Mayor ProTem Neuhaus called the meeting to order at 7 : 03 p m. Council present Neuhaus , Stallman, Shakespeare and Wainwright , Motion by Stallman, 2nd Wainwright to approve the Agenda, corrected minutes of the March meeting, Clerk' s Budget and Financial Reports . MC , Mayor Sheely arrived at 7 : 15 p. m. Steve Gannon, Asst County Engineer and Mr . Jim Houser , Linn co. Board of Supervisors , discussed E . Southview Road . Steve explained that the City will be required to take the North half of the road by State Law. Discussion as to whether the City would like to enter into a 28E Agreement with the County. Ro decisions were made at this time . Steve stated that there was a time frame of approximately 2 years . Building Permits : Motion Stallman, 2nd Neuhaus to approve the permit of Ken and Chris Slaton for a Garage . MC . Motion Stallman, 2nd Neuhaus to approve the permit of Brad Hamilton for a deck . MC . Motion Neuhaus , 2nd Wainwright to approve the permit for Wm Karteus for a new home on E' . Cemetery Rd . MC . Enri Ostrenga presented her complaint on burning in Fairfax. After discussion with Mrs . Ostrenga and neighbors , motion by Neuhaus , 2nd Stallman to leave the burning regulations as they are now. Stallman, Neuhaus and Wainwright Aye , Shakespeare nay, Harville absent . Steve Waln presented his plans to build a Collision Center: on Lot #2 on Hwy 151 . Mike Karal requested permission to contact the DOT to get driveway acess . Mr . John Stokesberry, Starwest Cable , was present for questions on the renewal of the cable franchise . She requested better communication between the Council and the Library Board . Motion Neuhaus, 2'nd Stallman to approve the 6 Month Beer Permit for the Ball Team. MC . Motion Wainwright , 2nd Neuhaus to approve the bills presented for payment: . MC. Discussion was held on ditches along Seipman, the maintenance men will contact the homeowners . Ken Selzer discussed the water availability in the City . Ken will be placed on the May council Agenda . Discussion followed on vacations schedules and comp time . Ron will receive 2 weeks vacation, all. comp. time must be used up by the end of 1997 . The time will be used on the rates during which time it was accumulated. Betty Panek, City Clerk 1J CITY OF FAIRFAX Special meeting of the Fairfax City Council was called to order by Mayor Pro Tem Cerveny at 7 : 00p.m. in the Library Community Room. Council members present : Neuhaus, Peters , Quillin and Sheely. Guests - Dusil , Svoboba and Cawthorne . The meeting was scheduled to restructure the workforce for the City of Fairfax. Mark Neuhaus started the discussion on things that were not getting done in Fairfax, and the best solution for keeping things running smoothly. He thought the hours should be split and both Ron & Lud should work together, with Ron being put in charge of keeping things done . Vernon suggested that each morning the employees sit down and discuss what the jobs for the day will be and who is going to do them. The clerk should write up an agreement, stating the facts listed by the Council . Both are to make sure the equipment is ready to use the next day when it is put away for the night . Ron and Lud will alternate the Holidays . If a day off is going to be taken a 24 hour notice should be given, unless it is an emergency. Vacations should be requested one month before they will be taken and presented to Council for approval . If one of the maintenance persons would have to use his own vechicle for work, mileage would be paid, but a form must be kept and presented before mileage would be paid . After much discussion on haw to keep both of the maintenance persons working for the City. Motion of Neuhaus, 2nd Sheely, Dusil and Svoboda will work 40 hours per week. The one who has weekend duty will leave early on Friday, they will run an eight (8 ) hour day with a 1/2 hour for lunch . This will run for six ( 6 ) months and at that time will be reevaluated. MC. Motion of Neuhaus , 2nd Sheely,Dusil will be paid the same hourly wage as Svoboda and the City will pick up Dusil ' s health insurance . MC Motion of Quillin, 2nd Peters to adjourn at 9 : 05 a . m . MC , Vernon Cerveny Mayor Pro Tem Betty Panek City Clerk March 21, 1997 City of Fairfax Council Members 523 Vandervilt Street Fairfax IA 52228 To whom it may concern: We have felt that this letter is necessary to explain a problem that has gotten way out of hand and out of control and feel it is crucial to express our side of the story. As you know, we have been accused of burning trash that we should not be burning. We enjoy living in Fairfax and all we want is to enjoy our home and property and nuot have any friction with neighbors, but at this point we have our doubts that is possible. We feel that we bend over backwards to please End Ostrenga and no matter what we do it is never good enough. This all started when we received a letter from our neighbor End on January 17, 1997 stating that she had a medical problem and would appreciate it if we would move our burin barrel. Our