Mayor Sheely called the meeting to order at 7 :00 p.m. Council present Neuhaus, Stallman and Wainwright . Absent Harville and Shakespeare . Motion by Neuhaus, 2nd Stallman to approve the Agenda , Minutes of the June 11th meeting, Clerk' s budget and financial reports . MC. Sgt . Rowe , Linn County Sheriff ' s Dept. presented the monthly report . Mike Karal requested the City to clean out the ditches on East Cemetery Rd. to help the drainage problem. Motion by Neuhaus, 2nd Stallman to approve Banes Constructions ]Bid to clean the ditch on E. Cemetery, a section on W. Cemetery and on Church Street from the bail diamond to Fairfax Raod. MC. Liz Jacobi , City Attorney, presented the latest on the Bluestem By-laws and rules . The Council asked her to attend a meeting with Mayor Clancey, Cedar Rapids , and Marsha Beckleman on July 17th. Building Permits: Motion by Stallman, 2nd Wainwright to approve Waterworks for an addition to their office building. MC. Motion by Wainwright, 2nd Neuhaus to approve the Masonic Lodge for an addition for storage on the Lodge building. MC. Bud Burger represented St . Patrick' s Church to request permission to put a tile line around the Church. Motion by Wainwright 2nd Neuhaus , the city will check on the culvert across Church Street and possibly putting a catch basin in to handle the water . MC Betty Hamilton requested that something be done about the water in the loop to theer home . Motion by Neuhaus , 2nd Stallman we will get bids on a circulating pump, and come up with a possible solution to clear out the lines . MC. Fire Chief requested the admission of Eric Lyle to the Fire Department . Motion by Neuhaus , 2nd Wainwright to approve his appointment . MC . The New Rescue truck is finished and the chief is going to pick it up. The Department has ordered a "Jaws of Life . " Motion by Stallman, 2nd Wainwright to send a letter to Todd Philipp, and give him until July 15th at 8: 00 a.m. to clean up the City Streets, or the City will clean it and bill him for the service . He will also be billed for the use of the City Barricades . MC. Motion by Wainwright , 2nd Neuhaus to accept Prairie Roadbuilders latest revisions for the streets . MC. Motion by Neuhaus, 2nd Wainwright to approve Street Light Resolution, new Street Lights of E . Southview Rd. MC. Clerk wall contact IES and have a representative go with Neuhaus for the proper location. ORDINANCE 203 -- Amending Paragraph D of Section 1 . 08 . 01 of the Supplementary District Regulations of the City of Fairfax Zoning Ordinance . ACCESSORY BUILDINGS. Motion by Neuhaus , 2nd Stallman to approve the Ordinance on its first reading. Wainwright moved the approval of Ordinance 203 on its second and third readings by its title , per section 380 . 3 , Code of Iowa. MC. RESOLUTION 070996 -- Addition to the building permit application. Motion by Neuhaus, 2nd Wainwright to approve the reolution. MC. Motion by Neuhaus , 2nd Wainwright to approve R.O.W. The zoning amendment will require a public hearing with notice of time and place of hearing published as provided in Section 362. 3 of the Iowa Code enclosed, except that at least seven days notice must be given and in no case shall the public hearing be held earlier than the next regularly scheduled city council meeting following the published notice. Solid Waste Agency Dear Betty: Enclosed is a letter I received from Dave Hogan at Bluestem. I believe it was in response to my letter inquiring as to status of the rules/bylaws promulgation. As you can see from the letter, there is apparently no longer a rules/bylaws committee. This is somewhat disturbing news, we think, because of the time and money Fairfax and other associate members have put in to have a voice in the fairness of operations. You recall, I am sure, that the board rationalized the lack of representation for smaller communities by stating that we could be involved in rules and bylaws rather than the Agreement. I have some questions, at least preliminarily, whether the board's action in disbanding the committees would survive judicial scrutiny because it was done without notice or hearing. I also have some questions whether it would be cost effective to get involved in the "working groups" of which Mr. Hogan speaks in his letter. I would like to discuss this with you and receive some directive from the council as to how I should proceed, if at all. Last, I received a call about Mr. Hogan's letter from Marsha Beckelmann, who represents several cities and was an appointed member of the rules and bylaws committee. She objects strongly to the action and suggests representatives of the smaller communities meet with Mayor Clancey to discuss the turbulent history and the assurances behind promulgation of rules/bylaws. Jacobi Enclosure ORDINANCE 203 AN ORDINANCE AMENDING PARAGRAPH D OF SECTION 1. 08. 01 OF THE SUPPLEMENTARY DISTRICT REGULATIONS OF THE CITY OF FAIRFAX ZONING ORDINANCE BE IT ORDAINED BY THE CITY COUNCIL OF FAIRFAX, IOWA. Section 1. The purpose of this ordinance is to amend Paragraph D of Section 1. 08. 01 of the Supplementary District Regulations of the City of Fairfax Zoning Ordinance Section 2 . Paragraph D of Section 1.08.01 of the Supplementary district Regulations of the City of Fairfax Zoning Ordinance is hereby amended by deleting Paragraph D of Section 1. 08 . 01 in its entirety and substituting in lieu thereof the following: D. Accessory Buildings. No accessory building may be erected in any required front or side yard and no separate accessory building may be erected within 10 feet of a main building. Where a garage is entered from the alley it must be kept 15 feet from the alley line. Accessary buildings located in the rear yard may not occupy more than 30 percent of the rear yard nor be less than four feet from any lot line. Section 3 . All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4. Severability. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Section 5. This ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law. Adopted this day of f € 1996, and approved on the same date.
