Opportunity for Citizens not on the Agenda . 16 . Bills presented for payment. 17 , Adjournment . Fairfax Council Meeting February 10 , 1998 Mayor Stallman called the meeting to order at 7 : 00 P . M. Council in attendance , Beer, Harville, Stockton and Wainwright . Absent Shakespeare . Members of Planning and Zoning in attendance , Hartman, Heintz , Selzer and H. Stallman. Liz Jacobi , City Atty. , and Dick Ransom, City Engineer . Motion by Stockton, 2nd Harville to approve the Agenda, Minutes of January 13th meeting, Clerk' s Budget and Financial Report. MC. Vernon Cerveny, Fairfax Arbor Team, reported that F .A, T. had received a Grant of $1, 000 from Trees Forever and TES . The Grant must be matched by Fairfax Arbor Team, a Pancake Breakfast is scheduled for Sunday March 15 , 1998 . Motion by Wainwright to give F.A. T . $250 , 2nd Beer . MC, Frank Scott , Prairie Raodbuilders , presented a proposal for Seal Coating of the City Streets . Motion by Beer , 2nd Harville to accept Prairie Roadbuilders Proposal . MC , Liz Jacobi gave an update on the on the Union Pacific Railroad Spur . The UP has received all the permits from the DNR . Dick Ransom presented the Vanderbilt Street Project . Motion by Stockton, 2nd Wainwright , to approve RESOLUTION 98-02-10 , RESOLUTION PLACING PLANS, SPECIFICATION'S, FORM OF CONTRACT AND ESTIMATED COST ON FIIE AND DIRECT THE PUBLICATION OF THE NOTICE TO BIDDERS AND SET UP, 'THE PUBLIC HEARING. MC . Doug Fredrick and Chris Townsend, Hart-Fredrick Consultants- and Gordon Sevig, were present to discuss some of the questions from Planning and Zoning members . Motion by Harville , 2nd Wainwright to set up a committee to work with Mr . Sevig and Hart-Fredrick . Appointed were Dick Ransom , City Engr. , Cory Stockton, Marianne Wainwright , Council -•- Ken Selzer , Harry Stallman, P&Z , and City Clerk Betty Panek. MC. Sgt . Carol Curran, Linn Co , Sheriff ' s Dept . , discussed the list of calls . They will be checking on illegal parking , abandoned vehicles left on streets . ORDINANCE 211 - AN ORDINANCE AMENDING TITLE 3 , CHAPTER 4 , SECTION . 0105 OF THE CODE OF FAIRFAX , IOWA. Motion by Stockton, 2nd Wainwright to approve Ordinance 211 , MC. Stockton moved the approval of the Ordinance on its first reading and that the procedural requirements as set forth in section 380 . 3 , Code of Iowa, be suspended as provided for , and that the Ordinance 211 be placed on its second and third readings by its Title , 2nd Beer „ MC, Motion Beer , 2nd 'Wainwright to send Lud to Water Operators Safety Class , Wednesday March 18 , 1998 . MC . Discussion on PUD, Chad Sands , ECIGOG will be asked to attend the March Council Meeting. Motion by Harville , 2nd Beer to approve the bills presented for payment . MC . Motion Stockton, 2nd Wainwright to adjourn at 8 : 40 P . M. Mayor Stallman reconvened the meeting "to discuss setting a Public Hearing for the 98/99 Fiscal. Budget . AN ORDINANCE AMENDING TITLE 3, CHAPTER 4, SECTION 0105 OF THE CODE OF ORDINANCES OF THE CITY OF FAIRF'AX, IOWA BE IT ENACTED by the City Council of the City of Fairfax, Iowa:' SECTION 1. SECTION MODIFIED: Title 3, Chapter 4, Section 0105 of the Code of Ordinances of the City of Fairfax, Iowa is modified by including the following to the original ordinance: Open burning will be allowed providing the additional following conditions are met and maintained: 7. Burning shall be conducted during the hours of one half hour after sunrise until one half hour before sunset; 8. Burning shall be conducted in a container or barrel which has a one inch spaced wire,, grate or other suitable spark arresting device for the control of wind blown materials. SECTION 2, SEVERABII,ITY CLAUSE, If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. SECTION 3, WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law. ADOPTED this 10th day of February, 1998.
