Bills presented for payment . 18 . Opportunity for citizens not on the agenda . 19 . Adjournment. CITY OF FAIRF"AX The Fairfax City Council met on Tuesday November 11 , 1997 . Mayor Pro Tem Neuhaus called the meeting to order at 6 : 07 P .M, Council present - Stallman, Harville . Mayor Sheely arrived at 6 : 20 P ,M . Shakespeare arrived at 6 : 50 P . M. , and Wainwright arrived at 7 : 02 P . M . Stallman made a motion to approve the agenda , minutes of the October meeting, budget and financial reports . 2nd Harville . MC. Mike Singer , Hart Frederick Consultants , discussed Sevig Sub Division and T. I . F . districts . The clerk will draft a note stating that the council is in favor of Mr . Sevig to proceed with the annexation and his sub division plans , and to explore T . I . F. as a means to support community growth and Mr . Sevig ' s sub division. Stallman made a motion to table the Flood Plain Permit for the Union Pacific until the Board of Review makes its final decision. 2nd Neuhaus . MC. Building Permits: Wainwright made a motion to approve the permit for Fairfax State Savings Bank, 2nd Shakespeare . Motion Neuhaus to approve the permit for a garage for Craig Nelson, 2nd Stallman. Stallman moved to approve the permit for Stan Moore, to add a 2nd story and roof to his building. 2nd Neuhaus . Neuhaus moved to approve the permit for the Star Saloon, Inc, for alterations to the Star , 2nd Wainwright . All motions carried . Planned Unit Development will be referred back to Planning and Zoning for their recommendations and a Public Hearing. Mr . & Mrs . Ostrenga were present to discuss a burning ban in Fairfax . The clerk was to have an amended Ordinance drawn up for the December Council Meeting . Public Hearing on the Comphrensive Addendum was opened at 8 : 26 p. m, no comment from the floor , public hearing closed at 8: 27 p . m. Motion Wainwright to approve Resolution 111197 - Approving and Adopting the 1997 Addendum to the Fairfax , Iowa Comprehensive Plan and Land Use Recommendations 1989 . 2nd Neuhaus . MC , Motion Wainwright to approve the Liquor License for the Star Saloon, Inc . 2nd Shakespeare . MC , Motion Neuhaus , 2nd Stallman to approve the Liquor License renewal for the American Legion. MC . Maintenance Report : Motion Neuhaus , 2nd Harville to approve Lud ' s attendance at the IAMU Meeting , MC. Discussed purchasing tire chains , and having the South Well pump checked . Motion Shakespeare , 2nd Stallman to approve the appointment of Cindy Divishek as the Children ' s Librarian, and Lisa Meyers as the new board member to finish out the term of Steve Meyer . MC. Motion Shakespeare , 2nd Harville to approve the appointment. of Brian Beaty to the Fairfax Fire Department . MC. Motion Shakespeare , 2nd Neuhaus to appoint Marianne Wainwra gbt. as a candidate to the Bluestem Board . MC'.. Shakespeare made a motion, 2nd Stallman to allow Mark Neuhaus to put a dumpster at his business and remove his garbage fee from the utility bill . MC . Motion Neuhaus, 2nd Harville to approve the bills presented for payment . MC. D . C . Neuhaus , Fairfax State Savings Bank, delivered at letter to the Mayor and Council thanking the City Employees for their help during and in the weeks and months prior to removing the Old Bank building. Sheely, Mayor Betty ' Panek, City Clerk +I1F I RESOLUTION NO. 1.111-9 7 A RESOLUTION APPROVING AND ADOPTING THE 1997 ADDENDUM TO THE FAIRFAX,, IOWA, COMPREHENSIVE PLAN AND LAND USE REC'ONNIENDATIONS 1989 WHEREAS, the City Council of the City of Fairfax, Iowa, has deerned it appropriate to update the City's 1989 Comprehensive Plan and Land Use Recommendations to assist in the coordination of future development activities and to provide for the general health, Ai safety, and welfare of the City, and WHEREAS, the City Council has engaged the services of the East Central Iowa Council of Governments to assist the City of Fairfax Planning and Zoning Commission with the preparation of this Addendum" and WHEREAS, the 1997 Aclderrclum to the Fuijf tx, loira, Comlrrehen ivc Plan utrd Lt id U,se Reconnnetrdcttion.s 1989 is acceptable to the City of Fairfax Planning and Zoning Commission and has been so recommended to the City Council for adoption after public hearing; l NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Fairfax, Iowa, does hereby approve the 1997 Addendum to the Fairfcrr, loivct, ('ol rprehensive Plata crud Land Use Recorr merrdatioras 1989 and adapts said plan to be used in conjunction with the Fcth far, Iowa, Comprehensive Plats atad Laml(Ise Recommendations 1989 as the official Plan for the City of Fairfax, Iowa. Adjournment. f Minutes of the meeting of the Fairfax Planning and Zoning Commission, October 21, 1997 at 7:00 p.m. Present: ]Larry McNiel, Dean Hartman, Harry Stallman, Kenneth ' Selzer, and Terry Johnson., chair The first item of consideration was the request from the Union Pacific Railroad Company for a special use permit (see the attached document). After presentations by railroad representatives, the city attorney, and the city engineer a motion was made by Hartman, seconded by Stallman to approve the request with the following stipulations: 1. That the railroad install an elevated pedestrian walkway over the UP railroad tracks in the Vanderbilt Street area and 2. That the railroad install a casing(s) under the proposed siding at the time of construction to provide access for Fairfax sewer lines in the future. The city engineer would determine the specifications for this casing. The motion passed 4-0. The second item was the consideration of a request from Rlysia Bahr to rezone the property described in the attached document from CP to RS. She is also requesting' that she be granted a speciia.l use permit to operate a day care in the facility. A motion was made by Selzer and seconded by Stallman to approve the rezoning. Thee motion passed 5-0. A motion was made by McNiel and seconded by Stallman to approve the special use permit request. That motion passed 5-0.