burn barrel is located near their driveway and she indicated that the smoke would blow toward her house. When we purchased the barrel and started burning we chose that area of our yard, and as a property owner we feel as long as we are not breaking any city limits or rules we should be able to choose where our burn barrel is located. Out of respect however, we started to burn later at night when no one was outside and when the wind was going the opposite direction of Enri's house. As you see however, that still was not good enough and now she wants us to quit burning all together and accusing us of things that are totally untrue. What is more frustrating than anything is that she has now turned to lying to try to accomplish the restriction of our burning. We do not and have never burned our trash daily. On an average we burn about 2 or 3 days per week. We recycle everything that is possible and in reality there is no way a family of four would have enough garbage to burn daily. Yes, we have been putting our brash into the burn barrel in a garbage bag and when approached by Enri she indiicated that the bag was plastic and should not be burned. I indicated that I would dump the garbage out of the bag into the barrel from this point on. Never did II say that I would burn anything I wanted and if necessary I would disguise our 1 9 arbage as she stated. We have two children so as you can expect accidents happen and some items may be thrown in the garbage that should not be thrown in. We are going to be more cautious when we bairn. The comment in regard to us not caring or being concerned about Enri's medical problem is totally, untrue. If we did not care would we have started burning later in the evenings or watch which way the wind was blowing. The only reason we are short with her at this point is due to the way they have handled the situation which is totally immature and rude. We are tired of her making us sound like the Ibad ones in this whole situation. She does not ask us she tells us, she is rude, she has threatened us by saying that we and the town would start receiving her imedical bills to pay, and the latest by her coming over and ringing our doorbell and when no one answered she peeked in the window. The only reason that my daughter's Diabetes was mentioned was due to End stating that we had no idea and did not understand her situation with medical bills. All I did was state that we very much understand due to Tiffany having Diabetes. We agree with Enri's comment that her Diabetes is not the issue here and we feel she should of not even included the subject in her letter to the city. She knew exactly why I said what I said, and what it meant, but once again she is trying to make us look Ibad. We feel that the reason they are making a big issue out of the whole situation is that we have had problems with these neighbors since we have moved in. I have never met anybody like them that want it their way or no way. They want us to quit burning however, we have asked them to move their mailbox into their own yard and keep their trees and bushes trimmed and off of our property. The mailbox has never been moved or the tree and bushes trimmed. The only reason 'the some of the bushes were taken care of is because they were on our property line and we wanted to put up, a fence and for that reason they had to be moved. Another item that has pint strain between us as neighbors is the issue on their garage. We admit that we were not happy that they had to build a garage as big as their house, so close to our property line and when we asked them not to they indicated they were going to anyway. We are asking for the city's help at this time to inform the Ostrenga's that we want their tree trimmed and their mailbox moved. If they do not take care of this we will be happy to do both items for them, as we have hadl to trim their tree and bushes in the past. We want them done immediately, Once again we apologize to the City of Fairfax that this whole situation has gotten so out of handl. We will continue to burn as Ilong as the City ordinance allows us to do so, as long as we are obeying the rules. We will be more cautious on what we are burning. We feel as long as the whole town burns why should the Ostrenga's ask us to be the only ones that don't. We enjoy living in Fairfax and have no problems with any of our neighbors but the Ostengas. We are tired of one person trying to control everything that we do and wish to have all these issues settled. It is to be hoped that after that point they will respect our wishes and mind their own business. We wish no medical problems on any one however, they have to be learned to be dealt with and lived with. You can not always blame everyone around you for your problems. Thank you for your help in this issue. We plan to cooperate with what ever the city counsil decides and if we can answer any questions please feel to contact us. I have a major complaint. The use of burn barrels have become a very big problem in my neighborhood. I was under