Fairfax City Council Meeting
July 14, 1998
Mayor Stallman opened the meeting at 7 : 00 p .m. Council present ,
Beer , Harville , Shakespeare , Stockton and Wainwright . In attendance
City Attorney, Liz Jacobi and City Engineer Dick Ransom.
Motion by Beer to approve the Agenda, Minutes of the June 9,th
Council Meeting, Clerk' s Budget and Financial Reports . MC.
Linn Co Sheriff ' s deputy presented the list of calls . Some
vandalism was reported at the Elevator .
Vernon Cerveny was present , with John Hughes , requesting
premission for John to do 100 Hours of work for his Eagle Scout
Badge . Several, ideas were presented and Vernon will go over them
with John. Vernon will get some quotes on bulldozing the scrub
trees down at Prairie Creek Park. Vernon reported that F .A.T. had
planted 9 new trees .
Building Premits: Motion Stockton, 2nd Shakespeare to approve
the permit for Jeff & Julie Freeze for a new deck and screened
in area around part of it . MC. Motion Wainwright, 2nd Shakespeare
to approve the permit for Joseph & Roxanne Blood to erect a
Swimming Pool . MC..
Discussion with Ron Hilton regarding the permit for a car wash
on Hwy 151 . Concerns were expressed that the drainage issue was not
answered, and Ron was advised to contact the property owner to the
South and work on an equitable solution to the problem.
Mayor Stallman opened the Public Hearing on the Rezoning
Application of Joseph & Roxanne Blood at 7 : 44 p.m. No objections
the public hearing was closed at 7 : 50 p . m. Motion by Wainwright ,
2nd Stockton to approve the rezoning at 60 E . Cemetery Rd. from
44RS to C-2 Arterial Commercial . MC.
Fairfax Heights Sub Division: Mike Hart presented the revision
of the Preliminary Plat. The only changes being in the Storm Water
Detention Basin. Stockton moved to approve the revised Preliminary
Plat subject to the developer retaining duty of the maintenance on
the Storm Water Detention Basin, until 70% of the construction on
all lots has been completed. Plus the conditions recommended in
Dick Ransom' s letter of June 18 , 1998 . Beer seconded the motion.

ORDINANCE 214 Well Protection , was submitted and placed on file
to be acted on at the August Council meeting . Motion by Wainwright ,
2nd by Stockton, to designate Mayor Stallman to receive , review and
acknowledge any and all schedules received for Well and Water Tower
Project . MC.
Jeff Vance was asked to attend the Council meeting to clear the
air about all of the rumors that have been going around.
Motion by Beer , 2nd Harville to approve the Service Agreement
with ECIGOG for the revisions on the Zoning code . MC. ECIGOG will
be asked to also look at our Comphresive Plan to make sure that the
Comp Plan and Zoning do not conflict.
City Engineer will look into the drainage problem on Seipman and
Main, and at the ditch along E . Southview. A letter will be sent
about the Barking Dog Complaint .
Pat Slater gave a recap on USA Days and requested $679 . 60 from

the City. Motion by Stockton, 2nd Beer to approve the, payment. MC.

Librian and Fire Chief gave their reports .
Maintenance Report : Motion Stockton to have Alliant Utilities
install the electricity to the Lagoon to hook up the monitoring
meters , 2nd Shakespeare . We will not undercoat the pickup. Motion
Harville , 2nd Beer to approve Prairie Roadbuilders work list with
some additions . MC..
ORDINANCE 215 - Adopting Official Rezoning Map. Motion
Shakespeare, 2nd Stockton to approve Ordinance 215 on its first
reading. Stockton moved the approval of the Ordinance on its First
Reading and that the Procedural Requirements as setforth in Section
380 . 3 , Code of Iowa, be suspended as provided for in that Section,
and that the Ordinance be placed on its second and third readings
by its Title . Second Beer . Mayor Stallman declared the Ordinance in
effect upon posting' the Ordinance .
Motion Beer to remit Partial Payment #1 to Cedar Valley Asphalt
for the work on Vanderbilt Street , 2nd Shakespeare . Ayes Beer ,
Harville , Stockton and Shakespeare. Wainwright Abstained. Change
order will be presented in August .
Ken Selzer discussed Linn Housing Council. The following were
appointed to the committee, Ken Selzer, Dave Neuhaus, 3o Ann Beer ,
Marianne Wainwright , Brian Stallman and Harry Stallman.
Stockton made a motion to approve bills presented for payment ,
2nd Harville . MC'.
Motion by Wainwright, 2nd Stockton to adjourn at 10 : 10 p.m..

