CITY OF FAIRFAX The Fairfax City Council met on Tuesday September 10 , 1996 . Mayor Sheely opened the meeting at 7 :15 p.m. Council present Harville, Shakespeare and Neuhaus . Absent Stallman and Wainwright . Motion by Neuhaus , 2nd Shakespeare to approve the Agenda, Minutes of the August 13th Council Meeting, Clerk' s Budget and Financial Reports . MC. Motion by Shakespeare , 2nd Neuhaus to approve the building permit for Fred Woods of E . Cemetery Rd . , for a shed. MC. RESOLUTION 091096B - Preliminary and Final Plats of McGinness First Addition to Fairfax, Iowa . Recommendations from Planning and Zonning, Motion by Shakespeare, 2nd Harville to approve the Plats . MC. RESOLUTION 91096 - Olson' s Annexation to the City of Fairfax. Motion by Shakespeare to approve the annexation by legal boundry description, 2nd Neuhaus . MC. Olson requested that the city hold up on the annexation until further data is received. RESOLUTION 91096A - Olson' s Prelimanary and Final Plats of Olson' s First Addition to Fairfax were tabled until Olson changes the driveway entrances. Motion by Shakespeare, 2nd Harville to accept the resignation of Linda Balog as Librarian, and appoint Mary Ann Peters as the new Librarian. MC . Motion by Harville, 2nd Shakespeare to appoint Tina Slade to the Fairfax Fire Department . MC. Tom Drzycimski, ECIGOG, discussed the service agreement for preparation of amendments to the zoning ordinance . Motion by Shakespeare , 2nd Neuhaus to approve the Orginal Service Agreement Retroactive to August 29 , 1996 . MC . Motion by Harville , 2nd Shakespeare to approve the addendum to the Orginal Agreement . MC. Tom has set September 26th to meet with the Planning and Zoning Committee . Motion by Harville, 2nd Neuhaus to contact the City Attorney for a clarification on Fairfax Road. Who ' s responsibility it is to extend the road to the North? MC. Brian Rowe, Linn County Sheriff ' s Dept. gave his report on the Traffic Sting in Fairfax . Motion by Neuhaus , 2nd Shakespeare to approve RESOLUTION 0910960, Cox Cable transferring thier Franchise Agreement to TCI . MC. Maintenance Report : Motion Shakespeare , 2nd Harville for Lud to attend a conference on October 22nd . MC,. Complaint on burning at the Ball Park. The 'Ball team will be notified that there will be no burning at the Ball Park. All residents are responsible to mow to the street . A letter will be sent to Mark Reilly to trim back 'his bushes in front of his home or the City will trim them and charge. Mr . Reilly. Todd Philipp will be notified to attend the Council Meeting on October S , 1996 . Vern Cerveny has volunteered to open the park restrooms each day and lock them at night . Motion by Harville , 2nd Neuhaus for the Clerk to attend the League of Cities meeting on September 18 , 19 & 20th. MC . Dan Shakespeare discussed the problem with the ditch in front of his residence on West Cemetery Rd, Motion by Neuhaus, 2nd Harville to approve the bills presented for payment . MC. (hereinafter referred to as"the CITY")and the EAST CENTRAL IOWA COUNCIL OF .GOVERNMENTS (hereinafter referred to as the"SERVICE PROVIDER")for the purpose of contracting with the SERVICE PROVIDER for the review and preparation of AMENDMENTS TO THE FAIRFAX ZONING ORDINANCE [AND UPDATE TO THE CITY'S LAND USE PLAN IF NECESSARY] (hereinafter referred to as"ORDINANCE AMENDMENTS"). Terms. The SCOPE OF SERVICES& SERVICE COST PROPOSAL"forthe ORDINANCE AMENDMENTS shall be made a part of this SERVICE AGREEMENT. All provisions and language of the SCOPE OF SERVICESe SERVICE COST PROPOSAL shall be adhered to as If thev were incorporated herein. The CITY shall be billed on a monthly basis for actual hours worked.on the project during the month by the SERVICE PROVIDER„ The CITY will be billed monthly until the project is complete or the not to exceed figure has been attained,whichever is first: Effective Dates. The effective starting date for this SERVICE AGREEMENT shall be September 1, 1996. The SERVICE AGREEMENT shall remain