Fairfax Council Meeting
April. 14 , 1998
The Council met at 6 : 00 p. m. for a work session with the City
Attorney and City Engineer to discuss Fairfax Heights Sub division.
Mayor Stallman opened the regular council meeting at 7 : 00 p .m.
Council present - ,Beer , Shakespeare, Stockton and Wainwright .
Absent Harville .
Beer made the motion to approve the Agenda, Minutes of the March
10th meeting, Clerk' s Budget and Financial Reports . 2nd
Shakespeare . MC.
Building Permits : Motion Shakespeare , 2nd Wainwright to approve
the permit for Lance Quigley for a garage .
Motion Stockton, 2nd -Shakespeare to approve Randy Price permit for
a screened porch. Motion Shakespeare , 2nd Beer to approve storage
building for Robert Hudson. Motion Stockton, 2nd Shakespeare to
approve Beverly Reiner.t ' s permit for a screened porch. Motion
Stockton, 2nd Wainwright to approve Dennis Novak' s permit for a
Storage/Shop addition to garage . All motions passed.
Motion Stockton, 2nd Shakespeare to approve the Fairfax Baseball
Beer permit . MC.
Mayor Stallman opened the public hearing on Bill Gibney' s
rezoning request at 7 :07 p. m. Discussion on the size of buildings,
water, sewer and traffic. A Petition from neighbors was placed on
file . Public hearing closed at 7 : 25 p.m. Motion by Stockton, 2nd
Beer to table the request until a detailed plat of the development
was presented. MC.
Wainwright moved to grant applicants , Joe Zalesky and Bud
Burger , temporary access from Burger Lane, along Railroad Street to
the . proposed 8-plex site , on the condition that before occupancy,
the road will be hardsurfaced according to City specifications and
at the applicants expense , 2nd Shakespeare . MC .
Motion Wainwright, 2nd Stockton to approve the Building permit
for Zalesky/Burger for an 8-plex . MC.
Sgt Carol Curran delivered the Sheriff ' s report , 44 calls for
the month.
Fairfax Heights Sub Division - Mike Singer , Jon McCright,
developers attorney,, and Gordon Sevig were on hand to answer
questions and discuss the sub division. Items discussed were storm
water runoff , easment changes , the Developers Agreement , T . I . F . it
was deceided that there would be a special meeting on April 21st at
6 : 00 p .m. , to work on the Sub Division.
ORDINANCE 212 - Amending zoning Ordinance adopting Planned Unit
Development (PUD) District . Motion Wainwright to approve Ordinance
212 on its first reading. 2nd Beer . MC.
RESOLUTION 98-4-14, Designation Local Option Sales Tax . Motion
Stockton, 2nd Shakespeare to approve the designations as Street
Improvments , Water and Sewer Improvments and Water Tower . MC.
RESOLUTION 98-4-1.4-1 , Setting Salaries for appointed employees .
Motion Beer to approve the Resolution, 2nd Shakespeare . MC .
Library - Board Chairman Cerveny said there would be a coffee on
Saturday April 18th at 9 : 00 a.m. to honor Don Young on his
retirement from the Library Board .
Fire Chief Sankot reported that quotes have been sent out for
new Fire Truck and bids will be opened in. May.
Maintenance : City wide Clean up days will be Saturday May 30th.
Motion Wainwright, 2nd Shakespeare to send L,ud to AWWA - Water &
Wastewater Operator - Short Courses . MC . Sidewalk from the parking
to the Pavillion at Prairie Creek will be installed, also a
Volleyball court . Article will be placed in the newsletter to
address the problems of people letting their dogs run in the parks .
Discussed were the new street lights on Vanderbilt St . and a
Peddlers Ordinance . More information will be brought to the May
meeting.

CITY OF FAIR FAX
RESOLUTION NO, 98-4-14
A resolut ion. designating the percentage (or amounts ) of Local Sales
and Services Tax revenues to be devoted to property tax relief in
the event such--tax is imposed in the City of Fairfax. , and
designating the proposed use of the remainder of such revenues ,
WHEREAS , pursuant to the request of the council of the City of
Cedar Rapids , Iowa, an election will be held throughout Linn County
on June 23 , 1998 , upon the question of the imposition of a local
sales and services tax in the incorporated and unincorporated areas
of Linn County; and
WHEREAS, the legislation authorizing imposition of the tax
also allows of jurindintions were in the tax would be imposed to
individually designate what percentage or amount of local sales and.
services tax revenues each will devote to property tax relief , and,
what uses it will put the remainder of said tax revenuo to; and
WHEREAS , thi City Council has beon advised and does believe
that it would bo in Lbe best interests of this City to m,-ake a
designation as to property tax relief and use of remaining local
sales and servicos tax revenues ,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF FAIRFAX, IOWA ,-
That revenues from a local sales and services tax which may be
imposed it) this City oia and as of October 1 , 1998 , shall be.
allocated as follows :
1 . 0% for property tax relief .
2 . The specific purposes for which the revenues shall.
otherwise be expended are : Street improvement , Sew :- Unrovefyflent-15
and Water Tower and water' improvements .
AND BE IT FURTHER RESOLVED
That the City Clerk be and is hereby instructed to deliver this
Resolution to the Linn County Commissioner of Blectioas withoot
delay.

A RESOLUTION SETTING THE SALARIES FOR APPOINTED EMPLOYEES OF THE
CITY OF FAIRFAX FOR 'THE FISCAL YEAR OF 1998\1999 .
BE IT RESOLVED BY THE CITY COUNCIL OF FAIRFAX, IOWA:
Section 1 . The following positions named shall be paid the
Salaries or Wages indicated and the City Clerk is
authorized to issue checks , less legally required
or authorized deductions from the amounts set out
below, and make such contributions to IPER' S, FICA,
and other purposes as required by law, or order of
the City Council , all subject to audit and/or review
by the City Council.
CITY CLERK: $9 . 56 per hour M,T,W, & F ( 32 Office Hours
4 Non Office Hours . )
LIBRARIAN: $8. 50 per hour @ 26 Hrs . per wk.
CHILDRENS LIBRARIAN: $5 . 78 @ 11 Hrs . per wk.
SATURDAY HELP: $5 . 63 @ 5 Hrs . per wk.
MAINTENANCE MEN: $11. 49 per Hour 40 Hours per week
Section 2 . OVERTIME: Any time over the regular hours shall be
taken off on another day as regular time .
Section 3 . The City shall provide the City Clerk and Maintenance
Men with Blue Cross\Blue Shield Insurance . The City
shall be responsible for the $500 . 00 deductible .
( SINGLE POLICY ONLY. )
Section 4 . The Clerk and Maintenance Men shall be paid for the
following Holidays : NEW YEAR ' S DAY, GOOD FRIDAY,
MEMORIAL DAY, 4TH OF JULY, LABOR DAY, THANKSGIVING, DAY
AFTER THANKSGIVING, CHRISTMAS EVE DAY AND CHRISTMAS.
Section 5 . The Clerk and Maintenance Men shall be allowed 4 sick
days per year. The Sick days may be accumulated up to
Thirty (30 ) days . They shall be allowed three ( 3 )
Bereavement Days per year for immediate family members
only. (Spouse , Children, Parents, Brothers, Sisters,
and in laws . ) They may not be carried over . They shall
be allowed two ( 2 ) Personal Days per year. Personal
Days may not be accumulated. After using five ( 5 )
consecutive sick days , at the discreation of the Mayor,
a docktor ' s verification may be requested.
Section 6 . Vaction Schedule : 40 hours after one year , 80 hours
after three years , and 120 hours after seven years .
