RESOLUTION APPROVING PLAT
WIIEREAS, a Plat of OLSON'S FIRST ADDITION TO FAIRFAX, IOWA,
containing Seven (7) lots., has been filed with the City Planning Commission, Fairfax,
Iowa, and after consideration the same is found to be correct and in accordance with the
provisions of the laws of the State of Iowa, and the ordinances of the City of Fairfax,
Iowa, in relation to Plats and Additions to Cities,
NOW THEREFORE BE IT RESOLVED BY THE CITY PLANNING
COMMISSION OF FAIRFAX, IOWA, that the said Plat and dedications of said
OLSON'S FIRST ADDITION TO FAIRFAX, IOWA, be and the same is hereby
• acknowledged and approved on the part of the City Planning Commission and this
Commission hereby recommends to the City Council the approval of the same, and the

WHEREAS, Russell E . & Elvira D . Olson , pwners of the following
described property:

did make application dated October -29 , 199 ; for the annexation of
said property to the City of Fairfax, Iowa.
WHEREAS, it appears desirable and in the best interest of the City
of Fairfax, that said property referred to in said application be
annexed to the City of Fairfax, at this time, now therefore :
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRFAX, IOWA:.
that the property herein before described, and the same is hereby
annexed to the City of Fairfax, Iowa, in the manner provided in
Section 368 . 7 , Code of Iowa, 1983 , and such property shall
hereinafter be and become part of the City of Fairfax, Iowa.

The undersigned, being legal titleholders, to the hereinafter
described real estate, do hereby make written application to the
City Council of Fairfax, Linn County, State of Iowa for the
volunteer annexation of said property and state that the said tract
adjoins and abuts the present limits of the City of Fairfax, Linn
County, State of Iowa.
The real estate sought to be annexed pursuant to this
application, is more particularly described as follows :

The Fairfax City Council met on Tuesday December 10 , 1996 . Mayor
Sheely called the meeting to order at 7 : 00 p.m. Council present ,
Stallman, Harville and Neuhaus , Shakespeare and Wainwright arrived
at 7 : 08 p .m.
Motion by Stallman, 2nd Neuhaus to approve the Agenda, Minutes of
the November 12th meeting, Clerk' s Budget and Financial Reports .

Building Permits : Motion by Neuhaus , 2nd Harville to approve
Reed Construction, a Single family home , Motion by Stallman, 2nd
Neuhaus to approve Cory Stockton' s garage . MC .
RESOLUTION 12109 - Olson' s Annexation, Preliminary and Final
Plat of Olson' s First Addition to Fairfax . Motion by Neuhaus , 2nd
Wainwright to approve the annexation, the Mobile Home located in
the area , will be allowed until the present owner leaves and when
she leaves the Mobile Home will go . MC .
RESOLUTION 12109A --- Winifred ' s First Addition to Linn County ,
Iowa. Motion by Wainwright , 2nd Shakespeare to approve the

ORDINANCE 207 - AMENDING AND CHANGING ZONING CLASSIFICATION.

Thereupon, it was moved by Stallman, 2nd Neuhaus that the laws
and rules providing that the ordinance be considered and voted on
at two Council meetings be suspended and that Ordinance 207 and 208
be placed on its last reading . MC .
Fire Department -- Mike Sankot was re-elected Chief , with the
officers remaining the same . Discussion with Bill Barry, Emergency
Mangement on the city pruchasing an additional generator ,
Sgt . Mau, Linn County Sheriff ' s department presented the report .
Discussion on budget assignments , Newsletter , and the maintenance
report ,
Motion by Wainwright , 2nd Shakespeare to approve the bills

ORD I NANCE_207
AN ORDINANCE AMENDING AND CHANGING THE ZONING CLASSIFICATION
OF CERTAIN PREMISES AS ESTABLISHED AND SHOWN ON THE OFFICIAL
ZONING MAP OF THE CITY OF FAIRFAX , IOWA.
BE IT ORDAINED BY THE CITY COUNCIL OF FAIRFAX , IOWA
section 1 . The purpose of this ordinance is to amend and
change the zoning classification for certain promises as
established and shown on the official zoning map for the City of
Fairfax , Iowa ,
Saction 2 . The zoning classification of __AG
for the premises described as _IvF 151 and 80Q Street,
as adopted and shown on the official zoning map of the city 01".
Fairfax, Iowa , is hereby amended and changed by repealing the above
zoning classification and adopting in lieu thereof the roning
classification of C-2, Commercial Arterial -for the above described
premises
Section 3 . Al®l ordinance, or parts of ordinances in conflict
herewith are hereby repealed .
Section 4 , If any section, provision or pai.�t of this
ordinance should be adjudged invalid or unconstitutional, such
adjudication shall not affect the validity of the ordinance as a

ORDINANCE NO. 20'
AN ORDINANCE ADOPTING AN OFFICIAL ZONING MAP FOR THE
CITY OF FAIRFAX, IOWA, AND ESTABLISHING DISTRICTS, AS
SHOWN ON THE OFFICIAL ZONING MAP OF THE CITY.
BE IT ENACTED by the City Council of the Fairfax, Iowa, that the
City's existing zoning map, as established by Ordinance No, 77 , "A
Zoning Ordinance for the City of Fairfax, Iowa", and adopted
12-7-78 , is repealed and the following adopted in lieu thereof:
PURPOSE
The purpose of this Ordinance is to adopt an official zoning map of
the City of Fairfax, Iowa, and establish by reference to the official zoning

ADOPTION
As established by Ordinance No. 207 , Section 1.07
The City of Fairfax is divided into nine classes of districts. The
boundaries of these districts are hereby established, as shown on the official
zoning map of the City of Fairfax, Iowa, and said map and all notations,
references and information shown thereon shall be, and are hereby made a
part of this Ordinance by reference. The official zoning map signed by the
Mayor and properly attested by the signature of the Clerk, and the date of
adoption, shall be and remain on file with the City of Fairfax, Iowa, as
provided in Ordinance No. 207 , Section 1.07
REPEALER
All Ordinances or parts of Ordinances in conflict with the provisions
of this Ordinance are hereby repealed.
SEVERABILITY
If any section, provision or part of this Ordinance shall be adjudged
invalid or unconstitutional,, such adjudication shall not affect the validity of
the Ordinance as a whole, or any section, provision, or part thereof not
adjudged invalid or unconstitutional.
This Ordinance shall be in effect from and after its final passage and
approval and publication, as by law provided.
