Mayor Sheely called the meeting to order at 7 : 00 p.m. Council present Stallman, Shakespeare, Harville , Neuhaus. Wainwright arrived at 7 : 05 p.m. Fifteen residents in attendance . Amy Scott was in attendance as a High School project. Motion by Stallman, 2nd Neuhaus to approve the Agenda, Minutes of the February Meeting, Clerk' s Budget and Financial Reports . MC .. Building permits : Motion by Stallman, 2'nd Wainwright to approve the permit for Jeff Vance for Storage Garages on Williams Blvd. Ayes Stallman, Wainwright, Harville and Shakespeare . Neuhaus abstained. Motion by Neuhaus , 2rid Shakespeare to approve the permit for Mark Prabel for a storage building. MC. Motion by Neuhaus, 2nd Stallman to approve the permit for Bill Van Nevel for a single family home . MC Motion by Wainwright, 2nd Neuhaus to approve the permit for Selzer ' s Enterprises for an addition to Bo'b ' s Meats . MC. Motion by Harville, 2nd Stallman to approve the permit for Harold Scott to add a porch to the rear of his house. MC. Motion by Stallman, 2nd Shakespeare to approve the permit for Jack Harville for storage garages . Ayes Neuhaus , Stallman, Wainwright, Shakespeare, Harville abstained from voting. Motion by Shakespeare, 2nd Neuhaus to rescind the building permit issued to Progressive Homes at the February Council Meeting , MC , Motion by Shakespeare, 2nd Neuhaus to change the Insurance Agent of record from Davis, Jones , Lamb Agency to Millhiser , Smith. MC. Frank Scott, Prairie Roadbuilders , let the Council know that they would check the streets over in a couple of months and give the city the cost . Reggie Hastings explained to Council that some lights might be donated to Fairfax to be used at the Ball Diamond. It was suggested that Reggie investigate the cost of running the lights , how many night games might be played, and how late they would run, and then come back to the Council . Motion by Neuhaus , 2nd Stallman to approve the Beer Permit for the Baseball team. MC. Reggie requested permission to the out the field behind the School , Pemission was granted as long as one of the maintenance men was on hand. CPR Recertification Classes will be held March 20th at City Hall , Motion by Shakespeare, 2nd Neuhaus to approve Ordinance 202 , amend Junk Vehicles . MC , Motion by Shakespeare , 2nd Neuhaus to suspend the 2nd and 3rd readings and adopt Ordinance 202 on its first reading. A letter will be sent to Mr . Reilly about his Old Pickup truck. Motion by Neuhaus , 2nd Brian to approve Ordinance 201 , Readopt the current City Code . MC. Motion to suspend 2nd and 3rd readings and adopt Ordinance 201 on its first reading. Box 93 Fairfax, IA 52228 Re: Junk Vehicles and Machinery Dear Betty: You requested that we review the Junk Vehicle and Machinery Ordinance, Title VI, Chapter 3, Article II of the Fairfax City Code.. We understand that a Fairfax resident has refused to remove a unlicensed and unused vehicle which is stored outside on his property. This resident is claiming that even though the vehicle is not licensed for the current year, it does not have the characteristics which constitute a threat to the public health and safety as enumerated in Section 6-3 . 0201 of the Fairfax code. You requested that we investigate amendment of this ordinance to revise 'the definition of a ""junk motor vehicle or junk machinery"" to include that it not be licensed for the current year or that it fit within the characteristics outlined in Section 6-3, 0201(1) through (5) . We would not recommend that this ordinance be amended in that manner, since the "junk vehicles" definition would include all vehicles that were stored in garages which for some reason the owner decided not to license. This could include antique cars or other vehicles which an owner might not want to operate for a period of time but are stored out of sight. We would suggest adding the following language to Section 6-3 . 0201(5) to correct the objection which is presently being argued by the Fairfax resident to avoid removing an unlicensed and obsolete vehicle from his property. " (5) defective or obsolete condition. Any other vehicle or piece of machinery which because of its defective or obsolete condition in any other way constitutes a threat to the public health and safety or is offensive to the senses. I believe the city council could, without this amendment, argue that the unlicensed and obsolete vehicle sitting unused outside and in full view of the public is a nuisance under the definition in Section 3-1. 0101(1) of the Fairfax Code. PURPOSE... The purpose of this ordinance is to comply with the provisions of Section 380.8, Code of Iowa, requiring cities to compile a code of ordinances at least once every five years. SECTION 2. CODE ADOPTED. The CODE OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 1989, as amended by Ordinances 157 through 200, both inclusive, being found to be correct and adequate for the City is hereby readopted as the CODE OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 1996, with the following amendments: A. DEFINITIONS. Section 1-1.0102, subsection 8 is repealed and the following is enacted in lieu thereof: "8. `Code of Ordinances' or `City Code': shall mean the Code of Ordinances of the City of Fairfax, Iowa, 1996." SECTION 3. AMENDMENTS. All general ordinances of the City passed hereafter shall be in the form of an addition, amendment or repealer to the CODE OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 1996, and shall include proper references to title, chapter, article and section or subsection to maintain the orderly codification of ordinances. SECTION 4. COPY ON FILE. An official copy of the "CODE ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 1996," adopted by this ordinance, including a certificate of the City Clerk as to its adoption and the effective date, is on file in the office of the City Clerk and is available for public inspection. Any other vehicle or piece of machinery which, because of its defective or obsolete condition, in any other way constitutes a threat to the public health and safety or is offensive to the senses. Section 3 . All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4 . Severability. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
