Channel 2 aired you would have a very good
understanding of what occurs everyday. If you were unable to view the footage, I still have
footage available or just come on down to the intersection, the engines are still parking in town.
Secondly, the continual noise of the engines sitting idle for long periods of times. I feel that the
noise that the train makes is just as much a pollution problem as the smoke and fumes, Idonot
have a problem with the Horns blowing because I know that it is very necessary and important
for the railroad to alert any and all oncoming traffic by all means necessary of the approaching
train.
I have, what I feel is a very simple solution to the problem. That is for the engines to
park to the West of the Viaduct. The Viaduct would provide an adequate noise barrier and also
somewhat of a shield for the smoke and fumes emissions.
This has been a topic of discussion with a number of residence of the community and I
felt that we could possibly come to an agreement with the railroad, which motivated me to try
and contact someone from the railroad. This was about a year ago.The statement was made in
the story ran by News Channel 2 that the railroad is 'Willing to work with community on a
solution'...1 have left message after message with the railroad and I am still waiting on someone
to contact me. I have spoken with several engineers about this problem and I'll list just a few of
the responses I received: 'Weare not able to gauge where to stop% '...Had to come into town to
be able to see the controls'; '...The trains have been here longer than the community!'. These
were just a few of the responses I received and all of the responses were not favorable to
working with the community on a solution.
I have lived in this community for over thirty years and I understand that the railroad was
here before the community, but the community, as well as the railroad, are not going to be
moving, so I hope that we are able to come up with a solution that will be acceptable to the
railroad and to those living in the community. I do regret not being able to attend this meeting
tonight due to a prior commitment. If you have any questions please feel free to call me. Thank