the impression that residents were only allowed to burn yard waste. But some of my neighbors are burning their regular trash in their burn barrels. By regular trash, I mean that I have personally witnessed people dropping their plastic trash bags into the burn barrels and burning them. I have also seen on more than one occasion another person bringing their,light-blue trash cans that should be put at the curb for the trash truck to collect,just be set up next to their burn barrel and they have just burned trash all afternoon. The plastics products burn for hours and hours. One of my neighbors that also have objections to the burning of other things other than yard waste, told me he recently witnessed a neighbor put in about a gallon of liquid he at first feared was gasoline into the fire. He said it did not react like gasoline when put in the fire. He said he was not sure if it was car motor oil, cooking oil, or perhaps another substance. Another time, this same neighbor said he heard something he thought was an aerosol can explode in that same neighbor's burn barrel. -My complaint is that this is causing me medical problems which could result in death and it also is effecting my quality of life on my ropes I have Asthma as well as some other allergies that could become life threatening at any moment. I have written my neighbor, Mr. Coppess a letter explaining that his burning regular trash, especially plastic is making me sick. I have explained to him that his burning is making me have Asthma attacks. I told him that I am on several medications for Asthma and that when he burns, I am not only sick, but I also am not able to sleep, and that sometimes I am breaking out in hives after the exposure to the pollutants coming from his yard. I explained that the BREATHING problems are bad enough, but that my face swells up with hives. And at least once I have had to call by doctor during the night at approx. 4:oo in the morning putting him on alert that an ambulance might need to be called because the swelling is getting close to my throat. My husband is not always home so I have to have an Epinephrine injection which.I might need to give to myself if I feel that I might pass out before an ambulance gets to me on time. Some nights after I have been exposed to the trash burning pollutants, and I have an Asthma attack, I get no sleep at all. And I still have to go to work the next day. After Mr. Coppess received my letter he stopped burning during.the day but started again during the night. Then he started to burn when he judged that the wind would not be blowing toward my house. This did not help because when I breath in any amount of whatever the allergen is, I automatically start to have an Asthma attack. I let him know of my medical problems by letter. "Today I told him in person. His answer to me was that he has discussed the burn barrel "issue with the "City" and he was told that he can burn "anything" as long as it is not "plastic." Is this correct? My problem is not only that I am not able to BREATH adequately after I have been exposed to inhaling this polluted air, but also about my QUALITY OF LIFE. I am not able to go outdoors when any of my neighbors are burning the trash that should be put out for the recycling truck and the trash truck. If I see that my neighbor is burning, I pretty much know that I must be a prisoner in my own home until the smoke stops coming out of the burn barrel. And I have to wear a face mask when I arrive home from work if I see that burning is being done, I have to wear a face mask when I bring home groceries because I cannot go outside again, and again while I bring in my groceries. Now that Spring and Summer are on the way I look forward to being outside doing gardening. But last year I would be in the middle of planting Towers or some other outdoor activity,then my neighbor would start burning his trash, and I had to go in the house. I had to close all the windows and turn on the air conditioner whether the TEMPERATURE permitted us to need to use the air conditioner or not. I have spent too long keeping quiet, in the interest of good neighbor relations. But this week I went out and spoke to all the neighbors on my block of my medical problem. I am very concerned about having,to go to the Emergency Room as a result of the pollution. (I only have a problem with the block of houses by my property.) All my neighbors were very pleasant and said they would help me out, with the exception of Mr. Coppess, who told me he was going to continue to burn his trash as long as the "City" allowed him to. He said the other neighbors are burning trash, too. I believe he said he was not burning plastics or trash that could be recycled. I told him I have seen him put his white trash bags in the fire several times. He said he would continue to burn has trash and he would just remove his regular trash from the white trash bag before he came out of his house so I would not see him burning it then. I told him that I have already spoken to everyone else on the