Mayor Sheely called the Fairfax City Council meeting to order at
7 : 04 p .m. , Tuesday October 14 , 1997 . Council present Neuhaus ,
Wainwright, Harville and Shakespeare . Absent Stallman.
Motion by Neuhaus to approve the Agenda , Minutes of the September
Council meeting, Clerk' s Budget and Financial Report, 2nd Harville .
MC.
Building Permits : Motion to approve the permit for Carrie ,
Halfhill to add a deck to the rear of thier residence by Neuhaus,
2nd Shakespeare . MC. Motion by Neuhaus to approve the permit by
Rosemary Rosdail for an addition to her house , 2nd Wainwright . MC.
Discussion with Mike Singer and Gordon. Sevig about the Sevig
proposed sub division . Mike discussed the possibility of a T . T .F.
district . Mike and Gordon will be at the November Council meeting
to discuss the division more . The meeting will start at 6 : 00 p .m.
Motion by Neuhaus , 2nd Harville to table the Union Pacific
request for a Flood Plain Permit until the November meeting , 3
ayes , 1 nay.
RESOLUTION 101497 A - Animal Control, Motion by Shakespeare , 2nd
Neuhaus to approve the Resolution. MC.
Motion by Neuhaus , 2nd Wainwright to approve the Linn County
Secondary Road Agreement . MC.
Maintenance Report : A letter will be sent to George Hahn about
the removal of the dirt from the ditch west of his driveway. The
City will look at getting a letter delivered about Junk Vehicles .
Motion by Shakespeare , 2nd Wainwright to approve maintenance man
Lud Svoboda to attend Iowa Water Pollution Control Meeting on
October 29th . Lud will also go for his Commercial Applicators
License School on November 12 and 13 . MC' ,
Alisa Shakespeare was given the go ahead to order Banners to put
up in the City of Fairfax .
Motion by Neuhaus , 2nd Shakespeare to sign the Abstinence
Awareness Week Resolution. MC.
Motion by Wainwright , 2nd Harville to approve the bills presented
for payment . MC.
Motion by Harville , 2nd Neuhaus to adjourn at 9 : 05 p . m,

Junk vehicles parked along your garage . The City Ordinance
prohibits parking Junk Vehicles and parts in your yard.
This is to notify you that you have thirty (30 ) days from the
days from the date this letter is delivered to remove the Vehicles
or on the 31st day the City will remove them at the owners expense .

RESOLUTION NO. t(JUI
WHEREAS, the City of Fairfax , Iowa, desires to establish policy
for Animal Control, within the City of Fairfax ,
NOW THEREFORE, be it resolved by the City Council of Fairfax,
Iowa as follows :
It shall be the policy of the City of Fairfax that any resident
wishing to make a, complaint concerning an animal within the City
limits shall first contact a member of the Fairfx City Council or
the Mayor or City Clerk and may request that the city official
contact the city' s animal control officer to investigate and/or
handle the complaint; provided, however, that in the event of an
emergency incident after regular business hours , which incident
requires immediate attention by the city' s animal control officer,
a resident may directly contact the city' s animal control officer
to request emergency assistance . The city' s current animal control
officer is Cedar Valley Humane Society. It shall be within the
discretion of the city' s animal control officer to determine
whether the incident requires an emergency response .
This resolution shall be effective upon its passage and
approval and in accordance with the law.

PROCLAMATION
Whereas Research indicates that high risk behaviors such as illegal drug
use, alcohol use and pre-marital sexual involvement negatively
impact families and communities, and
Whereas There are more than 20 sexually transmitted diseases that can shatter
the health of sexually-active youth, resulting in long-term consequences
(e.g. pain, infertility, cancer and death), prompting federral Centers for
Disease Control and Prevention to spend over$106 million per year
to fight sexually transmitted diseases other than AIDS, and
Whereas Our children live in a sex-saturated culture where 4064 teenage girls
in Iowa had babies in 1995 and 225 of those babies were born in Linn
county, it behooves parents and adult role models to teach children
how to say"'no"to pre-marital sex and how to build friendships
without sexual involvement,and
Whereas Knowing the benefits of sexual pre-marital abstinence empowers teens
to develop and build healthy dating relationships that respect the power
of sexuality and foster self-control, and
Whereas Our young people are the future of our nation and the decisions they
make and the actions they take will affect our families, our communities,
and our whole society for generations to come,and
Whereas Adults Concerned for Teens has taken the character-based, abstinence-
only message to many communities since 1992,and will take this
message to twelve school communities in 1997 to educate young people
about the moral dimensions of sexual conduct and to give them a vision
of the benefits

The meeting of the Fairfax Planning and Zoning Commission opened
at 7 . 05 p.m. by Chairman Protem, Kenneth Selzer . Commission members
present Harry Stallman, Larry McNeal and Dean Hartman. Absent Dan
Shakespeare , Terry Johnson and Dennis Heintz .
The proposed adendum, to the Comprehensive Plan and Land 'Use
Recommendations was presented by Chad Sands from ECIGOG. The
meeting was opened to a public hearing . Several questions were
asked about the plan and answers were provided. The public hearing
was closed at 7 : 20: p.m. Motion by McNeal -to recommend approval to
the City. Council , 2nd by Stallman, Carried 4 ayes .
The second item, was the consideration of an application for
Special Exception 'Permit by Elysia Bahr to house a Nursery/Day
Care/Preschool in the former Methodist Church. Because no notice of
zoning change was posted no action could, be taken.

LINN COUNTY SECONDARY ROAD DEPARTMENT

AGREEMENT FOR WINTER SNOW AND ICE CONTROL
1997-1998
WHEREAS, for the benefit of the traveling public and for the mutual benefit of the Lin n
County Secondary Road Department and the City of Fairfax, Iowa, and
WHEREAS, to as effectively as possible deal with the common problem of snow removal
and icy conditions on road and/or street surfaces during winter storms, and to maintain a
reasonably safe flow of traffic.
THEREFORE, Linn County, Iowa and the City of Fairfax, Iowa herewith enter into
agreement for snow plowing and/or spreading of abrasives and/or chemicals on those secondary
road extensions, into the incorporated areas of said City, as listed herein and under the provisions
hereinafter stated,
1. The County will provide materials, men and equipment to assist said City in snow plowing
and spreading of abrasives and/or chemicals on the fallowing routes.
County will plow and treat 80th street.
County will plow and treat Southview
West of Hwy. 151 .
County will treat West Cemetery from
Longview Drive to Morgan Bridge Rd.
2. The County will perform this work during its regular work on the secondary road as it
enters and leaves the corporate limits of said City.
3. The use of abrasives and/or chemicals in any quantity will be controlled by the County on
the basis of the availability of these materials.
4. The City of Fairfax, Iowa, agrees to pay to the Linn County Secondary Road Fund an
amount of$30.00 per storm for the initial plowing and//or spreading for each storm on
the routes stated in paragraph 1.
g. Any requests for additional plowing or applications of materials on this routes within the
incorporated area will be considered only after the County has completed its regularly
scheduled work outside of the incorporated area.
6. The City of Fairfax, Iowa agrees to reimburse the Linn County Road Department for the
expenses incurred in performing the work in paragraph 5 according to the following
schedule.
a) All material costs shall be at the same current rate as charged to the County.
b) Truck plow and/or sander plus operator, $30.00 per hour
