Bills presented for payment. Pay Mayor, Council , & Firemen. 14. Adjournment . CITY OF FAIRFAX Mayor Sheely opened the Fairfax City Council meeting at 7 : 04 p.m. on Tuesday December 9 , 1997 . Council present Stallman, Shakespeare and Wainwright . Absent Harville . Stallman moved the approval of the agenda, minutes of the November Council meeting, Clerk' s Budget and Financial Reports . MC . Councilmen Neuhaus arrived at 7 : 15 p .m. Sgt Carol Currans presented the Linn County Sheriff ' s report , and stated that things were pretty quiet last month. Mike Singer, Hart Frederick Consultants, Gordon Sevig and Robert Boland presented an update on the Sevi,g Sub division, Mr . Boland represents LoRoCo, Ltd . , as the adjoining land owner . Plans will continue for the annexation of the land for the sub division. Motion Stallman, 2nd Wainwright to have Hart Frederick' s to install the Metering device on the Lagoons . MC , Rich Stephens , Linn County Health Department , discussed the burning concerns in Fairfax . Petitions were presented from Fairfax residents in favor, of burning. Motion Neuhaus to retain Fairfax Burning Ordinance , 2nd Stallman. Aye - Neuhaus , Stallman, Nay Shakespeare and Wainwright . The Burning issue will be placed on the January Agenda . Complaint filed by Darren and Cheryl Coppess on yard waste piled against the fence by the neighbors , and the neighbors trees and bushes growing on their property. Motion by Neuhaus , 2nd Stallman that a certified letter be sent to Mr . & Mrs . Ostrenga to remove the Yard waste from the property within thirty ( 30 ) days of the notice , or the City will clean it up at the owners expense . Ayes, Neuhaus , Stallman, and Wainwright . Nay Shakespeare . MC , Planned Unit Development - Motion Shakespeare to approve PUD, 2nd Wainwright , Vote Ayes , Shakespeare , Wainwright and Stallman , Nay Neuhaus . Due to Planning and Zoning not recommending passage , three - fourths of the City Council would have to approve the motion. Motion denied. Motion Wainwright to approve the Flood Plain Permit for the Union Pacific, 2nd Shakespeare . 4 Nays . Permit denied . New Mayor, and the three new Council members were sworn in , Fire Department - Motion Neuhaus , 2nd Shakespeare to reappoint Mike Sankot to a two year term as Fire Chief . 3 Ayes , Stallman abstained. Council gave permission to appoint Rob Casper to the Fire Department . Bill Barry requested that all home owners put 6" numbers on their homes so the Fire Department will be able to respond quicker when they are called . Maintenance Report : Motion Shakespeare, 2nd Neuhaus to trim and shape the 4 trees on Vanderbilt and Church Street . MC , Outgoing Mayor Sheely wished the new Mayor and Council Good Luck in the up coming year . Motion Neuhaus , 2nd Stallman to pay bills presented for payment . MC . Wainwright made a motion to adjourn, 2nd Neuhaus . Meeting adjourned at 9 : 10 p . m. Mark E .
