MAY 27 , 1998
Mayor Stallman called the meeting to order at 3 : 03 p . m. , with
Council members Harville , Shakespeare and wainwright . Absent Beer
and Stockton.
Development Agreement for Fairfax Heights Subdivision. Bob
Boland brought his questions and concerns to the Council . Motion to
enter into a Development Agreement with Gordon Sevig, as amended on
May 27 , 1998 , by Wainwright , 2nd Shakespeare . 3 Ayes , 2 absent , MC.
Copies of Robert Boland and Harold McCormick questions and concerns
will be placed on file with these minutes .
Mayor Stallman opened the Public Hearing on LoRoCo , Ltd . , and
Sevig Annexations at 3 : 50 p. m. Mr . Boland expressed his concerns ,
Mayor Stallman closed the public hearing at 3 ; 58 p .m. Motion by
Harville , 2nd Shakespeare to approve Resolution 98-5-27-3 , LORoCo,
Ltd request for annexation. 3 Ayes . Motion Shakespeare , 2nd
Wainwright to approve Resolution 98-5-27-2 , Gordon Sevig
Annexation. 3 Ayes .
Discussion on Street Surfaces , Crosswalks , and .Engineering
Services were to be put on the June 9th Agenda .
Kari Raiche , Asst , Director of Linn County Department of
Planning and Development presented to the Council what they would
need to do to enter, into a 28 E Agreement on Building Pemrits and
Building Inspections .
Harville made a motion to adjourn at 5 : 00 p . m. , second
Shakespeare . Aye .

Dear Mayor and Council :
I am writing to express my concern over the potential dama,5 to my
farmland due to increased runoff from the proposed Sevig Development ,
I am also concezned about potential soil erosion from the developmenL
site causing sediment damage to my lan&
Therefore , I am requesting that Lhe City of Fairfax impose the
following conditions, before the final plat is approved for this
development :
1 . The proposed stormwatez detention basin shall be designed and
constucted to meet the standards and specifications found in the
Cedar Rapids Metropolitan Area Engineering Design StandarK
manual . In addition, the outlet structuxe shon1d be designed to
cause detention of stormwater from a two year , 24 hour rain .
DeAgns should be reviewed by the Linn County Soil and Water
Conservation District
2 ® An erosion and sediment control plan needs to be prepared and
followed to keep sediment from damaging neighboring properWes .
Plans should be :re' iewe by the Linn County Soil and Water
Conservation District
3 . The City of Fairfax needs to assume all responsibiliLy for future
maintenance of the stormwater detention basin .

WHEREAS , Robert & Lois Boland, LoRoCo, Ltd. Owners of the following
described property:
The West 1/2 of the NW 1/4 of Section 10 , 'Township 82, North Range
8 West of the 5th P .M. , in Linn County, Iowa, lying South of State
Highway No. 151 .
did make application dated January 12 , 1998 for the annexation of
said property to the City of Fairfax, Iowa.
WHEREAS, it appears desirable and in the best interest of the City
of Fairfax, that said property referred to in said application be
annexed to the City of Fairfax , at this time, now therefore :
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRFAX , IOWA:
that the property herein before described, and the same is hereby
annexed to the City of Fairfax, Iowa, in the manner provided in
Section 368 . 7 , Code of Iowa, 1983 , and such property shall
hereinafter be and become part of the City of Fairfax, Iowa.
BE IT FURTHER RESOLVED, that the City Clerk be authorized and
directed to file a certified copy of this resolution, together with
the application of the owners , with the Linn County Recorder and
thereafter to be filed with the Linn County Auditor .

owners of the property described in Exhibit "A" (attached). We are requesting voluntary
annexation of this property to the City of Fairfax.
Upon annexation to the City of Fairfax this property will continue to be used for agricultural
purposes. I will be requesting appropriate zoning of this property to allow this use.
.Attached to this letter is an Annexation Plat showing this property and its relation to the City
of Fairfax.
