CITY OF FAIRFAK
Mayor Sheely opened the City Council Meeting at 7 : 00 P .M. on
Tuesday June 10 , 1997 . Council present , Stallman, Shakespeare and
Harville , Wainwright arrived at 7 : 25 P.M. Absent Neuhaus .
Stallman made a motion to approve the Agenda, Minutes of the May
Council Meeting, Clerk' s Budget and Financial Reports . Second
Shakespeare . MC.
Motion Stallman to accept the Planning and Zoning recommendations
to approve Karal ' s 2nd Addition to Fairfax, second Harville .MC'.
Dave Neuhaus , Fairfax State Savings , discussed the banks new
building project . He was interested in the street elevations, and
was interested in input from the Council on the parking lot on
Vanderbilt .
Pat Slater , Chair, of USA Days , talked on the project for the day.
Motion Stallman, 2nd Wainwright to approve expenditures of $641 . 33
from the City for USA Days,
Building Permits: Motion Harville , 2nd Stallman to approve
Shakespeare permit for a new building. Ayes, Harville , Stallman and
Wainwright . Shakespeare abstained. MC. Motion Stallman to approve
the permit of Bill McDermont for a new Home on East Cemetery Rd. ,
2nd Harville . MC.
Rita Nierling and Kevin Costigan, representing Prairie Creek
Park, requested funds for a Pavilion, Basketball Court and
playground equipment. Motion Harville to approve the funds for the
Pavilion and Courts , not to exceed $7 , 981 . 32 . Second Shakespeare .
MC.
Sgt . Wm. Mau, Linn County Sheriff , arrived and presented the
monthly report . It was suggested that the Sheriff ' s dept . check on
the parking on Stallman Drive .
American Legion was complaining about the water run off from the
parking lot of the apartments on Vanderbilt Street . Mr . Philipp
will be contacted to attend the July Council Meeting.
Motion Wainwright, 2nd Shakespeare to approve the Cigarette
permit for the Handi Mart . MC. Motion Shakespeare , 2nd Stallman 'to
deny the renewal for the Star Hotel and Livery until after July 1,
when the cigarette machine will have to be removed. They may
reapply to the July Council meeting. MC.
Motion Shakespeare, 2nd Harville to table until the July Council
meeting Resolution 01097 - Airport Zoning Regulations . They will
also appoint 2 members to the Airport Hazard Zoning Board. MC.
Motion Wainwright to approve the bills presented for payment, and
give the Clerk permission to pay any incoming bills before the end
of the Fiscal Year, 2nd Harville . MC.
Motion Shakespeare, 2nd Wainwright to adjourn at 9 : 00 p.m.

The Fairfax City Council on Tuesday June 10, 1997 directed that
you be notified that your Trailer Leasing is an unslightly mess .
When you advised the Council that you were bringing in the Trailers
you stated in your letter of August 20, 1996, that Image was very
important to you. You stated that you would make it an attractive
addition, but you have a camper trailer, old trucks and people
working there without any water or sewer facilities . Also no one is
allowed to live on the premises .
Please be advised that the City will take further action if it is
not cleaned up.

Dear Mayor,
Please allow me an opportunity to introduce myself and give you a little background
on who I am and the purpose of purchasing property in Fairfax. First of all, my name
is Mark Weeks, and I live in St. (Peters, Missouri. My wife's name its Jerene, which she
is a 3rd. grade teacher. We have two children, Collin, which will be 3 in September
and Landon, who just turned 7 weeks this past Monday. In July of 11989 my wife
and l moved to Cedar Rapids, where I opened and developed a new branch for AJF
Leasing ( now called Xtra Lease), located on 66th Ave. S.W. Xtra is a nationwide lessor
of semi-trailers. After 1.5 years of building that branch, they offered me the National
Accounts Sales Manager job, located at their corporate office in St.. Louis. I held this
position for 3.5 years. AfterXtra's CEO and board of directors decided to merge us
and Strick Lease, another nationwide competitor, coupled with the forced resignation
of my president, who had taught me everything about the business, I decided a career
move would be best. Therefore, in December of 1993 at the age of 27, I resigned.
Thus, in January of 1994 1 acquired Trailer Leasing of Iowa (T.L.I.),a small semi-trailer
leasing company located in Cedar Rapids. Now I was competing against not only the
branch that I had developed for Xtra, but too,the individual that:l had trained and left
in charge. T.L.I. during the past 2.5 years has experienced a lot of growth, and too,
we have refurbished and painted a lot of the trailers. Image is important to me and over
the next 18 months I hope to have completed the painting of trailers,that we have been
diligently working on,
In February of this year I contacted your City Hall, and spoke with the clerk regarding any
permits that I might need regardiing doing business within the city limits of Fairfax. I
explained that we buy,sell, rent and lease semi-trailers and that we were currently looking
at some property. The property II thought was for sale, I asked her about it and she commented
that a dance hall used to be located on it and that the ground should be solid and that it was
zoned commercial. Thus, I wound not have to get any conditional permits from the city. Also,
she mentioned that Hilton Truckling with trucks and trailers would be located directly across
from us. She also mentioned that if we were to build any buildings that they would have to
comply with Linn county codes. During our conversation, it was mentioned that it might flood,
but the water will run-off as fast as it rises. After having this conversation, I informed Ed Cassidy
with Erusha Realtors that zoning wasn't a problem and to get me exactly what was for sale.
He later notified me and infon-ned me that we had walked over and looked at the wrong ground.
The property that was actually for sale was located next to it and it took in a lot of the creek.
Thus, everything with respect to buying land in Fairfax was cancelled. A couple of months
passed, and I continued to ask our landlord R.J. MitValsky about how close the City of Cedar
Rapids was to acquiring his downtown property, which we rented,to park our unrented
equipment. He informed me that the city had made him an offer and that his nephew, an
attorney was working out the negotiations. Within a few days of my conversation with Mr.
Mitvalsky, Ed Cassidy called about a 1 acre spot located in Fairfax, next to the land we had
walked over and looked at. We arranged a meeting to look at this(property, which was being

listed by Smith Realtors. Knowing that the property we had been using in downtown Cedar
Rapids was going to be a parking lot for MCI and others, I decided to buy the 1 acre of
commercially zoned ground.
Betty, from your city hall called ime on Monday asking about what we were doing, and
explained that I was the individual that had called earlier in the year with regards to renting
and leasing semi-trailers and thhat we did purchase the ground. She gave me the names of
two board members and their;phone numbers. I did speak with Alisha and addressed some
concerns she had and later that evening I spoke with Jack regarding any concerns or questions
he had. My goal is not to disrupt any community or irritate anyone,, but to build a nice quality
company with a nice looking location. As I mentioned to Jack,we do not have and will not
have refrigerated units running at nighttime. This was a concern of his. Also, I mentioned
to Alisha that we can plant some trees across the creek side that will help with her view.
I know you weren't expecting such a lengthy introduction, but I appreciate your indulgence.

Tuesday, June 10 , 1997 the Fairfax City Council denied your
request for renewal of your Cigarette Permit. The new state law
requires that you remove the cigarette vending machine on July 1st .
When the machine is removed you may request your permit to be
renewed at the July 8th Council meeting.