Meeting of the Fairfax Planning and Zoning Board June 18 , 1998
at 7 : 00 p.m. Present : Terry Johnson, Kenny Selzer , Harry Stallman,,
Dan Shakespeare and Dean Hartman.
In consideration of the revised preliminary plat for Fairfax
Heights Subdivision, represented by Doug Frederick, Hart-Frederick
Consultants , it was moved by Selzer that the Plat be approved
subject to and contingent upon the developer retaining ownership of
the the retention basins until the TIF , is paid off and then deeded
to the town with the basins cleaned to original basin condition.
Also subject to the recommendations from Dick Ransom of Hall & Hall
Engineers . Seconded by Stallman. Passed 4 to 0 . The reason for the
conditions is that we will receive no spendable dollars return from
the development until the TIF is paid off ..
Shakespeare moved that the City Council work with ECIGOG to
develope a revision of the City Zoning Code, Seconded by Selzer .
Passed 4 to 0 .
Moved by Selzer that the Planning Zoning Board meet regularly on
the Monday just prior to the Council Meeting, of each month.

ORDINANCE NO. 2,15
AN ORDINANCE ADOPTING AN OFFICIAL ZONING MAP FOR THE
CITY OF FAIRFAX, IOWA., AND ESTABLISHING DISTRICTS, AS
SHOWN ON THE OFFICIAL ZONING MAP OF THE CITY.
BE IT ENACTED by the City Council of the Fairfax, Iowa, that the
City's existing zoning map, as established by Ordinance No. 210 , "A
Zoning Ordinance for the City of Fairfax, Iowa", and adopted
January 13, 1 9 9 8 is repealed and the following adopted in lieu thereof:
PURPOSE
The purpose of this Ordinance is to adopt an official zoning map of
the City of Fairfax, Iowa, and establish by reference to the official zoning
map, zoning districts, as created in Ordinance No. 208 of the
Ordinances of the City of Fairfax, Iowa.
ADOPTION
As established by Ordinance No. 208 , Section 1 . 07
The City of Fairfax is divided into nine classes of districts. The 3,
boundaries of these districts are hereby established, as shown on the official
zoning map of the City of Fairfax, Iowa, and said map and all notations,
references and information shown thereon shall be, and are hereby made a
part of this Ordinance by reference. The official zoning map signed by the
Mayor and properly attested by the signature of the Clerk, and the date of
adoption, shall be and remain on file with the City of Fairfax; Iowa, as
provided in Ordinance No. 208 , Section 1 0 7 . 01
REPEALER
All Ordinances or parts of Ordinances in conflict with the provisions
of this Ordinance are hereby repealed.
SEVERABILITY
If any section, provision or part of this Ordinance shall be adjudged
invalid or unconstitutional,, such adjudication shall not affect the validity of
the Ordinance as a whole, or any section, provision, or part thereof not
adjudged invalid or unconstitutional.
This Ordinance shall be in effect from and after its final passage and
approval and publication, as by law provided.

It was a pleasure to meet you at the Linn Housing Council meeting held on June 6'h.
During that meeting I announced that I was completing a Linn County housing needs
assessment. This document will contain information necessary for cities, and the county,
to obtain'grant funding for housing projects. A critical part,of the assessment is meeting
with local residents to discuss and document their housing concerns.. I am writing you to
seek your assistance in arranging a focus'group meeting in Fairfax.
I will need you to recommend a meeting site in Fairfax and the names of key people to
invite to the meeting. I would also like the name and phone number of the newspaper

These are the City ordinance cites you may vi,sh to review
prior to next Council m ting;
In Title III, Chapter 1 (Nuisances) Article 1, section 3
1,0101 defines nuisances and gection 3-1.0102 prohibits them;
and Article 2 states the procedures for stepping them.
In 'Title III, Chapter 3 (Liquid Wastes) f Article 11 sections
3-3. 0104 (4) through (6) prohibit certain acts at issue here,
and 3-3 .0105 requires as sewer connection for essentially any
building within the city (Fused for human occupancy,
employment, recreation or gather purpose") . Enforcement
procedures and special penalties are set forth at 3-3 . 0110.