in effect until November 30,1996,unless an extension is granted to the SERVICE PROVIDER by die CITY. Service Extension Period. The SERVICE PROVIDER shall provide a one near service extension' period,at no additional cost,for the purpose of correcting oversights, errors,or omissions that may have occurred in preparation of the documents. The service extension period shall begin upon adoption of the ORDINANCE AMENDMENT'S by the CITY. Termination. This SERVICE AGREEMENT maybe terminated by either the CITY or SERVICE PROVIDER by submitting a written notice of termination to the other party no less than seven(7)days prior to the end date of this SERVICE.AGREEMENT. This SERVICE AGREEMENT ADDENDUM is hereby entered into by the CITY OF FAIRFAX(hereinafter referred to as."the CITY") and the EAST CENTRAL IOWA COUNCIL OF' GOVERNMENTS(hereinafter referred to as the"SERVICE PROVIDER")for the purpose of preparing:a COMPREHENSIVE PLAN UPDATE (hereinafter referred to as PLAN UPDATE). Said PLAN UPDATE shall include but not be limited to revising the city's future land use map for areas Inside and outside city boundaries,summarizing the changes between the 1989 Fairfax .-Comprehensive Plamand the PLAN UPDATE,update land use recommendations,goals,and policies contained in said 1989 Fairfax Comprehensive Plan, and the review of other planning documents which may affect the future development of the CITY. Terms, This AGREEMENT ADDENDUM hereby amends the previous agreement between the SERVICE PROVIDER and the CITY signed and dated by the Mayor of the City of Fairfax on August 29 1996 (hereinafter referred to as"ORIGINAL AGREEMENT"'). The above services will be provided by the SERVICE PROVIDER at a rate not to exceed S280.00 This amount shall be above and beyond the not to exceed amount of$427.50 contained in the ORIGINAL,AGREEMENT. In no case will the combined provision of services under the ORIGINAL AGREEMENT and this AGREEMENT ADDENDUM exceed$752.50. Effective Dates., The effective starting date for this AGREEMENT ADDENDUM shall be September 10,1996. The AGREEMENT ADDENDUM shall remain in effect until November 30,1996,unless an extension is granted to the SERVICE PROVIDER by the CITY. Service Extension Period. Moved by Johnson and seconded by Selzer , Passed, Re : Request for approval of Preliminary and Final Plat (described in attached document ) , from Russell Olson. Moved for approval by Hartman, subject to satisfactory answers to the following questions , second by Stallman. Passed.. 1 . Is 30 " an adequate width for the access road, for access and snow removal? 2 . Is the location of the entrance of the same road on to West Cemetery far enough away from the crest of the hill? 3 . Should the requirement of upkeep of the access road by the owners of the three, lots under consideration be included in the lot abstracts? Re : Request of John and Mary Mcginness for preliminary and final plats )described in attached document ) . Moved by Hartman that the request be approved subject to satisfactory answers to the following questions: 1 . Is the 20 ' easment for the drive access to lot I adequate? 2 . Does this easement decrease the size of Lot 2 to less than one acre? Seconded by Stallman. Passed, Re : The before mentioned request from Russell Olson. ("Cox"). Cox has entered into an agreement to exchange the cable television system in your community(the"System")with TCI American Cable Holdings,L. P. ("TCI"). .Accompanying this letter is a cornpleted Form 394 with detailed information regarding TCI's qualifications, all required exhibits and documentations, and a proposed transfer resolution. For purposes of this transaction, Cox will first merge with its affiliate, CoxCom,Inc. ("CoxCom") and then immediately transfer the System to TCI. We respectfully request your consent to the transfer of the franchise in your community to TCI. We are also asking for your consent to the merger of Cox and CoxCom in the event that such consent is required under the franchise.
