Mayor Sheely called the Fairfax City Council to order at 7 : 100
p.m. Tuesday February 11 , 1997 . Council present , Stallman,
Shakespeare , Harville , Neuhaus and Wainwright .
Don Kleis , Frank Scott - Prairie Roadbuilders , Greg Steelsmith,
Steelsmith Sanitation and Marty Fritz, Schultz Sanitation and
citizens of Fairfax in attendance .
Motion by Harville, 2nd Stallman to approve the Agenda, Minutes
of the January Meeting, Clerk' s Budget and Financial Reports . MC.
Maintenance Report : Motion by Stallman„ 2nd Neuhaus to have Dud
attend IAMU Water Operators ' Safety and Training Workshop , and
Ornamental and Turfgrass , Roadside Applicators Class . MC . An
Ordinance will be drawn to require all new buildings to have shut
off valves on all meters .
Garbage Bids : Motion by Shakespeare , 2nd Wainwright to accept the
bid from Steelsmith Sanitation. MC. Mayor Sheely thanked Greg and
Marty for thier interest .
Disposition of the Karal Complaint . Motion by Shakespeare, 2nd
Stallman that the parties involved should try to handle the problem
between them. Ayes Shakespeare , Harville, Stallman . Abstain Neuhaus
and Wainwright . MC ,.
Prairie Roadbuilders : Motion by Stallman, 2nd Neuhaus to accept
the contract with Praire Roadbuilders for the 1997 street project .
A decision will be made later as to what streets will be done . MC .
Neff Vance requested the City to do something about the drainage
in the ditches along Hwy 151 in front of the Storage Buildings . The
clerk will contact the D .O. T . to see who' s problem it is �
Councilperson Shakespeare left at 8 : 15 p , m.
Sgt Hall , Linn County Sheriff ' s Department , turned in the Monthly
report . Discussed was the complaints about snowmobiles going thru
the streets and on private property. The Sheriff ' s deputies will
start stopping snowmobilers in the City. Parked cars on city
streets during snow removal will be issued a 24 hour notice to
move , or be towed .
Bill Barry, Emergency Management Rep. , discussed a letter that
will be sent to all of our Representative . He had the Council and
Mayor sign them .
Budget meeting set for Tuesday February 25 , 1997 .
Motion by Wainwright , 2nd Harville to pay bills presented . MC.
Motion by Harville , 2nd Neuhaus to adjourn at 9 : 25 p.m.

RE: Mike Karal complaint re: Vance Storage-- Barking
Dogs
Dear Betty:
Please provide copies of this letter to the other council
members and note that it should be kept confidential in order
to preserve the attorney/client privilege.
We understand at one of your recent council meetings, Mike
Karal complained about barking dogs on the property at Vance
Storage, which is adjacent to the Karal property. We
understand further that Mr. Karal is asking the City to issue
a Notice to Abate as was done with the bright lights coming
from the storage facility. As discussed by phone on this
date, we have reviewed the Fairfax Code provisions concerning
nuisances as well as the Iowa .Code provisions on which they
are based.
A basic rule of law is that one is entitled to the quiet
enjoyment of his property and whatever unreasonably interferes
with that enjoyment is a nuisance. A nuisance may be either
private or public. A private nuisance is one which is
peculiar to a given property owner, while a public nuisance
is one which is injurious to the public at large. Individuals
may seek abatement of a nuisance either through a city
ordinance and administrative procedure or through private
litigation.
Both the Iowa Code and Fairfax's Code are quite general
in their definitions of nuisances. Nuisances are whatever
unreasonably interferes with or disturbs a property owner's
right to quiet enjoyment of his property. However, the
standard is whether the annoyance (for example, the bright
lights, odor, danger, or noise) causes unreasonable
disturbance to a property owner. In other words, not all

disturbances rise to the level of nuisance; they must be
unreasonably annoying or disturbing.
The City has a great deal of discretion to determine
whether Vance's dogs are a nuisance for which a Notice to
Abate should issue. We understand as a practical matter the
problem may resolve itself soon because of actions Mr. Vance
anticipates taking. There is nothing of which we are aware
that would prevent the City from exploring a practical
solution before or instead of demanding abatement. Further,
it is our understanding there are several other homes in the
City with -dogs that bark. The question then arises whether
Mr. Vance's dogs' barking is an unreasonable disturbance to
Mr. Karal. Unfortunately, we found no case law specifically
addressing barking dogs as a nuisance. We advise the council
to weigh the various factors, including practical
considerations and possible future complaints of a similar
nature, to determine whether the City will invoke the nuisance
abatement procedure. As long as the City has a rational basis
for its decision and does not act arbitrarily, either decision
will be within its discretion.
If any member of the council requires additional
information or wishes to discuss the matter further, we are
of course happy to assist. Please advise if this is the case.

Description of problem:
As the two dogs that are caged behind the Vance Storage
Buildings have matured, so have the incidences of loud and
prolonged barking. Below are dates and times that the dogs
barking have either kept us awake or have awakened us :