block about my medical problem and they said they would help me out. I explained to him that wood or leaves were not causing me any medical problems, it is the plastics and other recyclable and "unrecyclable" items that cause air pollution. He said that his daughter has Diabetes, so he knows about medical problems. I told him that I also have Diabetes, but Diabetes is not the problem I was discussing with him. The problem is that when he burns, I can not BREATH. He said as long as he is allowed to burn he will continue to burn and he does not care about my medical problems. My question to you is this: Are you going to wait until this issue turns into a matter of life or death? Or can you help me out today? When(and it is only a question of "when")I have to go the hospital as a result of the air pollution that is being allowed to go on,who do I complain to?By that point, it will be too late. Dike so many other city residents, I only get paid for working when I can go to work. If I cannot go to work, I cannot buy health insurance. How will you deal with this? It is not fair to me to expect me to deal with not only these medical problems,but also the financial expenses that I have to have as a result of this burning in the City Of Fairfax. I am in the process of gathering information as to what the cost of an Asthma attack Emergency Room visit would cost. Keep in mind that this would involve the cost of the room, doctor, nurses, equipment, medication, etc... In the event that I might need to be admitted into the hospital, keep in mind that the cost of a regular hospital room, doctor fees,nurses, equipment, medications,, etc... will all need to be paid.. All this is very extreme,just because someone refuses to pay$1.00 per trash can. Imagine. I have to go pay thousands and thousands of dollars to the hospital and live daily with an illness that I can control very well if I carry out my doctor's instructions, except for being exposed to this daily household trash burning next to my house. Maybe your fees for the trash collection are too high?But am not having any financial difficulties with paying these fees. It is too bad. But I am going to insist that burning anything in the city be banned because I cannot trust someone to keep the health my family and me in mind. It is too bad that everyone in the whole city has to lose out on burning their leaves just because of one person. But I have to say something because I want to BREATH and I want to enjoy being outdoors just like every one else. I apologize for this letter being so long. But I felt that you might need as many details as possible to address the problem with as much information as possible. It might help you out to know that I am not the only one that is upset about this matter. I believe at least another person on my block also has Asthma. You might have already heard from that family, as well. I do not know if we have the luxury of waiting until the next month's meeting because of my health issues. My next door neighbor has refused to help me out and stop burning his regular household trash. And he has made it clear that he will covertly continue to burn whatever he wants to. As he said to me, he will be more careful about being seen as to what he burns, He said he will disguise the contents of the items the best he can. Another one of my neighbors said he already spoke to someone at the City Hall office. He said he was told to call the Fire Dept, anytime he thought illegal items were being burned. I can do this. But do you really think it will be reasonable for me to be calling the Fire Dept. everyday?Mr. Coppess burns his trash daily, if not he alternates approx. every other day. I would appreciate a letter of response from the City Council to me as soon as possible. I would need someone to take responsibly to address this problem with me by Thursday, March 27, 1997. Due to your trash burning outside, I have been having Asthma attacks. The problem is that your trash burning.is done so close to both doors of my house. I am wondering if at the least,to minimize this medical problem for me, if you would consider moving your burn barrel to another location so the smoke does not blow in the direction of our doors? Up until now,I have been trying to stay indoors when I see that you are burring your trash. I also go indoors if you are just starting to get your fire!going. When I come home and you are burning trash, I have been doing my best to hold my breath all the way from my garage door to my house. When I do not have enough air in my lungs as it is,this a very difficult task for me. And when I come home from grocery shopping, it is horrible, because I have to go outside again,and again. In the interest of good neighbor relations, I have been reluctant about bringing up the issue with you. But my Asthma seems to be getting worse. Sometimes the Asthma attacks are lasting for the entire night. So I am also losing sleep. And I want to avoid a visit to the Emergency Room as long.as possible. I am sure you understand.
